SUFFOLK COUNTY ADMINISTRATIVE CODE. This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated May 3, 2019 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated August 27, 2019. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action is CONSISTENT with LWRP policy standards and therefore is CONSISTENT with the LWRP. PROPERTY FACTS/DESCRIPTION: The subject non-conforming, 30,507 square feet, .70 acre, irregular shaped parcel located in the R40 Zoning District measures 131.67 feet to the tie line along the Great Peconic Bay establishing a southern lot line, then arcs 378.23 feet along Nassau Point Road establishing an eastern lot line, and returns 351.62 feet along a residentially developed lot to the north. The site is improved with a two story frame house encircled by wood decking and steps, a roof over wood entry porch, a blue stone gravel driveway, multiple wood tie retaining walls, a partially covered wood waterside deck and wood frame shed as shown on the survey prepared by Nathan Taft Corwin III, Land Surveyor and dated March 6, 2017. BASIS OF APPLICATION: Request for Variances from Article III, Section 280-15; Article XXIII, Section 280- 124; and Building Inspector's February 5, 2019, Amended May 6, 2019, Notice of Disapproval based on an application to construct an accessory garage; at, 1) located in other than the code permitted rear yard; 2) located less than the code required front yard setback of 40 feet; 3) located less that the code required rear yard setback of 15 feet; located, at 10550 Nassau Point Road (Adj. to Little Peconic Bay), Cutchogue, NY. SCTM No. 1000-119- 1-16. Page 2, September 26,2019 #7308,Heagerty SCTM No. 1000-119-1-16 RELIEF REQUESTED: The applicant requests variances to construct a wood frame garage with half-bath measuring 22 feet by 22 feet, for approximately 484 square feet, with a ridge height of 20 feet, including a finished second floor storage area measuring 22 feet by 19 feet, for approximately 308 square feet, with a front yard setback of 12.8 feet where the code requires a minimum front yard setback of 40 feet and with a side yard setback of 9.10 feet where the code requires a minimum side yard setback of 15 feet. ADDITIONAL INFORMATION: No immediate neighbor, resident of the Nassau Point community or member of the public spoke in favor of or against this application. The subject parcel is located at the southern end of Nassau Point Road and is adjacent to a public beach access. The triangular, waterfront lot has substantial road frontage, varying topography and is well landscaped. The residence is sited on a hillside with an excavated area accommodating a pervious driveway. Town zoning code allows waterfront property owner's the right to place accessory structures in the front yard provided the applicant meets setback requirements. The applicant proposes to include electric and water to service the accessory structure and includes a garage level half-bath consisting of toilet and sink and states the finished, second floor will not contain plumbing nor will it be conditioned. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on September 12,2019 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The Nassau Point community was primarily developed in the mid- 20th Century and consists of varying lot sizes and shapes taking advantage of the natural terrain with a variety of housings styles and sizes, many of which contain detached multi-car garages or accessory buildings on similar waterfront parcels. The proposed non-habitable garage with second floor storage is in keeping with the design and scale of the primary residence and character and location of typical waterfront residences found elsewhere on Nassau Point. Furthermore, the proposed structure will be sited on a hillside accessed by an existing driveway area that is recessed below surrounding grade reducing the scale and massing of the garage and preserving existing mature oak trees which will be supplemented by additional proposed evergreen landscaping. 2. Town Law 2 267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. As the result of a long and narrow, triangular-shaped, waterfront lot with dramatic topographic contours and substantial, curving road frontage, there is no level, conforming building envelop available to accommodate an accessory building. 3. Town Law §267-b(3)(b)(3). The variances granted herein are mathematically substantial, representing 68% relief from the code relative to a front yard setback and 39% relief from the code relative to a side yard setback. However, there is no other location on the parcel to site an accessory structure without the benefit of relief given the irregular, narrow shape of the lot and substantial road frontage. Moreover, if the proposed accessory garage were relocated elsewhere on the site, major ground disturbance would occur resulting in a loss of landscaping, native vegetation and potentially disrupting the Board of Health approved sanitary system and existing retaining walls. 4. Town Law &267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. Page 3, September 26,2019 #7308, Heagerty SCTM No. 1000-119-1-16 5. Town Law V67-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law X267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an accessory garage structure measuring 22 feet by 22 feet with a ridge height of 20 feet including a garage level half bath with a finished, unhabitable second floor storage area while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD- In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Planamento, seconded by Member Dantes, and duly carried,to GRANT the variances as applied for as shown on the site plan, labeled Sheet 1, prepared by Samuels & Steelman Architects and dated January 30, 2019 and the garage plan, labeled Sheet 2, prepared by Samuels & Steelman Architects, and dated August 5, 2019. SUBJECT TO THE FOLLOWING CONDITION: 1. The accessory garage shall remain non-habitable, unconditioned storage space without plumbing on the second floor. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variances) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does naauthorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. In the event that an approval is granted subject to conditions, the approval shall not be deemed effective until the required conditions have been met; and failure to comply therewith will render this approval null and void. In your letter you explain that the Town Code has been revised to allow the size of dormers in accessory buildings to be constructed up to 80%of the roof width, an increase from 40%, and that your design proposes to construct dormers to measure only 45% of the roof width. I reviewed the associated architectural renderings (Sheets 3 and 4) dated October 29,2019 and the Zoning Board of Appeals determination No. 7308. The applicant was granted relief for an accessory garage having less than minimum required front yard and side yard setbacks. The proposed modification does not impact any of the aforementioned relief granted.
