SCTM#1000-51-1-2 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards: Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, the proposed action is recommended as CONSISTENT with the LWRP. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. See LWRP Section III - Policies; Pages 22 through 32 for evaluation criteria. ® Yes ❑ No ❑ Not Applicable LWRP CONSISTENCY ASSESSMENT FORM ADDENDUM for NICKOLAUS PROPERTY 17555 SOUNDVIEW AVENUE SOUTHOLD, NY SCTM#1000-51-1-2 POLICIES 4, 5 & 6, The on-grade patio and related activities proposed within Chapter 275 jurisdiction are associated with a project designed to reestablish the historically existing use of a swimming pool on the property as part of a multi-year process of bluff restoration/stabilization and landward retreat of the previously situated dwelling and swimming pool. Specifically, the subject property was historically improved with a swimming pool from 1974 until 2015, at which time it was demolished and removed and the dwelling was relocated landward. Then in 2016 the bluff was re-graded, renourished, revegetated, and stabilized with terracing and a stone revetment at the toe (see Town Wetland and Coastal Erosion Management Permits 8682 & 8682C), at which time the bluff crest was repositioned up to 29 feet landward of the 2011 bluff crest location. The proposed pool is to be located more than 100 feet from the newly established bluff crest and thus outside Chapter 275 jurisdiction, but approximately 40 percent or 1,385 sf of the proposed 3,445 sf on-grade patio will be located within 100 feet of the bluff crest, thus requiring a Wetlands Permit. Although located at its nearest point 62 feet from the buff crest, most of the patio is' located at least 75 feet from the crest of bluff. And although the pool enclosure fence, two proposed stoops/landings, and portions of the proposed clearing associated with the project are also located within 100 feet of the bluff crest, all other work(e.g., proposed spa, arbor, and additional walks and patio area) is proposed outside Chapter 275 jurisdiction. To mitigate the additional impervious coverage created by the proposed patio, a trench drain and associated drywells (located outside Chapter 275 jurisdiction) are proposed to capture and recharge potential runoff form the patio; and a project limiting fence will be installed to contain site disturbance and potential runoff during construction. Therefore, the current proposals will have no significant adverse impacts on the adjacent bluff or tidal waters, and the longer term process of restoring the bluff and retreating the previously existing structures farther away from the bluff will continue to have the long-term impact of improving the environmental condition of the adjacent bluff/beach ecosystem associated with the tidal waters of Long Island Sound, all consistent with Policies 4, 5, and 6 of the LWRP. s See attached.
