SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated May 15, 2019 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject non-conforming, rectangular 12,441 square feet, .286 acre parcel located in the R40 Zoning District measures 184.20 feet along Legion Avenue, then turns east 70 feet along the continuation of Legion Avenue then runs south 172.85 feet along a residentially developed lot and returns 69.84 feet along a developed lot, to the south, containing a church. The site is improved with a two-story frame house, roof over porch under construction, roof over stoop under construction, an accessory frame garage, stone driveway and stockade fence as shown on the survey prepared by Nathan Taft Corwin IIl, Land Surveyor and dated February 2, 2019. BASIS OF APPLICATION: Request for a Variance from Article XXIII, Section 280-124 and Building Inspector's February 8, 2019 Notice of Disapproval based on an application to legalize "as built" additions and alterations to an existing single family dwelling; at, 1) less than the code required minimum front yard setback of 35 feet; located, at 400 Legion Avenue, Mattituck,NY. SCTM No. 1000-142-2-8. RELIEF REQUESTED: The applicant requests a variance for additions and alterations to an existing single-family residence including the conversion of the second floor attic area into living space consisting of two bedrooms and a `future' bath, an `under construction' rear covered porch and the addition of an "under construction" covered front porch measuring 8 feet by 30.2 feet with a proposed front yard setback of 19.7 feet where the code requires a front yard setback of 35 feet. Page 2, September 26,2019 #7312, Lazzaro SCTM No. 1000-142-2-8 ADDITIONAL INFORMATION: An immediate neighbor, Advent Lutheran Church, wrote a letter of support for this application. No other neighbor or member of the public spoke in favor of, or against this application. Pre- Certificate of Occupancy #Z-22155 issued February 24, 1993 was included with this application illustrating that this house and accessory one car detached garage was built prior to April 9, 1957. The Town of Southold Building Department issued a stop work order on October 15, 2018 for construction beyond the scope of building permit #42287, which includes the covered front porch requiring front yard setback relief. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on September 12,2019 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law &267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Legion Avenue is an "L" shaped road connecting Main Road aka State Route 25 with Sound Avenue via Pacific Street. While it is zoned R40 residential, it is a mixed-use neighborhood developed prior to zoning and is comprised of a cemetery, a warehouse, a church and single-family residences. The subject parcel is in close proximity to properties in other zoning districts, with greater uses, including the Residential Office, Business, and Light Industrial zones. Moreover, the applicant proposes to construct a covered front porch which is common to homes in this neighborhood and will visually enhance the streetscape opposite a cemetery. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The home' existed prior to current zoning in its present location and the applicant proposes to enhance their residence with a covered front porch,which can only be placed on the front of the house. While the porch meets the primary front yard setback, because the house is located on a corner, relief is required for the second front yard setback, given the structures existing proximity to the road. Almost any conforming addition to the front of the house, on the northside, will require relief from the code to meet current setback requirements on the western fagade. 3. Town Law §267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 43.7% relief from the code. However, the house existed prior to current zoning and the applicant proposes no increase in the non-conformity. The applicant proposes to maintain the current fagade and meets the front yard setback requirements for the addition of the covered front porch on the north fagade which is greater than the required 35 feet setback. 4. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law &267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a covered front porch and other additions and alterations including a covered rear Page 3, September 26,2019 #7312,Lazzaro SCTM No. 1000-142-2-8 porch and conversion of second floor attic space into conditioned living space consisting of two bedrooms and a bathroom while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Planamento, seconded by Member Weisman, and duly carried, to GRANT the variance as applied for, and shown on the survey prepared by Nathan Taft Corwin III, Land Surveyor, and dated February 2, 2019 and shown on the architectural drawings, labeled Sheet 1-8 and D1-3, prepared by Christopher Garten Architect and dated January 10, 2019. SUBJECT TO THE FOLLOWING CONDITIONS: 1. Prior to receiving a building permit, the owner(s) of the subject property cited herein must sign a statement acknowledging: a. That the applicant(s) have read this determination and understand the limits of the variance relief granted herein; b. Any deviation from the variances) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. In the event that an approval is granted subject to conditions, the approval shall not be deemed effective until the required conditions have been met; and failure to comply therewith will render this approval null and void. ' Section 280-4 of the Town Code defines "Demolition' as any removal of a structure or portion thereof, where the total cost of the reconstruction of the structure or portion thereof exceeds 50% of the market value of the existing structure before the start of removal.
