TO HAVE AND TO HOLD the premises herein granted unto the party of the second part,the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first part,covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever,except as aforesaid.
AND the party of the first part,in compliance with Section 13 of the Lien Law,covenants that the party
of the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will

thereon erected, situate, lying and being at Bay View, near Southold in the Town of
Southold, County of Suffolk, State of New York and being bounded and described as

BEGINNING at a concrete monument on the northerly side of a certain 20.00 feet right
of way known as Goose Creek Lane leading to North Bayview Road, said concrete
monument being 225.00 feet westerly along said right of way from a pipe set at the
southwesterly corner of land now or formerly of Charles McNeily. Said point of
beginning also being 545.00 feet westerly from the corner formed by the intersection of
the northerly side of said right of way with the westerly side of North Bayview Road as
measured along the northerly side of said right of way; RUNNING THENCE South 61
degrees 47 minutes 20 seconds West along said northerly side of right of way 75.00
feet to a concrete monument: RUNNING THENCE North 29 degrees 12 minutes 40
seconds West along land formerly H. Sayre and R.Young, now or formerly of Mildred
B. Cullen,Monte Warren and others 228.50 feet to the approximate high water mark of
Goose Creek; RUNNING THENCE North 49 degrees 15 minutes 36 seconds East as
