LATHAM & KURT F. FREUDENBERG IRREVOCABLE TRUSTS En-Consultants on behalf of THE JANET R. LATHAM & KURT F. FREUDENBERG IRREVOCABLE TRUSTS requests a Wetland Permit to construct approximately 66 linear feet of low-sill vinyl bulkhead and two (2) 12' angled low-sill bulkhead returns and backfill with approximately 100 cubic yards clean sandy fill to be trucked in from an approved upland source and planted with Spartina Alterniflora (12" o.c.) to restore approximately 1,200sq.ft. of vegetated intertidal marsh between bulkhead and MHW/toe of bank; and as bank stabilization, install approximately 82 linear feet of 1.5' to 2.5' diameter, 300-1,5001b. stone rip-rap (approximately 20 cubic yards) on filter cloth along toe of eroding embankment. Located: 165 Lester's Road, Mattituck. SCTM# 1000-114-7-2.1 The action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, the proposed action is recommended as CONSISTENT with the LWRP provided the following is addressed: 1. Verify the need for the installation of the low sill bulkhead seaward of the bottom of the bank creating a large need for fill. Why is the erosion control structure not being proposed at the bottom on the bank or aligned with existing bulkhead to the west? Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency, *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its si nifg scant beneficial and adverse effects upon the coastal area (which includes all of Southold Town). If any question in Section C on this form is answered "yes" or "no", then the proposed action will affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. FREUDENBERG IRREVOCABLE TRUSTS 165 LESTER'S ROAD MATTITUCK,NY SCTM#114-7-2.1 POLICIES 4, 5 & 6 The project's purpose is to prevent the further loss of the severely eroding upland embankment and restore the vegetated intertidal marsh, which less than 17 years ago (see attached photos) extended seaward from the embankment at least to the location of the proposed low-sill bulkhead in the westerly half of the property, where it has since been completely lost to erosion. To do so, the project proposes to employ a combined structural and non-structural/vegetative erosion control approach where a strictly non-structural approach is not viable due to the ongoing erosion and loss of wetlands and upland material. Specifically, to restore the vegetated intertidal marsh, a low-sill bulkhead would be installed approximately in line with the still existing intertidal marsh on the east side of the property, backfilled, and planted with Spartina alterniflora to create approximately 1,200 sf of vegetated intertidal marsh. And to stabilize the embankment, stone rip-rap would be installed along the seaward toe of the embankment, immediately landward of the proposed marsh. The proposed rip-rap has been designed to the minimum scale necessary, will terminate in the center of the subject property, and will have no adverse impact on the adjacent westerly property, which is hardened with a traditional bulkhead; and the proposed low- sill bulkhead will not adversely affect natural coastal processes, as it will be submerged at high tide. The low sill-bulkhead will beneficially impact natural resources because it will allow for the restoration of a substantial area of previously existing intertidal marsh and thus the associated functions and values Chapter 275 and the LWRP seek to protect and restore, including marine food production, habitat, erosion control, and the filtering and storage of potential excess nutrients running into the surface waters of Mattituck Creek. Therefore, the effects of the project will be 1) the stabilization of the embankment to protect the property from further flood and erosion damage; and 2) the restoration and protection of the quality and function of Town wetlands and water quality, consistent with the standards and goals of Chapter 275 and LWRP Policies 4, 5, and 6.
