SEVERABILITY If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law as a whole or any part thereof other than the part so decided to be unconstitutional or invalid. IV. EFFECTIVE DATE This Local Law shall take effect immediately upon filing with the Secretary of State as provided by law. I have a notarized affidavit that this hearing has been noticed in the Suffolk Times and a signed and notarized that this was published on the Town Clerk's bulletin board and on the town website. I do have a memorandum from the Planning Board office, thanking us to provide comments on the above referenced local law, the Planning Board supports the proposed legislation but offers the following comment, `In the LIO zone, recreational facilities are a permitted use if the following criteria are met: a minimum parcel size shall be three acres and b, there shall be three acres for each use. The addition of the recreational facility minor as permitted use in the LIO zone will allow a facility to be located on a parcel less than three acres in size which is seen as a benefit for those activities that require smaller areas. The second criteria requires three acres for each use. To improve clarity, it is recommended the Town Board clarify that the term use only applies to those listed in the use regulations within each zoning district to provide a distinction from recreational activities. It is further recommended that the definitions involving recreational uses in the town code are cross referenced for congruency.' Public Hearing Amendments to Chapter 280, LIO July 30, 2019 page 5 And I have memorandum from the LWRP director, the proposed local law is proposed to be consistent with the LWRP policy standards and therefore is consistent with the LWRP. SUPERVISOR RUSSELL: Just a clarification before we move forward, an LI zone (inaudible) I have to presume the three acres only applies to the LIO which is the bulk schedule for the code. TOWN ATTORNEY DUFFY: Yes, well this is recreational facility minor and that was for recreational facility which is a separate definition so it doesn't apply, this doesn't... SUPERVISOR RUSSELL: Okay, so just so I understand, recreational facility minor, all of the uses are permitted, multi-purpose uses under one roof? TOWN ATTORNEY DUFFY: Yes. SUPERVISOR RUSSELL: And there is no single use component to that? TOWN ATTORNEY DUFFY: Right. They are all one use under one umbrella, so to speak. That section that the Planning Board was concerned about was really for a different definition, a different type of use altogether. It's for more outdoor uses and things. (Inaudible) So for this it's all one use under... SUPERVISOR RUSSELL: One use based on the current bulk schedule. So if it's an LI zone, it's considered a use and only one acre requirement? TOWN ATTORNEY DUFFY: Yes. SUPERVISOR RUSSELL: Okay. But the multiple uses can take place under one roof? TOWN ATTORNEY DUFFY: Yes. SUPERVISOR RUSSELL: I thought the intent was to limit it to one or two uses, based on the intensity. TOWN ATTORNEY DUFFY: Well, I am saying that if it's one facility, one business, it might have more than one activity going on under their roof, that's fine but if it's different organization of facilities, it would be different uses. COUNCILMAN GHOSIO: I also have a memorandum here from the Planning Board office, that this is determined that it is a type I action therefore it is subject to SEQRA review. And under 617.4, the adoption of changes in the allowable uses in any zoning district affecting 25 or more agents in the district, a negative declaration of the action is recommended. If the negative declaration is issued, a copy must be filed with the environmental notice bulletin board. I am sorry, with the environmental notice bulletin. And a letter from SC Department of Economic Development, that this is a matter to be considered for local determination, there is no apparent significant county-wide or inter-community impacts. And that is it. Public Hearing Amendments to Chapter 280, LIO July 30, 2019 page 6 SUPERVISOR RUSSELL: Would anybody like to address the Town Board on this particular local law? STEPHANIE PIRAINO: Hi, I am Stephanie Piraino, I would like to thank you for getting us this far. from what I understand, everything sounds like it's moving in the right direction. I just have a few quick questions. As far as the one acre for multiple use, we had discussed, well, everyone had discussed it would be for single use but cheerleading is still, if we are just doing cheerleading in the facility, this would still fall under what the zoning is allowing for on one acre? SUPERVISOR RUSSELL: Yes, it's defined. And my presumption is it's supposed to be, the original discussion was for single use. In other words, this is the menu, you can pick one of these uses, not having several uses under one roof because that would potentially undermine the whole purpose of the recreational overlay zone. But we will get clarification on that. Yes, that is a specifically listed definition. MS. PIRAINO: Okay, so if we are in that one acre zone, what then would be the next step we would take if this all goes as we hope? Once we get to the next step and we have a location, LI use, are there specifics that we need to maintain to stay within what the town requires such as parking, things like that? SUPERVISOR RUSSELL: Quite honestly, what you would do is, this is what our intended use is, this is the building. You apply for a building permit and then the building inspector will go over the list of things... MS. PIRAINO: Okay, just like any other business? SUPERVISOR RUSSELL: Like any other business. MS. PIRAINO: Okay, perfect. Do you guys have any questions for us? My understanding is now that we would go another two weeks and then vote. SUPERVISOR RUSSELL: The Town Board generally, we can vote at the close of any hearing on any local law. Generally when we get a lot of varying opinions, we will table for two weeks to take all of those points of view in serious consideration but it really depends on the outcome of the public hearing. MS. PIRAINO: Okay. I mean I guess what I would want to leave you with, as far as we are concerned we, obviously you know we need this type of space to operate. I just left practice right now in my little, itty, bitty space. It would be wonderful if it could be in a bigger space so it could run a little more seamless for the kids. If there are any questions or concerns that the Board may have, I am open to answer any questions. I know that this is not just about cheerleading and it does open doors for other recreational uses but right now I am just thinking about my kids and what I do with our kids on a daily basis. I really want to be able to afford this opportunity, so if there's any questions as far as our use that would sway us to the positive end, I am open to answer any of those. Sorry, I am flipping it a little here. Public Hearing Amendments to Chapter 280, LIO July 30, 2019 page 7 SUPERVISOR RUSSELL: You have provided so much information to the Board, I can't think of any question that hasn't already been answered. MS. PIRAINO: Okay. SUPERVISOR RUSSELL: I can't speak for the rest of the Board. COUNCILWOMAN DOHERTY: No, I don't have any questions. MS. PIRAINO: Okay, well thank you very much. SUPERVISOR RUSSELL: Who else would like to address the Board? CHATTY ALLEN: Chatty Allen, Greenport. I am here in support of this and hoping that this is going to move forward in their favor. I spoke at the last meeting, that some of these girls are going into 7th grade now, I have been watching them since they were in kindergarten. This is beyond amazing, this program. What these young athletes do and they go away and they win first place after first place and they are in a space where they can't even do their full routines. So it is amazing what these young girls are doing and I really hope that this can go through for them so they can have the space that they need so we don't lose this from Southold Town because if there is no space available, we are going to lose this program for a lot of our young youth here and this is a phenomenal program. I am not a parent, I don't have a child in this but I follow them and they literally blow me away and I don't want to see our youth lose out and our town, our town should be so proud of North Fork Cheer and what these girls can do. So 1, you know, from what I am hearing it seems like this will move forward positively and that's what my hope is that's going to come out of this. So thank you. SUPERVISOR RUSSELL: Thank you. The use is defined as: Fully enclosed indoor recreation facility that provides soccer, baseball, basketball, tennis, cheerleading, swimming and other sport activities instruction or education to "r Negative Declaration Page 2 of 3 July 30, 2019 participants in multiple classes, sessions or events. Facilities are open to members, participants and guests only. A member, participant or guest charge may be applied. Recreational uses shall not include gambling, racing and amusement parks. Reasons Supporting This Determination: A Full Environmental Assessment Form (FEAF) has been submitted and reviewed and it was determined that no significant adverse effects to the environment were likely to occur should the project be implemented as planned. The determination was based upon, the following: This proposed action will not result in moderate to large adverse impacts. The proposed local law amends the LI and LIO Zoning District to allow a recreational facility, minor as a permitted use. Currently there is not a project that would physically impact the environment proposed. If and when a project is proposed, site plan review and separate SEQR review for the action would be required by the Planning Board. 1. No moderate to large impacts to groundwater quality or surface waters are expected. 2. No substantial adverse change in existing air quality is expected. 3. No moderate to large increase in traffic or levels are expected. Impacts to transportation will be assessed during the site plan process. 4. No moderate to large increase in noise levels are expected. 5. No substantial increase in solid waste production is expected. 6. No potential of erosion, flooding, leaching or drainage problems will occur as a result of this action. Chapter 236 Stormwater Management requires that applicants retain and dispose of storm water on-site. 7. No significant removal or destruction of large quantities of vegetation or fauna, no substantial interference with the movement of any resident or migratory fish or wildlife species, no moderate to large adverse impacts on a significant habitat area, threatened or endangered species of animal or plant or the habitat of such a species, and no moderate to large adverse impacts to natural resources are expected to occur as a result of this action. 8. The proposed action is not in material conflict with a community's current plans or goals as officially approved or adopted. Providing opportunity for the population to access recreational facilities to meet recreational needs is supported by the new Southold Town Comprehensive Plan Parks and Recreation chapter. 9. The proposed action will not significantly impair the character or quality of important historical, archaeological, architectural, or aesthetic resources or of existing community or neighborhood character. A specific action is not proposed at this time. When the use is proposed the Planning Board will review the application to Article XXIV Site Plan Approval of the Southold Town Code. The action would also be reviewed to the Town of Negative Declaration Page 3 of 3 July 30,2019 Southold Local Waterfront Revitalization Program. Further the Town of Southold Architectural Review Board and Southold Town Engineer Office would review the action. 10. No major change in the use of either the quantity or type of energy will occur. It is expected that the energy used to power a future facility would increase. Alternative renewable energy systems such as solar would be encouraged offset peak use in the correct circumstances and reduce energy consumption. 11.No creation of a hazard to human health is expected to occur as a result of this action. 12. The proposed action will not cause a substantial change in the use, or intensity of use, of land including agricultural, open space or recreational resources, or in its capacity to support existing uses. The lead agency must complete Part 3 for every question in Part 2 where the impact has been identified as potentially moderate to large or where there is a need to explain why a particular element of the proposed action will not,or may, result in a significant adverse environmental impact. Based on the analysis in Part 3,the lead agency must decide whether to require an environmental impact statement to further assess the proposed action or whether available information is sufficient for the lead agency to conclude that the proposed action will not have a significant adverse environmental impact. By completing the certification on the next page, the lead agency can complete its determination of significance. Reasons Supporting This Determination: To complete this section: • Identify the impact based on the Part 2 responses and describe its magnitude. Magnitude considers factors such as severity, size or extent of an impact. • Assess the importance of the impact. Importance relates to the geographic scope, duration, probability of the impact occurring, number of people affected by the impact and any additional environmental consequences if the impact were to occur. • The assessment should take into consideration any design element or project changes. • Repeat this process for each Part 2 question where the impact has been identified as potentially moderate to large or where there is a need to explain why a particular element of the proposed action will not,or may, result in a significant adverse environmental impact. • Provide the reason(s)why the impact may,or will not, result in a significant adverse environmental impact • For Conditional Negative Declarations identify the specific condition(s)imposed that will modify the proposed action so that no significant adverse environmental impacts will result. • Attach additional sheets,as needed. Part 2 is designed to help the lead agency inventory all potential resources that could be affected by a proposed project or action. We recognize that the lead agency's reviewer(s)will not necessarily be environmental professionals. So,the questions are designed to walk a reviewer through the assessment process by providing a series of questions that can be answered using the information found in Part 1. To further assist the lead agency in completing Part 2,the form identifies the most relevant questions in Part 1 that will provide the information needed to answer the Part 2 question. When Part 2 is completed, the lead agency will have identified the relevant environmental areas that may be impacted by the proposed activity. If the lead agency is a state agency and the action is in any Coastal Area, complete the Coastal Assessment Form before proceeding with this assessment. Tips for completing Part 2: • Review all of the information provided in Part 1. • Review any application, maps, supporting materials and the Full EAF Workbook. • Answer each of the 18 questions in Part 2. • If you answer"Yes"to a numbered question, please complete all the questions that follow in that section. • If you answer"No"to a numbered question, move on to the next numbered question. • Check appropriate column to indicate the anticipated size of the impact. • Proposed projects that would exceed a numeric threshold contained in a question should result in the reviewing agency checking the box"Moderate to large impact may occur." • The reviewer is not expected to be an expert in environmental analysis. • If you are not sure or undecided about the size of an impact,it may help to review the sub-questions for the general question and consult the workbook. • When answering a question consider all components of the proposed activity, that is,the"whole action". • Consider the possibility for long-term and cumulative impacts as well as direct impacts. • Answer the question in a reasonable manner considering the scale and context of the project. 1. • Attach additional sheets,as needed Negative Declaration attached. • Proposed projects that would exceed a numeric threshold contained in a question should result in the reviewing agency checking the box"Moderate to large impact may occur" • The reviewer is not expected to be an expert in environmental analysis. • If you are not sure or undecided about the size of an impact,it may help to review the sub-questions for the general question and consult the workbook. • When answering a question consider all components of the proposed activity, that is,the"whole action" • Consider the possibility for long-term and cumulative impacts as well as direct impacts. • Answer the question in a reasonable manner considering the scale and context of the project. The Planning Board supports the proposed legislation with the following comment: In the LIO zone, Recreational Facilities are a permitted use if the follow criteria are met: a. Minimum parcel size shall be three acres. b. There shall be three acres for each use. The addition of the Recreational Facility, Minor as a permitted use in the LIO zone would allow a facility to be located on a parcel less than three acres in size, which is seen as a benefit for those activities that require smaller areas. The second criterion requires three acres for each use. To improve clarity, it is recommended that the Town Board clarify that the term "use" only applies to those listed within the "Use regulations" within each zoning district to provide a distinction from recreational activities. It is further recommended that the definitions involving recreational uses in the Town Code are cross referenced for congruency. cc: William Duffy, Town Attorney OFFICE LOCATION: h0o S®TyOlO MAILING ADDRESS: Town Hall Annex P.O.
