En-Consultants on behalf of ANDREW TORGOVE & JONI FRIEDMAN requests a Wetland Permit
to remove existing "L" shaped dock consisting of a 3'x24' catwalk, 3'x10' ramp and 6'x16' float; and
construct in the same location (starting 6' landward and ending 18" seaward) a new fixed timber"L"
shaped dock consisting of a 3'x29' fixed timber catwalk constructed with open-grate decking and
elevated 4' above marsh grade, a 3'x12' ramp, and a 6'x16' floating dock secured by two (2) 8"
diameter piles. Located: 7165 New Suffolk Road, New Suffolk. SCTM# 1000-117-5-31
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based on the new submittal and my assessment, the proposed action is recommended
as CONSISTENT with the LWRP.
The dock is nearly identical in size to the pre-existing, permitted dock (Wetland permit 3888). It is
recommended that the Board clarify the dimensions of a representative vessel when assessing the
1/3 rule.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

LWRP CONSISTENCY ASSESSMENT FORM
A. INSTRUCTIONS
1, All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its si nificant
beneficial and adverse effects upon the coastal area (which includes all of Southold Townl.
If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency
review law. Thus, each answer must be explained in detail, listing both supporting and non-
supporting facts. If an action cannot be certified as consistent with the LWRP policy standards and
conditions, it shall not be undertaken.

POLICY 6
The proposed dock is to be constructed in place of a permitted (Wetlands Permit No. 3888), 27-
year old dock that is in a dilapidated condition. The new dock would be constructed in the same
location as the existing dock, which is positioned between a myriad of floating docks associated
with the commercial marina to the north and a'much longer adjacent private dock to the east.
The proposed dock allows for a 12'wide dockage space between the shore-parallel float and a
distance 30 feet seaward of mean lower low water, which represents one-third of the width of the
approximately 92' wide waterway at mean lower low water. The new dock would improve upon
the existing dock with respect to the environmental condition of the property and compliance
with the "construction and operation standards" for docks set forth by Town Code Section 275-
11(C)(2). Specifically, the new dock would be elevated four feet above the vegetated tidal marsh
grade, compared to the existing lowly elevated dock; the new dock would be constructed with
light permeable open-grate decking, compared to the traditional, treated timber decking of the
existing dock; and the new float would be offset 10 feet from the extended westerly lot line,
whereas the existing float is located only 2 feet from the extended property line. Therefore,
consistent with Policy 6, the proposed replacement dock would not cause a "fragmentation of
ecological communities," pose any risk to the water quality of Schoolhouse Creek, or result in
the physical loss, degradation, or functional loss of any ecological components of the adjacent
tidal wetland ecosystem.
