Located: 360 Wiggins Lane, Greenport. SCTM# 1000-35-4-28.33 11 The Wetland Permit for a Ten Year Maintenance Permit to maintenance dredge an approximately 15'x115' area of owner's underwater land to a maximum depth of-5 MLW (with max. 1' overcut) and truck approximately 140 cubic yards of resultant spoil to an approved upland site construction of the bulkhead has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, the proposed action is recommended as CONSISTENT with the LWRP. The existing, as-built structures are recommended as INCONSISTENT with the below policy and LWRP. 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction. 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. A Wetland Permit was not located within Town records for the existing, as- built structures. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its si nificant beneficial and adverse effects upon the coastal area (which includes all of Southold Town If any question in Section C on this form is answered "yes" or "no", then the proposed action will affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. To limit the effects of ephemeral turbidity associated with the dredging,a silt curtain will be deployed around the proposed dredge site during the proposed dredge operations,and spoil will be trucked offsite to an approved upland source. Maintenance of the existing, unpermttted patio areas will have no effect on water quality. Attach additional sheets if necessary Policy 6. To limit the effects of ephemeral turbidity associated with the dredging,a silt curtain will be deployed around the proposed dredge site during the proposed dredge operations,and spoil will be trucked offsite to an approved upland source The application also seeks legalization of a small on-grade patio in an existing lawn area and the installation of a concrete paver pool patio,which was installed in place of a previously existing pool patio after Hurricane Sandy. The patio is larger than the one it replaced but remains situated within a previously existing lawn area,approximately 41 feet from the canal. Therefore,the proposed dredging and maintenance of the patio areas will not adversely impact the quality or function of the surrounding tidal wetland ecosystem.
