Southwesterly corner of land of John H.Willis,and running along land conveyed or
to be conveyed by Theresa Bollhoefer to said John H.Willis, and along other land
of Theresa Bollhoefer, North 74 degrees 28' East 103.55 feet to an iron pipe and
land of Henry Wickham,said pipe being 125 feet southerly along the westerly line
of said land of Henry Wickham from East Road; thence along said land of Henry
Wickham, and passing through an iron pipe set near the top of the bank, South 13
degrees 29' 40"East 143 feet,more or less,to ordinary high water mark of Peconic
Bay;thence westerly along said high water mark of Peconic Bay, 110 feet,more or
less,to the easterly line of Fleets Neck Road at a point distant South 10 degrees 53'
East 144 feet, more or less,from the point of beginning;thence along said easterly
line of Fleets Neck Road,North 10 degrees 53' West 144 feet,more or less,to the
point of beginning.
Said premises known as 6225 Pequash Avenue,Cutchogue,New York 11935.
BEING AND INTENDED TO BE the same premises conveyed to the parties of
the first part by Deed dated January 4, 1978 and recorded in the Suffolk County
Clerk's Office on January 6, 1978 in Liber 8371 at Page 355.
Together with the appurtenances and all the estate and rights of the party of the first
part in and to said premises;
To have and to hold the premises herein granted unto the party of the second part,
the heirs or successors and assigns of the party of the second part forever.
And the party of the first part covenants that the party of the first part has not done
or suffered anything whereby the said premises have been encumbered in any way
whatever,except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law,
covenants that the party of the first part will receive the consideration for this
conveyance and will hold the right to receive such consideration as a trust fund to
be applied first for the purpose of paying the cost of the improvement and will
apply the same first to the payment of the cost of the improvement before using any
part of the total of the same for any other purpose.
