SUPERVISOR RUSSELL: Can everybody please rise for the Pledge of Allegiance? Thank
you. What I would like to do before we get to the business of the agenda, there are some people
I need to thank for putting this day together. First I would like to thank you, all the elected
officials and guests, for taking the time out of your busy schedule to make the trip, also to the
Fishers Island Ferry District commissioners and Captain RJ Burns and his crew for providing the
transportation. I want to thank Plum Island and Department of Homeland Security, Dr. Larry
Barrett and the security staff for use of their dock and parking facility. It saves the Town and
guests a tremendous amount of time and money. The Fishers Island School for being such a

gracious host, the Fishers Island residents for always welcoming us and participating in the
meeting. The Fishers Island Highway Department for assistance in setting up. Legislator Al
Krupski for donating the corn. Southold Fire Department for donating the ice. The Department
of Public Works for helping bring everything over and setting up, they work very hard. Carol
Hydell of the Human Resource Center and Regina Blasko of the Police Department for helping
assist with the check in process and the luncheon. Special thanks to Lauren Standish and
Michelle Tomaszewski, who coordinate the entire event of the day which makes this trip
possible. Thank you. I want to recognize some of our state and county officials who are in
attendance, we have representing Congressman Lee Zeldin, Mark Woolley. United States
Senator Charles Schumers office, we have Garrett Armwood, the Long Island Regional Director
representing the Senator. Oh, yes, can you do me a favor and stand up, so people know who you
are. From Governor Andrew Cuomo's office, we have Theresa Santoro, Suffolk County
Regional Representative. From State Senator Ken LaValle's office we have Senator LaValle
representing himself and Jennie Ingebretsen from his office. From Assemblyman Anthony
Palumbo's office we have Angela Noncarrow, chief of staff. And we have our Legislator Al
Krupski, representing District I.

SUPERVISOR RUSSELL: Okay, usually the way the meetings are organized is that I would
take public comment at this time on any of the items as they appear on the agenda but I see a
group of people that are here that has an issue that is very compelling for them and I would like
for them to be able to go first, if they would like to make comments, if they would like to present
anything, please feel free. All I ask is that you speak into the microphone and give your name
and hamlet for our minutes.

GEORGE DE MENIL: Thank you for being here. My name is George deMenil, I am a voter on
Fishers Island, I am a resident on Fishers Island for many years. And I have come to ask for
your support for safe sidewalks and an extension of the bike path. We have circulated a petition,
I would like to read the petition. It's addressed to you, Mr. Russell, We the undersigned, cyclists,
walkers, baby carriage pushers, car drivers and all the families of Fishers Island, ask you to live
up to your promise to repair and build sidewalks at the wester end of the hamlet, and to support
the construction of a recreational path between the post office and Wilderness Road. Cyclists
young and old and parents pushing baby carriages who are obliged to walk on the existing roads,
without shoulders or sidewalks, risk being hit by cars and trucks turning a blind corner, of which
there are many. Drivers in the community have on occasion rounded a corner to find a mother on
a large bike next to a child on a small bike in the oncoming lane, with a contractor's truck
heading down the road in the opposite direction. Both sidewalks and the recreational path are
urgently needed. The Fishers Island Recreational Path Foundation has offered to foot the bill for
the first stretch of a recreational path, past the Naval Underwater Systems Center. All the
township needs do is authorize that first segment. We are confident that the Navy will also do
so. Let's get started. This petition, Mr. Russell, has been signed by 1,182 people, half of the
registered voters on Fishers Island and half of the adult seasonal population have signed. Some
have signed on paper, some have signed electronically. This has been an eye opening
experience. When my daughter Victoria and I set on this effort, we expected that we would
present you with 100 signatures. The petition caught on like wildfire. I have spoken with many
people, people working on Fishers Island, island contractors, parents, kids,property owners who
are upset and they feel that we are not being heard. It has been deeply troubling to hear several
year round residents say Southold does not like us. We did this without telling either the
Community Board or the Rec Path Foundation, the effort was spontaneous. it hit a sore nerve.
That is why, Mr. Russell, this number of people have signed. This is not Fishers Island's only
need. Many of the paved roads on the west end have pot holes that need repair but please let's
get started on safe sidewalks and the bike paths before the accident that we fear occurs. Matty
Lusker and Cecily Reed, will you please present this petition to Mr. Russell. These young
people are accompanied here by 11 other young cyclists. Thank you.
SUPERVISOR RUSSELL: Thank you for creating this petition and making this process work.
This is exactly how it gets done, it is holding public officials accountable. I have to tell you, I
think 1,200 signatures is probably one of the largest petitions I have received in my 14 years of
doing this. That's a testament to your hard work and I admire each and every one of you.

CHIP DUPONT: Scott, while we are on the subject of sidewalks, last year I believe a sidewalk
was supposed to be repaired and I understand the contract was withdrawn for some reason and I
don't know why but it was not repaired and I have got a souvenir for you. Inaudible. That
sidewalk, I was walking with all the school kids and did a face plant, I got seven stitches in my
forehead. The doctor said if I wasn't so hard headed, I probably would have gotten really injured.
That's what happens when we don't fix the sidewalks.

SUPERVISOR RUSSELL: Let me just address the sidewalk issue. Actually I had put a capital
project in place for$250,000. I will continue to do that over a five to seven year plan for the
restoration of the sidewalks in and around Fishers Island. The project that was supposed to be
done in 2019, in between that starting, the engineers had secured a grant to upgrade all of the
lead (inaudible)water service in the area. We have been trying to coordinate with the utility
company, who from what I understand is going to dig that up and implement for those changes,
to upgrade to make the water safe. Southold Town couldn't move forward with a sidewalk until
that work was done. I think we are on schedule now to start in Spring 2020. Now on the regular
business of the agenda, would anybody like to comment on any of the agenda items? (No

WHEREAS, there had been presented to the Town Board of the Town of Southold, Suffolk
County,New York, on the 2nd day of July, 2019, a Local Law entitled "A Local Law in
Relation to Amending Chapter 280 Zoning, to Allow Recreational Uses in the Light
Industrial Park/Planned Office Park(LIO) and Light Industrial (LI)Districts" and
WHEREAS, the proposed action is listed under 6 NYCRR § 617.4 (b)(2) as a Type I action as it
falls within the description of the adoption of changes in the allowable uses within any zoning
district, affecting 25 or more acres of the district, and;
WHEREAS, the Planning Department reviewed the proposed action and has recommended that
the Town Board adopt a"Negative Declaration" in a memorandum dated July 30,.2019, and
therefore be it;
RESOLVED,that the Town Board of the Town of Southold hereby classifies the action as a
Type I action pursuant to 6 NYCRR Part 617.4 (b) (2), and be it further;
RESOLVED,that the Town Board of the Town of Southold Town hereby declares Lead Agency
status for the SEQRA review of this Type I Action; and be it further;
RESOLVED, that the Town Board of the Town of Southold Town Board, as Lead Agency
pursuant to SEQRA, hereby makes,a determination of non-significance for the proposed action
and grants a Negative Declaration

SUPERVISOR RUSSELL: That concludes the business of the agenda. At this time I am going
to invite anybody that would like to address the Town Board on any issue?
Tom O'Neil, F.I. ICB
TOM O'NEIL: Tom O'Neil, Island Community Board.-Welcome Scott and Southold community
reps and all of you have come here today. Thanks for coming and thanks for your continued
civic service. The ICB has worked consistently and diligently over the last six years, providing a J
forum for serious discussion on Island issues, so that we can provide you Southold, with a
coherent snapshot of our Island needs., These monthly discussions vary around a multitude of
issues. As with any community, such as housing, schooling, roads, waste management, water,
fire, lights, environmental just to name a few. To this end, we have created a living document
that is updated monthly by all our constituents in our Google docs that we share with you in
Southold. Two years ago we received funding from you, of$1.25 million over the next six years
as well as $100,000 from Senator LaValle. The need for synchronicity between our utility
company and engineers delayed that project until the Spring of 2020. This project status is
underway and moving forward.' This year the ICBheld discussions around the following issues;
waste management presented an expansion plan to our community. Discussion took place on a
community level and our waste management board decided to listen to the communal needs and
revise its plans. Our school has begun a fundraising campaign for capital improvement, the
utility has begun a housing,project at the Briar Patch that will house two year round units. Walsh
Park has begun its housing project that will provide six apartments for much needed housing
needs. Thank you all for your help in these initiatives. Discussion around water needs and
upgrades has arisen and the ICB has encouraged synchronized developed discussion between all
involved partners. Specifically the utility company, the fire district and Fishers Island
development company. Rec path discussions continue and are moving forward, thanks to the
help of(inaudible). Civics requires discipline. I want to thank Southold and this group of
committed ICB members, who continue to advocate for Island needs in a disciplined and
thorough fashion. This is the way forward,petitions and civic complaints should be brought to
the ICB, we will continue our elected due diligence and will not be undermined by any last
minute items. Thank you again for your committed help and support, the ICB remains _
committed to providing a forum for serious civic engagement so that you, Southold, can better
understand our needs. Thank you.

WILLIAM SOPER: Thank you, my name is Willie Soper and I am a member of the ICB. And I
think under the circumstances, that repetition is the key to knowledge. I am going to repeat a lot
of what.you heard already but I think that it is important. First I want to thank you all again for
coming this year. Secondly, my compliments to the development of the comprehensive plan. It
seems to be well-done and shows just a tremendous amount of(inaudible). And thirdly, the
community thanks you for expediting the (inaudible). Now without dwelling too,much on the
past, I would like to speak to some of the Island's,needs and do so within the context of the

comprehensive plan. This is a little repetitious, so bear with me. Some highlights of the plan
include a focus on infrastructure, including roads, sidewalks and bike paths and a need to ensure
the safety of pedestrians, bikers and drivers. Improving infrastructure is very much a priority for
the Fishers Island residents as well. Thus it is a focal point for the ICB's strategic objectives.
Therefore, we are pleased to note that in chapter 24,page 21 your plan speaks to the goals of
increasing pedestrian and cyclist's safety, addressing sidewalk gaps, expanding bike network and
routes and in chapter 13 it specifically states Fishers Island goal of connecting the west end bike
path to the east end recreational path. To refresh everyone's memory and Tom did it but I am
repeating it, you were kind enough to commit to spend $1.25 million over a four year period on
our sidewalks which are in disrepair throughout the community, I underline that, not just the Fort
area, and as I mentioned earlier today, we may have most of the pedestrians on the sidewalk and
the riders be in the Fort area in the winter but in the summer we have children riding all over the
place and walking. Additionally, Senator LaValle promised an additional $100,000 for road
repair. We realize for many reasons, some of our own doing in trying to coordinate the utility
company activities that nothing has happened yet and are happy to hear that the money promised
by Senator LaValle has finally been appropriated and will be used on our roads. We are also
pleased that the utility company will initiate its Fort area project this fall and that the town will
start on the sidewalks this coming spring. However, since this process has taken so long and
since the need for better roads, safer sidewalks throughout the community and dedicated bike
paths are crucial to the safety and well-being of both summer and year-round residents, we
respectfully request that the town Supervisor continue to be proactive in moving the bike path
extension forward and that the highway department provide a three year projection of what will
be done and when to prepare the sidewalks and roads. As taxpayers that provide 10-12 percent
of the town's yearly revenue, we would like to see some specific attention to these long overdue
needs. On a personal level, last year my 12 year old grandson broke his arm falling off his bike
while riding home on a broken sidewalk on Montauk Avenue. This summer I have had the
pleasure and the scare of riding bikes from the east end to the west end with my 7 and 9 year old
granddaughters. As I understand it, the Bike Path Foundation is willing to fund the construction
of the path and all that is needed from the town is to continue to follow up with the Navy and to
provide some engineering support. The ICB hopes this can happen soon because the safety risks
are huge. Additionally, chapter 13 of the comprehensive plan speaks to the goals related to
parks, recreation and open space. The community, through notes, comments and emails to the
ICB fully agree with these goals and would A. suggest that the extension of the bike path fits
with the recreation objective and B. as a strong desire to ensure that the Parade Grounds owned
by the town and managed by the ferry district be changed from 10 acre zoning to designated
parkland for open space. In summary, the ICB's mission is to encourage and facilitate
communication among Island organizations and act as a primary intermediary.for consistent
open and focused communication with Southold. We believe the second objective provides
benefits to all but will only be perceived as relevant if we translate it in the results that benefit
the community. Additionally we believe that an informed community is a more productive one.
With that in mind, we ask that in addition to getting the three year projection of Fishers related
projects from the highway department, that the following questions be answered in the coming
weeks and these questions are, over the past five years on average what percent of the highway
department expenditures have been spent on Fishers Island? Two, over the last five years, on
average, how much of the highway departments yearly expenditures on Fishers Island have been

for capital improvements and major repairs versus salaries and routine maintenance? And how
does this compare to the other hamlets. Three, with respect to the comprehensive plan focus on
open space, please provide a summary of the amount of money that has gone into the 2% from
Fishers Island over the past five years and how much has been spent from the fund on Fishers
Island? Four, on a personal note I would ask that where possible, the highway department
review and approve intersection site lines and seriously consider making the intersection of
Montauk and Oriental Avenue a three way stop. This would help the slowing down of traffic
and improve safety at the intersection for all.

SUPERVISOR RUSSELL: Thank you. One or two of the questions I can answer immediately,
with respect to the comparison on how much gets spent on each hamlet versus the hamlet of
Fishers Island, the $1.25 million I proposed for sidewalk repair, not only exceeds any of the
hamlets in Southold, it exceeds all of the hamlets in Southold combined. But we'do need
cooperation, and I understand that there's mobilization and things aren't as easy as they seem but
we've been ready to go, they're designed, we're ready to go and now we need other agencies to be
ready to go. Okay but right now it looks like spring of 2020. Who else would like to address the
Town Board on any issue?
John McGillian,Pres.Recreational Path Foundation
JOHN MCGILLIAN: I am John McGillian, President of the Recreational Path Foundation. It's
been four years, as you know we have been talking about this extension along the path. To give
you a little color on this, Scott basically said to me two or three years ago that he didn't think the
Navy would ever approve the transfer of the land from the Navy to Southold. We actually were
very lucky to have someone in the community who was indirectly friendly with the Secretary of
the Navy and the Secretary of the Navy, Richard Spencer, called up Scott and so what I am
really asking for is the commitment, Scott has said it's not in the budget to build this path
extension. I told him we would pay for it privately ourselves but we still needed his staff to
spend some time and energy on dealing with the Navy on this transfer. So I am asking you
publicly make that commitment of your staff to make this happen and we will try to get the Navy
to do everything you,need to be able to make this happen. Thank you.

SUPERVISOR RUSSELL: Thank you very much. I just want to correct a few statements. First
I never said that I don't think the Navy would transfer the property, I don't know what the Navy
is willing or not willing to do. Secondly, the Secretary of the Navy didn't contact me, I contacted
him. And we had discussed at the time that there are probably some steps in the process GSA,
government services, general services administration probably has a process that they have to
follow to alienate land to other agencies even governments. There's also some conditions that
they are going to want in return. I had given him my email, he was going to email me all of the
information. To date, I haven't received it, I don't have documents to review, I think that there's
an impatience that I haven't signed the dotted line, I haven't been presented with a dotted line.
And that's part of the problem. Thirdly, providing the engineering support, we've put a
tremendous amount of effort, made a huge commitment with both engineers of Southold Town
to work with a surveyor, to work with an engineer I believe that the committee had worked with,

we had done quite a bit of that in the past. In fact, ultimately, that's where the issue of the
traversing over Navy property came. But I really need documents sent to me and I understand
there is someone here who is very close to the Secretary of the Navy, I believe a relative. Please,
have that person, I have done that, I gave him my email. I am waiting for documents back. I
can't evaluate anything until I have them in hand. Who else would like to address the Town
Board? Please.
Laura Nigro
LAURA NIGRO: My name is Laura Nigro. You had kindly put me in touch with the Town
Attorney. The level of noise that is coming from the Peqout as a result of the new owners is
excessive. We come to this Island because of its quiet respite, we come to this Island because it's
a unique environment. I am a homeowner, we have been here for 17 years, I have never
complained. I've called the State Police now four times. They have bands outside on their patio,
it literally shakes the windows of my home. You have a town ordinance that restricts the use of
amplifiers for sound and they are going unabated. On Sunday they had a woman doing an
acoustic guitar with amplifiers that played from 6 PM to 8 PM. As I sit down for dinner, the
Pequot has graciously selected my dinner music. It is beyond belief. It is not the environment
that we intend to have and I appreciate the Board's continued support in helping me come up
with a solution so that the Town has the tools that it needs in order to enforce their own code.

TRACY LEVY: My name is Tracy Levy and I live in Laurel. I am a Southold resident and I
thank the Town Board for being so kind for bringing me over. I am a member of the Helicopter
Noise Steering Committee. But I actually would like to call out the lack of respect for the people
who fly over our homes. Here on Fishers Island,there may or may not be an issue now with
helicopters or seaplanes or traffic that's just a little bit too low. Pilots are not flying at altitudes
that are high enough to get into noise issues. And I can appreciate what you're saying but we
have noise issues from so many different directions. I see Senator Schumer's representative and
the Governor's representative left the room, that's not good. I have flyers if anybody wants to get
into complaining about this. We are trying to work with the Town Board to get the FAA's
attention. We are trying to work with Congressman Zeldin's office, so my name is Tracy and I
have flyers and I would be happy to email them but it's about trying to get respect, I am not
against capitalism, I really believe that helicopters serve certain populations well but they have to
be respectful of those of us who live on Long Island and Fishers Island. You are being besieged.
I watched the traffic going to Martha's Vineyard and Nantucket and Block Island. It's kind of
crazy. So I am like being, you know, it's the aerial LIE going to the Hamptons over my house. It
doesn't really matter, we are all in this together. We are all residents, we all want to be respected
and I think if we get some respect from the FAA and our federal officials can get there, and hand
in hand with the town, that we can better people. So if you would like, you are more than
welcome to come up to me and I will give you one or email it to you. Thank you very much.

SUPERVISOR RUSSELL: Who else would like to address the Town Board on any issue? I just
want to make a couple of comments. First, I appreciate being held accountable. That's the right
approach. I understand that. But there are some expenses that maybe aren't as readily apparent
as people might think that are specifically designed for the benefit of Fishers Island. One of the
issues is, as you know, there's a pending federally approved project for dredge spoils to be taken
from the Connecticut River and placed off-shore. Southold Town,New York State has filed
litigation to stop that project. I also want to point out that Southold Town was the only town, the
only government at the town, village or state level to join that lawsuit, to stop it. It's a
considerable expense to the town but its money well spent. I also want to, you know what? I
have one more and it's a good one but I forgot what it was, well, oh, one thing I wanted to
mention, this is the good one. We are actually either just about to sign or already signed a
contract for the acquisition of the 5.4 acre parcel,known as Middle Farms from the utility
company. That was the good,ono. Anybody else? (No response). Thank you for coming.
