A Special Meeting of the SOUTHOLD TOWN ZONING BOARD OF APPEALS was held at the Southold Town Hall Annex, Second Floor Conference Room, 54375 Main Road at Youngs Avenue, Southold on Thursday, August 15, 2019 commencing at 5:00 P.M. Present were: Leslie Kanes Weisman, Chairperson Eric Dantes, Vice Chair Nick Planamento, Member Patricia Acampora, Member Robert Lehnert William Duffy, Town Attorney Kim E. Fuentes, Board Assistant Call to Order at 5:01 P.M. by Chairperson Weisman. WORK SESSION: a) Requests from Board Members for future agenda items. b) Proposed changes to Accessory Apartment Code. c) Requirements for Inspection and Certification by a Licensed Professional for Existing Residential Septic Systems. d) ZBA Training Conference scheduled for October 7, 2019. Resolution to be adopted by the Town Board for attendance by ZBA members in fulfillment of the 2020 training requirements. Page 2—Minutes Special Meeting held August 15,2019 Southold Town Zoning Board of Appeals e) SEQRA Budget from NP&V for Special Exception Application of JEMCAP Gas Station. To request submission of Environmental Review fees from the applicant. f) Second review by NP&V of The Enclaves Hotel and Restaurant Draft Environmental Impact Statement (DEIS) is forthcoming. POSSIBLE RESOLUTION TO CLOSE THE FOLLOWING HEARINGS: WILLIAM GORMAN #7303SE - (Adj. from August 1, 2019) Request for a Special Exception pursuant to Article III, Section 280-13B(1), the applicant is requesting to convert a single family dwelling to a two-family dwelling; located, at 45805 NYS Route 25, Southold, NY. SCTM No. 1000-75-2-14. BOARD RESOLUTION: A motion was offered by Chairperson Weisman, seconded by Member Acampora to Adjourn the hearing to October 10, 2019. Vote of the Board: Ayes: All. This Resolution was duly adopted (5-0). HALSEY A. STAPLES AND JANET E. STAPLES/RATS025 LLC #7299SE - (Adj. from August 1, 2019) Request for a Special Exception pursuant to Article III, Section 280-13B(1), the applicant is requesting to legalize a storage building altered to an "as-built" two-family dwelling; located, at 1100 Wilmarth Avenue, Greenport, NY. SCTM No. 1000-41-1-15. BOARD RESOLUTION: A motion was offered by Chairperson Weisman, seconded by Member Planamento to Close the hearing. Vote of the Board: Ayes: All. This Resolution was duly adopted (5-0). HALSEY A. STAPLES AND JANET E. STAPLES/RATS025 LLC 47213 — (Adj. from August 1, 2019) Request for Variances from Article XXIII, Section 280-124 and the Building Inspector's January 8, 2018, Amended June 19, 2018, Notice of Disapproval based on an application to legalize a pre-existing storage building that has been altered to an "as built" two-family dwelling; 1) located less than the code required minimum front yard setback of 35 feet; 2) located less than the code required minimum side yard setback of 10 feet; 3) located less than the code required combined side yard setback of 25 feet; located, at 1100 Wilmarth Avenue, Greenport, NY. SCTM No. 1000-41-1-15. BOARD RESOLUTION: A motion was offered by Chairperson Weisman, seconded by Member Lehnert to Close the hearing. Vote of the Board: Ayes: All. This Resolution was duly adopted (5-0). EXECUTIVE SESSION: 6:29 P.M. Motion was offered by Chairperson Weisman, seconded by Member Acampora to enter into Executive Session. This Resolution was duly adopted DELIBERATIONS/POSSIBLE DECISIONS/RESOLUTIONS: The Board continued with agenda items, and commenced deliberations on the following application. RESOLUTIONS: RESOLUTION ADOPTED: Motion was offered by Chairperson Weisman, seconded by Member Acampora to authorize advertising of hearings for Regular Meeting to be held on Page 4—Minutes Special Meeting held August 15,2019 Southold Town Zoning Board of Appeals September 12, 2019 which Regular Meeting will commence at 8:00 A.M., Town Meeting Hall, 53095 Main Road, Southold. Vote of the Board: Ayes: Members Weisman, Dantes, Planamento, Acampora and Lehnert. This Resolution was duly adopted (5-0). RESOLUTION ADOPTED: Motion was offered by Member Weisman, seconded by Member Acampora to approve minutes from August 1, 2019, Regular Meeting. Vote of the Board: Ayes: Members Weisman, Dantes, Planamento, Acampora and Lehnert. This Resolution was duly adopted (5-0). RESOLUTION ADOPTED: Motion was offered by Member Weisman, seconded by Member Lehnert to approve the Stipulation of Settlement between the Town of Southold Zoning Board of Appeals and Four Crows, Inc., d/b/a Croteaux Vineyards. Vote of the Board: Ayes: Members Dantes, Acampora and Lehnert. Nays: Member Weisman. This Resolution was duly adopted (3-1). (Member Planamento Recused) There being no other business properly coming before the Board at this time, Chairperson Weisman declared the meeting adjourned. The meeting was adjourned at 7:29 P.M.
