The applicant has submitted a revised plan that further extends the dock structure seaward into public waters. The new design does not meet LWRP policies as stated in the previous review. In summary: 1. The very low water depths in the area are inadequate for the operation of a motorized vessel during periods of low water. 2. The dock will result in adverse, ecological impacts. Operation of motorized vessels in areas of with very low water depths can cause bottom scarring, turbidity and loss of benthic species. 3. The continued construction of dock structures within a Significant Fish and Wildlife I Area will affect the public use of the area and degrade the Habitat/Critical Environmenta A p g ecological quality of the area through introduction of contaminants, disruption of marine life habits etc. .... Correspondingly, physical and functional loss to wildlife has been found to occur through the loss and/or impairment of habitat, disruption of habits and migration patterns (structure and activity) and introduction of harmful contaminants. The most common contaminant associated with docks is wood preservatives impregnated into the wood used to prolong the life of a dock. Three trace metals; arsenic, chromium and copper are the most common. These three metals have the greatest potential to increase in estuarine environments from docks (Sanger and Holland 2002). 4. The dock does not comply with the existing "pier line". The extension beyond the existing "pier line" creates a navigational hazard for small watercraft. 5. Approval of the dock would establish the precedent of allowing longer docks in this sensitive waterbody. 6. The extension of dock structures into public waters hinders the public use of such waters where the dock is located. 7. The applicant presently enjoys access to the waterbody due to the waterfront location of the lot. Due to the shallow water depths and environmental sensitivity of this waterbody, the seasonal moorinq of vessels is more appropriate in this area. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. Located: 1295 Island View Lane, Greenport. SCTM# 1000-57-2-16 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is INCONSISTENT with the Policy Standards (Policy 6.3) and therefore is INCONSISTENT with LWRP. 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. The dock extends further seaward that the existing dock line. If approved, the configuration would set precedent for further encroachment into public waters for existing surrounding docks. The existing "pier line" is not shown on the submitted plans. L The applicant fails to prove that the action meets the following requirements § 275-11 Construction and operation standards C. 2 (d) of the Southold Town Code: (d) Review and approval of dock applications. Before issuing a permit for a dock structure, the Trustees shall consider whether the dock will have any of the following harmful effects: [2] Whether the dock will unduly interfere with the public use of waterways for swimming, boating, fishing, shellfishing, waterskiing and other water-dependant activities; The dock is expected to reduce public use in the area for water dependent activities. Chapter 275 requires that the determination of the length of the dock must include the dimensions of the vessel. The dimensions of a vessel are not specified. j61 Whether the dock will cause habitat fragmentation and loss of significant coastal fish and wildlife habitats; The dock structure is proposed in shallow water. The draft of a representative vessel has not been provided. Operation in areas of shallow water can cause turbidity, loss of submerged vegetation and damage to bottomlands. Furthermore the dock is proposed in the New York State Significant Coastal and Fish and Widlife Habitat Area/ NYSDEC Critical Environmental Area. At the discretion of the Board of Trustees, any operations proposed in critical environmental areas (§ 275-2) may be subject to more stringent requirements than detailed in this section. Such requirements may include, but are not limited to, denial of certain operations, shortening or reducing the size of structures, and increasing the width of non-disturbance buffers. [7] Whether the dock will result in the destruction of or prevent the growth of vegetated wetlands, seagrasses including ee/grass (Zostera marina) and widgeon•grass (Ruppia maritima) or shellfish; The dock will not impact emergent, wetland vegetation. The occurrence of seagrass is unknown but, not'expected. [10] Whether the dock will adversely affect views, viewsheds and vistas important to the community; The important view sheds and vistas to the community have not been identified or discussed. [11] Whether the cumulative impacts of a residential and commercial dock will change the waterway or the environment and whether alternate design, construction, and location of the dock will minimize cumulative impacts, and The continued construction of dock structures within a Significant Fish and Wildlife Habitat/Critical Environmental Area will affect the public use of the area and degrade the ecological quality of the area through introduction of contaminants, disruption of marine life habits etc. .... Limit grants, leases, easements, permits or lesser interest in lands underwater in accordance with an assessment of potential adverse impacts of the proposed use, structure, or facility on public interest in public lands under water. 3. Obstruction of navigable waters and underwater/ands is limited: b. to the minimum necessary for access to navigable waters. The minimum is determined by evaluating the following factors: (vi) whether or not alternative means to gain access are available. The applicant presently enjoys access to the waterbody due to proximity and via the opportunity for a mooring. Due to the shallow water depths and environmental sensitivity of the area, the seasonal moorinq of vessels are more appropriate,in this area. In the event the action is approved, it is recommended that: 1. That a vegetated buffer be established to mitigate the local impacts from the dock structure to public surface waters and bottomlands. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
