THIS INDENTURE, made the a day of .T(f Ly . 2019 between Peconic Land
VIII, LLC, P.O. Box 645, 538 Herricks Lane,Jamesport, New York 11947 herein referred to as
"Grantor", and Joseph P. Lebkuecher, III and Katherine Mary Lebkuecher, 1046 Marsl�ide Way,
Belville, NC 28451 (herein referred to as"Grantee"), s
WHEREAS,Grantor owns certain improved lands situate at 2295 Aldrich Lane, Laurel, New
York 11948, Suffolk County Tax Map No. 1000-125-2-1.14, more fully described on Schedule"A"
annexed hereto and made a part hereof("Grantor's Property");
WHEREAS, Grantee owns certain improved lands situate at 3475 Aldrich Lane, Laurel, New
York 11948, Suffolk County Tax Map No. 1000-125-2-2, more fully described on Schedule"A-1"
annexed hereto and made a part hereof;
WHEREAS, Grantor,for good and valuable consideration, has previously granted an easement
dated October 26"', 2017 recorded on December 4, 2017 at the Office of the Suffolk County Clerk at
Liber 00012940 and page 658,with certain terms and restrictions;
WHEREAS, Grantor,for good and valuable consideration, is desirous of amending the
easement and conveying additional rights and privileges to Grantees over a portion of Grantor's
Property so that Grantees can access Grantor's Property from Aldrich Lane, inclusive of all utilities;
WITNESSETH:
1. Grantor hereby ratifies and confirms the grant,transfer, bargain, sell and convey unto the
Grantee,the heirs or successors and assigns, in perpetuity, of an Easement in gross of the nature,
character, and to the extent herein set forth, over and upon all that certain parcel of land constituting
the southerly most 25 feet of the Grantor's Property described in Schedule"A"attached hereto. The
"Easement Area"is more fully described in Schedule"B"attached hereto and previously recorded at
Liber 00012940 page 658.
2. Grantor further grants to Grantee additional rights and privileges to those rights granted by
agreement dated October 26, 2017:
1. Any and all utilities, including but not limited to public water, cable, natural gas, electricity to the
Grantee's property, and any other property which is not or may be acquired by Grantee, his
heirs, successors or assigns, in perpetuity;
2. Authorize Grantee, his heirs, successors or assigns,to subdivide Grantee's property and use
said easement for both vehicle and pedestrian access and utilities, herein now granted or
previously granted in Liber 00012940 and page 658;
3. Grantor hereby grants a non-exclusive easement; Grantor reserves the right to use said
easement;
4. Grantee shall be responsible for snow removal, cost of maintenance and repair of the
easement;
5. Grantor will share in the cost of snow removal, cost of maintenance and repair of the easement
to the extent that grantor uses said easement and in proportionate share to the use of the
easement.
6. The location of the easement is visually depicted on the attached portion of the survey.
