Environmental Consulting Services on behalf of DAVID SCOTT KETNER requests an Amendment to Wetland Permit#7710 for the as-built 36'x17' swimming pool and 710sq.ft. patio in lieu of the originally permitted 30'x12' swimming pool and 550sq.ft. patio; install a dry well (301 cu.ft.) for pool backwash; connect roof leaders to the dry well; and install native plantings consisting of 16 sweet pepperbush (Clethra ainfolia) and 6 inkberry bushes (Ilex gabra), to be installed 6' o/c at the existing clearing limits. Located: 4321 Brooks Point Road, Fishers Island. SCTM# 1000-4-5-18 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, the proposed action is recommended as INCONSISTENT with the LWRP. 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction. 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. The as-built construction does not comply with Wetland Permit 7710. The patio encroaches further into the setback to the freshwater wetland. On January 18, 2012 the Board issued Permit No. 7710, for the construction of a 12'x30' pool, 550 sq. ft patio and required that gutters, leaders and a dry well to be installed and areas of disturbance to be planted with native vegetation. The as built conditions are a 36'x17' pool, a 710 sq. ft. patio and pool fencing. No leaders and dry well were installed and no native vegetation was planted. At this time the permittee is seeking approval to install a dry well (301 Cu. Ft.), connect the pool filter to the dry well, connect roof leaders to the dry well and install native plantings. The plantings shall consist of 16 Sweet Pepperbushes (Clethra ainfolia) and 6 Inkberry bushes (Ilex gabra). The plants shall be installed 6' o/c at the existing clearing limits.
