SUPERVISOR RUSSELL: Please rise and join in the Pledge. Thank you. Let me just say that
usually the policy of the Town Board is to run the agenda and when that's complete to have

people come up to the microphone and discuss any issue that they would like. One thing that we
do recognize is that many of you are here for that one goal tonight, which is to find a facility for
what you would like to do, so what we would like to do is we are going to set the agenda to the
side so we can start hearing commentary from anybody that would like to speak now so that we
don't have to have you sit through an hour of resolutions that (inaudible). What I would like to
do, and then when you are done speaking we are going to update you on what the town had
talked about and the solution that we think we found to resolve this issue and other issues that are
similar to it. But before I discuss what we were coming up with, I would like to hear from
anyone that would like to speak. Just step up to the microphone and like a usually meeting,
please state your name and your hamlet.
Antonio Piraino
ANTONIO PIRAINO: Antonio Piraino, I actually had a speech prepared but in lieu of recent
things that have happened I had to put that to the side because I believe this morning when I sat
here at the meeting it did sound to me that a resolution was resolved or at least can be put up to a
vote or whatever it may be but it's not for me to sit up here and tell you what the program is
about or how the children have thrived in the facility that they are in now but I would just like to
say a couple of things to the Town Board. I watched the program grow leaps and bounds over
the years, I've lost sleep, I've gotten up early. I have lived, slept and bled for North Fork Cheer,
my wife and her partner Lauren, you won't find two more dedicated people to the town and to
their craft. They don't do this for money, they don't do it for pride. They do it because they love
what they do and they love the children of the town. We are not outsiders, we love our town, we
represent our town. They go to three, four, five different venues, competitions, per year and they
represent Southold Town and when they stand up there on that mat, not only are the children
fearless but they represent us as a whole and what we stand for. We do a lot in this town to
preserve the lifestyle that Southold has thrived on for a hundred years and I would just like the
Board to realize that we are in a very, you know, risky, trying time right now with the age of
digital and computers and our children sit in front of the TV and the I pads and the I phones and
they don't exercise enough, they don't get out enough, they don't have the skills that you need to
survive in the world today and I do see a lot of those skills being passed on to these children in
the program. I run a business in Mattituck and recently I had a young child from Mattituck High
School come in and he didn't even look up when we had our interview but at one point he
stopped me and said, do I have to interact with people? I thought that was funny because I said,
yes, this is the service industry of course you have to interact with people. He said well, I am not
interested and he left the interview. I have seen bonds built with parents, I have seen bonds built
with children. I have seen our children pick up children who have been knocked down. There's
a positive aura that follows these kids wherever they go and the things that they have done in the
facility that they are in, I can't explain that to you. it's more than words, you have to see what
the children can do. You know, the (inaudible) that they get right now is from medals that these
children wear and they are not easy medals to obtain, these kids have been invited to states and
worlds and all sorts of different competitions. With the facility we have, you know, if we had
the proper facility, I think the problem we are running into now is the children we have that have
started at this height are now this height. So they have not only outgrown the facility, they have
thrived and moved forward at such a pace that they kind of outpace themselves. They are doing
things that they shouldn't be doing for another three or four years. I am not sure why, it's just
our children. Maybe it's the teachers, maybe it's the children, I don't know but the sky is the

limit for all these children. You know, cheerleading is now a sport, they can get grants, they can
get full rides to college scholarships, you know, they can do a lot of different things with the
sport and it can lead to different things, you know, gymnastics, and things like that so, I would
just ask the Board, I don't know how we got to this point now and I am glad we are going to be
able to address it but you know, we are not asking to move mountains or to change the code or to
change the law and we are not trying to sidestep the law but in my mind, I know interpretation
and opinion, I know everybody has their own interpretation and opinion, the way that the zoned
us, I believe that we have a valid argument that says we can be in light industrial right now. I
don't want to go down that road and argue with the Board or argue with legal counsel or hire
legal counsel. There is verbiage in there that does say almost similar to what they have zoned us,
actually says exactly what they have zoned us at but for some reason they are telling us that that
verbiage that's in there doesn't qualify us for usage even though that verbiage is the business
hamlet where they want us to go. So I won't get into that now because I don't believe it's
warranted at this point because I do believe that we found a resolution but you know, the whole
time from when we started this thing, all I asked was that for what I believe seems to be done
today was that we just took a simple amendment and put something in there that said you know,
in the, if there is something that would cause danger to, whatever it might be, the program due to
a height restriction or width restriction or something like that, that there could be a special
exception where the Board could vote and decide if these children could go to a different facility
and instead I just kept getting doors shut and doors shut and doors shut and three, four years later
I am standing in front of you here now so, I would tell you, if there's something we can do on
our side, we are more than willing, I will move mountains, I will dig roads. You tell me to do it,
I will do it. I am not the person that is going to say no, I am not a person to sit back, we will help
you as much as we can but we need direction. I don't know where else to go at this point but in
front of you. You know, we have a parent dinner a couple of days ago and I addressed the
parents for the first time because I tried to do this without involving the parents even though they
knew it was going on. We have signed petitions, we have sent letters all for nil, you know, it just
seems getting the door shut and we are at a point now, like I said, with the program, the children
have outgrown the facility so, I won't take anymore time of the Board. I appreciate you listening
to us and I think what happened this morning will resolve everything but I just wanted to tell you
that these kids deserve better. Not just for the sport they are in now but you know, my son is in
baseball, I have to bring him to different towns for baseball. You know, we need to let our
children thrive and grow and you know, move with the times. You know, it's a different time
out there, it's not like when I was younger, I had no choice. I had to be in boy scouts, I had to be
in baseball, I had to be in football, we had it after school, we had it during school, we had it in
the town. You know, I don't see that now, and we have a program like this that is trying to make
the children, and it's something the children love, I just don't understand how we got to this
point but I will let my wife and Lauren come up and tell you a little more about the children and
what they accomplished over the course of the last couple of years. Thank you again.
COUNCILMAN DINIZIO: Can I ask you a question?
MR. PIRAINO: Sure.
COUNCILMAN DINIZIO: You are in a place right now, right?

MR. PIRAINO: Yes.
COUNCILMAN DINIZIO: Why can't you stay in that place?
MR. PIRAINO: Size restrictions.
COUNCILMAN DINIZIO: Size....
MR. PIRAINO: Right now we have a ceiling height of, it's probably double what we need but
width and length is nowhere near what the regulation law basically now its....
COUNCILMAN DINIZIO: Well...
MR. PIRAINO: Where these kids are practicing in a facility that's 20 feet long, where they
should be practicing in a facility that's 60 feet long with 30 foot ceilings and they still go and
win every competition. So they do go out of the Southold town, they do go out probably once or
twice a month and they go to different facilities to try to run their routine but they basically tc the
routines the routines together, that's how good these kids are. They take a piece from here, a
piece from there, and they go up and compete and they win and they don't win by a tenth, these
kids win and they, you know, they walk on that mat, they you know, to quote the poetry, they
may be small but they be fierce, watch out. These kids, if you let them now, they'll try doing
things in here. They are good at what they do. The perfect their craft in a short, short period of
time. Again, I am not tooting the horn, I think the sky is the limit for a lot of these kids. I think
that they can take this to a whole different level at this point. So...
SUPERVISOR RUSSELL: I just wanted to, probably the irony of this right now, you have the
height but you don't have the building size so, if you go find a building that's big enough, you
don't have the height.
MR. PIRAINO: Yes, we have searched tirelessly, from, I mean, we have even tried to amend the
program and you know, we've gone down to where we've told kids, take your shoes off and see
if we can gain an inch or do this or do that, raise the ceiling tile, everything in our power that the
town has told us in the areas that we are allowed to be and unfortunately it just doesn't exist.
And I've had comments from people in town that told us go build a building, we don't have that
money. You know, we are just blue collar people that get up in the morning, put our kids on the
bus, we cherish our town, we love our town but you know, we are just trying to find a facility for
the children. That's all we are trying to do.
COUNCILMAN DINIZIO: So what's the easiest thing for you to do?
MR. PIRAINO: so the easiest thing for us to do, again, we have a lease, we need approvals to be
light industrial, LI. Again, the verbiage for LI does say professional business in it and we have
been classified as a professional business even though I don't know we are classified as a
professional business, in our classification it says professional business office and in LI

classification it says office/professional building and for some reason, this does not mean this
and this does not mean that. And I...
SUPERVISOR RUSSELL: Honestly, if that was the interpretation in the beginning, that
probably could have gone to the ZBA for clarification.
MR. PIRAINO: Again, I don't know(inaudible)....
SUPERVISOR RUSSELL: That's right, we'll move forward. I was just saying there is a
process for that, for better or for worse, there is a process for that.
MR. PIRAINO: Yes. Well, we do have a facility that a parent has stepped up got(inaudible)
SUPERVISOR RUSSELL: That's LI and it's got the height and got everything you need.
MR. PIRAINO: It's got the height, bathroom, water, heat.
COUNCILMAN DINIZIO: And so basically you just need a larger building and a larger
building isn't available for you in the zone that....
MR. PIRAINO: Correct. We don't do construction on any of the buildings, the only thing that
would be needed in the building (inaudible)...
COUNCILMAN DINIZIO: No, no, I mean, you are just there a few nights a week but it's not
like you are doing a business there, you just need a place that you can throw the girls up high
enough to practice.
MR. PIRAINO: Well, girls and boys. And also....
SUPERVISOR RUSSELL: They don't throw them up, the girls throw themselves up.
MR. PIRAINO: And the facility, the program is also a drop off, so we don't have you know,
100 cars in the parking lot at the same time, so one of the things that the Board would worry
about that I totally get is our program kind of caters around everything, you know, like I said, if
we are doing something or you if you need us to do something and you tell us, A it has to be this
way and B it has to be that way, it's done. You just tell us and we'll make it work.
COUNCILMAN DINIZIO: Well, how many hours do you intend to be open?
MR. PIRAINO: I would just leave that to the owners of the company. I will bow out now and
let them answer the questions.
COUNCILMAN DINIZIO: I am trying to establish a (inaudible) and I need some information
that I can read later on, so when we go and try to do the process, we have an idea of what you
need.

COUNCILMAN DINIZIO: That's why I am asking the questions.
MR. PIRAINO: Yes, unfortunately though, like I said...
COUNCILMAN DINIZIO: Inaudible.
MR. PIRAINO: They would know more than me. I will bow out now, thank you.
Stephanie Piraino & Lauren Berry Owners of NF Cheer
STEPHANIE PIRAINO: Hello, I am Stephanie Piraino and I am from Southold.
LAUREN BERRY: Lauren Berry.
M.S. PIRAINO: So Lauren and I are the owners of North Fork Cheer and this is going to be our
7th year with the program. Like Tony said, we are so blessed that we have the space that we can
work in right now. it is just getting harder and harder for us to be able to look at our parents and
athletes and when they say to us can we get a bigger space, it's getting harder for the kids to
tumble in here, they have to go to other gyms. We are paying other gyms to train our kids
because they can't tumble in here anymore. There's nothing else that we can say to them.
There's nothing else that we can legitimately say other than, we are sorry, we are doing the best
that we can. And we are doing the best that we can with the space that we have but this is the
first year now that we are at the point where we are going to start losing kids. Kids are going to,
kids are already starting to drive out of our town because, they want a bigger space where they
can train and it's so unfortunate,because the foundation of this entire program is the foundation
of family. It's the foundation of working hard, making a commitment, setting down roots,
sticking to those and then showing our kids that they can accomplish anything if they work hard.
You know, aside from the parents, when Lauren and I work with these kids every single day and
.what we tell them every day is it you want it, you can do it. Just keep working hard, you can
accomplish anything. It's hard to say that to them when maybe perhaps we are not putting our
best foot forward to do what they really need. Like I said, we are very blessed to have a space
with high ceilings right now but,Lauren and I cut our mats in half to be in the space that we are
in. This year alone, we had to rent space at a gym in Bohemia and our,entire program tracked
out there once or twice a month so that the kids had the ability to practice on full mats. Years
past, we were able to use the schools, Southold allowed us to use the space, riverhead, Mattituck
but at the end of the day, that still costs that Lauren.and I are paying because we are not charging
our families extra. We are not charging our families anything for that, it's coming out of
Lauren's and myself pockets. In addition to the rent for the space that we have, we are footing
the bill for an additional $500-$600 a month just to rent additional space so we can give kids the
opportunity to feel really good about themselves when they get out there on those mats. This
year alone, these kids right here were able to win 12 first place titles. They won three national
titles. They won two high point titles. They have competed from the top to bottom of the coast
and I mean, every child that sits here makes up your girl scouts, your baseball team, they are on
high honor roll. They are the first kids to volunteer when there's something going on in this

town. They are the first kids to say, hey look, we will do it. our program has been at every
single Relay for Life that this town has had, since we started seven years ago. Our town makes
sure that whenever there's a parade, whenever there's an event, whether they are a North Fork
cheer here or not, that they are there volunteering. And it's not just because they have to, it's
who they are. Cheerleading has evolved, Lauren and myself both cheered, I can't tell you how
many years now. I was a high school cheerleader, college cheerleader, I worked for a national
cheering company when I graduated college and cheerleading is a very interesting sport. If you
don't know what it's all about, it's really hard to pinpoint into a box. And I think that's what
happens a lot. And I think that, I would like to believe that a lot of the issues that we have is
because we are trying to fit cheerleading into a box which it isn't going to fit into. You know,
these kids do amazing things. We say they can throw each other up, they do. and they make
sure that when they throw each other up that they are safe and they catch each other. The make
sure that if someone is having a bad day at practice, they look that person right in the eye and
say, hey, you can do it. The minute that somebody in this program gets a new skill, I mean, if
you watch the video and see how genuinely excited they are for each other, it's such an amazing
thing. And that goes past the 9, 10, 11, 12, 13, 14, 15 years old. When they are grownups like
us, they might be sitting in your chairs. These are kids that have no problem standing up and
talking to people and verbalizing how they feel and how they can change the situation and how
they can be leaders. And at the same respect, they also know how to be teammates and they
know how to take a backseat so someone else can shine and that's something that is really hard
to find. Lauren and I are so proud of what we do, listen, we could do it outside on the front lawn
if that were the space but at the end of the day, all we are trying to accomplish and we thank you
for trying to help us find the solution, is to be able to give these kids a space that they can
continue to thrive in. And like I said, the biggest thing for us is it's getting really difficult for us
to be able to say to our parents that we are doing our best, because day after day they come to us
and say, can we try this or can we take the kids here, can we do this? We are running out of
excuses for them, so you know, we are thankful to be here, we are thankful that you are listening
and we hope that we can find a solution. Just to answer your question from before, what we
need is just a space like Tony said, high ceilings which we have but a standard competition mat
is 60 x 60, so for them to really be able to throw a tumbling pass would be an exceptional thing'.
not to say, okay, you are going to cut your pass here and then you start it again when you get to
the wall and then we will put it together on competition day. We have an athlete that went
through our program and coached for us and this year she was able to get a full scholarship to the
University of West Georgia. She can probably say she is a national champion, not just from
North Fork Cheer, not just from being in our program but she now is a national collegiate
champion. And she is coming back after her freshman year with no student loans because of a
cheerleading scholarship. Every athlete is not going to be a pro athlete and we tell them that all
the time, at the end of the day, it's just cheerleading. Cheerleading for them is their here and
now and that's what's teaching them to follow through. That's what's teaching them time
management, that's what's teaching them okay, this is important to me so I need to prioritize.
That's what's teaching them to be respectful, leaders and to sit here before you today and not
even talk. I mean, these kids range from 6 to 16 and they sit here intently and all they want to do
is the thing that they love. So if you have any questions for us, here we are.

MS. PIRAINO: In the program as a whole, we have 50 athletes. So not everyone is here today
but we have about 50. And they are pretty awesome.
SUPERVISOR RUSSELL: I just want to see if anyone else wants to comment. And I am going
to tell you, (inaudible), you have a very unique set of circumstances...
MS. PIRAINO: Right.
SUPERVISOR RUSSELL: But I will discuss that when, please.
Chatty Allen, Greenport
CHATTY ALLEN: Hi, my name is Chatty Allen and I am from Greenport. I have no children
involved with this and yet I have all my kids involved with this. I have been watching them
since most of them were 1St grade (inaudible) and they are in other events and you see in their
eyes, I remember one of the girls, 1St grade, learned how to do a cartwheel first time. now you
should see this child. She flies through the air, no hands. She is going backwards, these girls
have thrived. They are amazing to watch them. I wish I could afford to travel with them but
thanks to the parents, they put those'videos up. They just went to a competition and won 1St
place yet again, and to think that these kids are doing this in a facility that is basically nothing
compared to their competitors. This is our future. Too many things for our youth are
disappearing. We no longer,have Pee Wee football, our kids have to go to Riverhead. Our Little
League is dwindling to basically nothing. These girls are so dedicated, that in the summer time
when they are asked what do you want to do? Most kids would say sit in my room, go on my
computer, go to the beach, not these girls. They want to go to camp, they want to go to
gymnastic camp which helps them to further what they are doing because I am telling you, if you
have not seen any of these girls in action or these teams in action, look online and look at them.
It blows my mind what they are able to do without the proper matting, without the proper
spacing, it's phenomenal and I think we need to do everything that we can to.support our youth
to get them into a building, I mean, you change zoning and codes for things I won't go into, I am
also at the Village in Greenport, so I've been down this road at many Boards, I am here today
when I should be home resting from an injury over the weekend but to me, this was so important
to stand up and stand behind North Fork Cheer, the owners, the teachers, the students and their
parents because they deserve the best the Town of Southold can give them. And I am telling
you, you will be seeing a lot of these kids in the future. There are kids in here that took it upon
themselves outside of the cheer to raise money for different students who are having health
issues. No questions asked, they need to help someone like the coaches said, they are the first
ones to jump and help. And through North Fork Cheer I have gotten to know quite a few that are
on here, there are some that I know better, like I said I have been watching them. And I am only
.related to two of them and that's a couple of generations. So whatever the town can do to get
them into the proper facility because otherwise we are going to lose this, because if they have to
go further west, outside of Southold Town and I am talking maybe out of Riverhead, to get the
proper facility to use on a weekly basis, we are going to lose a lot of that and that is a loss for all
of our kids. And it's time, not just Southold Town and the Village of Greenport as well, all the
towns, we need to start stepping up, helping our kids and doing what's right for them. So
hopefully things are working out and they can do this because I want to keep watching these

girls, because I am telling you, go on line. If I get permission, I will put some on Let's Talk
Southold Town and you can see what these kids can do. Thank you.
Andrea Esposito. NOFO Wellness Center
ANDREA ESPOSITO: Hello everybody. I am Andrea Esposito and I own the facility that these
ladies are at. These girls are amazing. Unfortunately, I am at a standstill here but I am here to
support them because they are amazing and if I could knock down walls and make the racquet
ball courts what they need, I would do it but of course, that's not in my hands. I am just here to
support them and I want the best for them because they are being held back. I try to do the best I
could and I am here for them and unfortunately, I know that they are going to go somewhere else
and they have to. I am here for the sports facility issue. That's a whole other thing that I am
concerned about for my business that I have been taking care of for 17 years, out here on the
North Fork taking care of these people. These children were just another bunch of people that I
was helping get to the next level and that's what is going to happen, so just do what you can
guys, to get them what they need. Of course, (inaudible). And if I could, you know, we would
do the (inaudible), that building, it's a great building but I don't think we can knock down walls
there to make it what they need, so please do what you can to give them what they need. Thank
you.
SUPERVISOR RUSSELL: Let me just quickly, there had been some discussion for some time
regarding trying to find a home for these recreational type uses, this particular use presents
unique challenges because the building height. Now, I know the definition, if you call it a rec
facility it's allowed in certain sections of code but the building isn't there that you wanted. I
think the building department came up with a different interpretation as a professional office but
again, allow, professional office uses are allowed in many of the zones but again, it's the
building that you couldn't find. And I know we had talked several times because you found a
building and then you know, how do you take and change the code to apply for your specific
needs for a building. The recreational uses in the industrial zones we had talked about at length
and add to the code but it had always focused on the halo centers, which is you know, these are
family type uses and that's pretty much where you want to locate the family uses. The industrial
zones are largely you know, transfer stations, power plants, things like that and we didn't think
that was necessarily compatible, plus that's a lot of impacts that recreational uses create. So
what we did was we had drafted with our assistant director of Planning, it's going to be fairly
restrictive because we really don't want to open up all of the recreational uses under one roof,
it's, there's some areas it's just not going to be compatible. You can't have 200 cars with
families going in and out of the same road as garbage trucks, things like that. So what we are
going to do is add language to the code, it's going to be very narrowly defined. It's only going to
allow for one or two compatible uses and that way we limit the amount of impact in terms of
how many people are going to be at the facility at one time. it's going to bring some clarity
because I know that one of the biggest problems for the last years was the lack of clarity as to
what is this, is it recreational, is it professional. There's an instructional component, does that
change, what we did was we came up with a definition, I am going to read it real quick, and then
explain to you the next steps in the process but what we are trying to do is we are trying to add a
section of code and you have got to remember, we can't just say cheerleading facility and then
put it in a zone. You have to be broad enough to allow other people that are other types of uses

that you know, that want to pursue something but not necessarily cheering, so what we did is we
are going to add, the definition is what we are going to call recreational facility minor. The one
that we recently adopted was one that was called major recreational facility, it allowed a lot of
indoor and outdoor uses on one site. A minor recreational facility is going to be fully enclosed,
indoor rec facility, that's the only way we can make it compatible with (inaudible) nearby. It's
going to provide for soccer, baseball, basketball, tennis, cheerleading, swimming and other sport
activities, instruction or education to participants in multiple classes, sessions or events.
Facilities are open to members, participants and guests only. Again, it's difficult to just have a
public facility in these very tight industrial zones. A member, participant or guest charge may
be applied. Again, (inaudible) and your customers. Recreational uses shall not include gambling,
racing and amusement parks. We are going to add that definition to the code, we are going to
add it to the LI zone. LI zone which is the buildings that you thought were the most suitable.
We have some sort of internal challenges here that we have got to work out. I don't want to get
into here again, a very dry discussion on how bulk schedule requirements work, acreage
requirements but I can tell you we will be working on that over the next two weeks, so hopefully
we can have draft code come back in two weeks, then if the Board is all on board with that draft
code language, we notice for the public hearing. That will be in two weeks that night and then
we hold the public hearing 30 days after and the public hearing is where the public will come and
speak for or against the legislation and then if everybody is in support of it, we close the hearing
and then we can vote. And with that it becomes a new use added to that zone which is the zone
that you want. A few issues are, how are we going to do it? Do you have to go the ZBA for a
special exception, do you need site plan? Things like that. you know, those are the things we
need to work out internally here but I assure you our goal is to'streamline it as best we can but
still be consistent with the over-reaching goals of having zoning (inaudible) so we will be
working on that over the next two weeks. Hopefully we will have draft code language to notice
for a public hearing in two weeks as well. Okay?

touch base with you and let you guys know what we are doing, you know, and if we can get draft
code done before Tuesday, hopefully by Friday before the meeting I will certainly send it out to

as a gym myself, would I be able to move into something like that?
SUPERVISOR RUSSELL: Yes, it's a singular use as a gym.
MS. ESPOSITO: Okay.
SUPERVISOR RUSSELL: In other words, you wouldn't be able to build a gym or basketball
courts or tennis courts and all those different enumerated uses but a gym would be allowed.
MS. ESPOSITO: Alright. Now this new sports facility, is that going to encompass like what I
have? I am as close to YMCA as you can get to out here.
SUPERVISOR RUSSELL: Sure.
MS. ESPOSITO: So is it going to encompass activities like that?
SUPERVISOR RUSSELL: Are you talking about what we just discussed?
MS. ESPOSITO: Yes and no. I mean, there's nothing I can do about that, I mean, I would love
to, in my building be able to (inaudible)...
SUPERVISOR RUSSELL: You are talking about a major sports facility.
MS. ESPOSITO: A major sports facility. That is on the agenda?
SUPERVISOR RUSSELL: It was on today's agenda, there's no formal action tonight.
Basically I don't believe....
TOWN ATTORNEY DUFFY: Inaudible.
SUPERVISOR RUSSELL: Yes, we are going to issue an RFP, request for proposals.
MS. ESPOSITO: And I needed to know if that was, if you were defining what that was tonight,
right?
SUPERVISOR RUSSELL: That, I was, no, I was defining a new definition for groups like
them.
MS. ESPOSITO: Okay.
SUPERVISOR RUSSELL: Which is minor recreation facilities. The major recreational facility,
which is what the RFP is going to be...
MS. ESPOSITO: Okay.

SUPERVISOR RUSSELL: Is going to open up an opportunity for an applicant to submit to us
their concepts, their ideas for a major sports facility, a major rec facility. Sports East, that type of
facility.
MS. ESPOSITO: Okay. And then what would that do, I work for the town as well, teaching
classes there, would that facility encompass the town activities as well? I am kind of confused
about that. Like how do we, it's going to take away all of our businesses that we built up out
here. Because we know there's not that many people out here, we know that. so you know, if
one big facility opens up like that, it's not just me, all these other little boutique workout
facilities are going to be gravely affected. They are not going to make it, you know? That's
what I am concerned about.
SUPERVISOR RUSSELL: This is the thing, we have no proposals submitted yet because we
haven't issued the RFP but if there's concerns like that, any RFP that we get and we said we like
this idea and we are issuing the RFP for the 10 acres on Carroll Avenue, any RFP that comes
back, any proposal, it's going to require a change of zone, what we call an overlay zone. So if
those are the concerns that get raised at the public hearing, we can try to figure out what the, with
the applicant, how to mitigate those as best we can. But we have nothing in front of us right now
from any applicant that, to evaluate in terms of impacts on the surrounding businesses. But all
those things should be factored into....
MS. ESPOSITO: So I don't need to worry about that tonight?
SUPERVISOR RUSSELL: No. We'll send the RFP out and then when we get specific proposals
back, that's when we can have the discussions about impacts on surrounding businesses, things
like that.
MS. ESPOSITO: I was just worried with this RFP, if I had to make sure, that I had to make
anything to be added to that, so this way I know at my facility I could use it as well. I don't
know, I just thought that today was the time that you were going to finalize that RFP and
something needed to be in there (inaudible).
SUPERVISOR RUSSELL: The RFP is very broad, because again, we want people to come to us
with their ideas rather than us telling them specifically what we want. It doesn't work that way,
you know, these private businesses are going to have to build what they think is going to work
for them. I can make sure you get a copy of the RFP. We are still perfecting it. we are hoping
to issue it in the next few days. I can perfect it for you, when we perfect it, I can make sure you
get a copy but it will be very broad language.
MS. ESPOSITO: Okay.
SUPERVISOR RUSSELL: And like I said, it would require a change of zone sooner or later, so
there is going to be plenty of opportunity for public input and to have those concerns raised and
then the Town Board would figure out, you know, can we mitigate those concerns, can we

include them somehow, can we mitigate you know, impacts. All those things get factored into
any change of zone.
MS. ESPOSITO: I am just concerned for the future. Inaudible. I have been doing it for years...
COUNCILWOMAN DOHERTY: Andrea, I will tell you from our discussions on this, one thing
we all have the concerns with is whatever business model that is proposed to us, that it works for
the whole town, it doesn't just work for them.
MS. ESPOSITO: Okay. I mean, we are a community. I just know, I mean no one knows half
the stuff I do. You've been at my facility, you know where I have been and you know what I
accomplished. And I love the people here and I am here to help them.
TOWN ATTORNEY DUFFY: The request for proposals, it's not a definition, it's not a code
change, it's just asking for potential developers to give us ideas (inaudible) on this piece of
property. And as the Supervisor said, it's very broad, we are not getting into specifics. I will tell
you, (inaudible) is that the developer should focus on how they can complement existing
recreational and all the businesses in town, not be in competition with them, so that is something
that's going to be considered.
MS. ESPOSITO: Or have somebody like myself come in and bring my facility and be in that, I
have no problem with that...
SUPERVISOR RUSSELL: Well, it would require a change of zone, if you are already permitted
to do what you are doing, I don't think that you would need a change of zone. I don't know,
Joe's old building, I don't know where you are.
MS. ESPOSITO: I am in Joe's old building.
SUPERVISOR RUSSELL: I don't know what the CO, I don't know any of that but if those are
already permitted uses, you wouldn't need to come for a change of zone.
MS. ESPOSITO: Okay. If I was to move myself into that new facility, you know what I am
saying....
SUPERVISOR RUSSELL: Yeah, right.
MS. ESPOSITO: Like, combine, or however it would work.
SUPERVISOR RUSSELL: If an applicant wants to or a responder to an RFP wants to factor
that into the equation because they want to show that they are trying to mitigate impacts on area
businesses,then those are the types of things that we will evaluate.
MS. ESPOSITO: Okay, so I am, it's just wait and see then.

COUNCILMAN DINIZIO: Well, I would say not wait and see, I would say make sure you take
a look at that RFP when it comes in and keep your attention squarely on that.
MS. ESPOSITO: Well, that's why I am here, not just for the last situation because that's going
to affect me greatly but you know what, I have been in business 17 years, you know it was just
another....
COUNCILMAN DINIZIO: It could be to you advantage as a business person to somehow
associate yourself with the person that finally wins that award. It's that kind of...
MS. ESPOSITO: I wish I had the money, I would do it. I mean, I would love to be doing
something like that.
COUNCILMAN DINIZIO: But see, the RFP is going to, these people are going to tell us here's
what we can do, okay, and you know one of them is, if your facility, the facility that you do right
now is part of that, there's no reason why you know, somehow you can't work your way into that
you know, between you and whoever wins that. and you know, the time for you to do that is
well before the public hearing, so you understand what we received, what we are viewing and
when we hold the public hearing, you have got to come.
MS. ESPOSITO: Okay.
COUNCILMAN DINIZIO: And so (inaudible) they have got to come and express to us their
feelings, because we are changing a zone. We are changing a zone and that affects the whole
town.
MS. ESPOSITO: Understood.
COUNCILMAN DINIZIO: And we need to hear from you because honestly, we didn't think
about you when we were doing this, you know, I know you're in Joe Lizewski's place. I had no
idea that was still going on.
MS. ESPOSITO: I have been there almost 10 years.
COUNCILMAN DINIZIO: You have to let us know you exist.
MS. ESPOSITO: Yes. I am here and I am still here.
SUPERVISOR RUSSELL: So you understand, there's a real difference between what the
discussion was tonight and what we are doing here and then this. but this is pretty much a blank
canvas and then we want applicants, you know, respondents to show us what they are going to
do and we have every right to tell them, look these impacts or what you want to do are going to
negatively impact area businesses, so you need to show us how you can mitigate that somehow.

Whether it's working with them, whether it's removing that component, those are the types of
things. In other words, it's a blank canvas and the respondent and the town get to paint out the
picture before we go to public hearing or after the public hearing when we take comments.
MS. ESPOSITO: So you are here to support us as well, as the community.
SUPERVISOR RUSSELL: We are here to strike a balance with everyone.
MS. ESPOSITO: Okay.
SUPERVISOR RUSSELL: And the difficulty we had with the group that was in here tonight is
they were finding the buildings but the zoning didn't match. It's difficult to zone around a
specific location or building but again, we have a lot of concerns but we think we addressed them
in language today by being so narrow that it will allow not just them but other similar type of
uses in the LI zones without getting too far away from the intended uses of those zones.
MS. ESPOSITO: And how long does something like that take to approve?
SUPERVISOR RUSSELL: If we have it all done and have it in draft form for next Tuesday,
what we will do is we put public hearing, you have to notice a public hearing. We are only
required to notice 10 days prior to the hearing but as a policy the board takes 30 days, so if we
noticed it in two weeks, it will be four weeks after that. We have the public hearing and then we
close the public hearing that night, we can either vote that night or if we get a lot of input that
night we can usually table and discuss the input for two weeks.
MS. ESPOSITO: So like two months?
SUPERVISOR RUSSELL: Yes, six to eight weeks.
MS. ESPOSITO: Yes, so that's what I am thinking. September 1, that's what the....

COUNCILWOMAN DOHERTY: And then it gets filed with the state and that takes a few
weeks.
MS. ESPOSITO: Sounds like they have done all their homework already and they probably
have done....
COUNCILMAN GHOSIO: We have to do it.
MS. ESPOSITO: You have to do it. Okay.
SUPERVISOR RUSSELL: I've been working with them for some time but again, the challenge
was where do you want family type facilities. Do you really want them next to, I mean, their
original building was located on Commerce Drive, so they had a building that was right next to a
transfer station, privately owned, a potential power, storage facility, for public utility. So then

you say do you really want those types of family uses but again, what we dis is we crafted is so
narrowly that it will only be one or two uses and that way you won't have 150 cars with families
parked all around it....
MS. ESPOSITO: Even with my, I have a great parking lot but it's tough with my people coming
in and out, so...
SUPERVISOR RUSSELL: And that's mostly residential traffic, if you put it where they wanted
to put it you know....
MS. ESPOSITO: It's dangerous.
SUPERVISOR RUSSELL: Traffic trailers and stuff. That's what we have to mitigate as best
we could. It wasn't as easy as it seemed. But we came to a solution I think.
MS. ESPOSITO: Okay. Alright. Well,that's what my concern was, a sports facility.
SUPERVISOR RUSSELL: I will get you the RFP as soon as it's done. Drop it off to you. but
again, it's a very broad document, the more specific component that you want to be aware of is
when the proposals come in.
MS. ESPOSITO: Okay. And from that point, I read it and then I can ask you guys any questions
at any time or do I have to wait for the Board?
SUPERVISOR RUSSELL: You can always ask us questions. But again, when we get the
applications in or responses, doesn't mean we are going to go with any of them or if we find one
we might like that the most but it might need to be amended. You know, before we are ready to
move forward on the change of zone.
MS. ESPOSITO: Why can't the town just, is it not in the budget? Why can't you just open up
and make something like Southampton?
SUPERVISOR RUSSELL: Southampton wasn't done by the town. The town simply offered
the site. It was done by a public/private partnership. The town offered the site and a lot of very,
very deep pocket donors put it together. Also, I don't think they have the pool there. Do they
have a pool there? I don't think so.
COUNCILMAN GHOSIO: They have an indoor track.
SUPERVISOR RUSSELL: They have an indoor track, my son used to play basketball there.
They have quite a bit but again, you can go inside there, there's the wall there with donors.
There's some pretty big names. We just don't have that pot here in Southold.
MS. ESPOSITO: Okay. I was just curious. Because we all join together, as different
businesses.

SUPERVISOR RUSSELL: When I met with a bunch of parents a few years ago who wanted an
indoor pool, so I gave them two concepts. One that would be more of a lap pool and one would
be more of an Olympic size pool and an estimated cost of$4.5 to 5.5 million, well, I told them I
would put it out to referendum and let the public vote, saying do you want the town to spend this
money. The problem is, towns aren't good at managing pools. Municipalities, have a terrible
track record and frankly, we don't have the knowledge or the experience, so I said what we need
to do is if we built it, we need to find somebody that's going to be a managing partner who's
going to run it for us. so I asked them, research that, see if that's something you can form on a
community basis so we have someone to have a contract with. and then ultimately they passed
on the proposal. So we never put it up.
MS. ESPOSITO: Well, I wish I was around at that time to,because I would have....
SUPERVISOR RUSSELL: It's very, very hard from a municipal perspective, municipal pools,
they are very, very hard to run. And they are so regulated, most towns invariably privatize. In
one case, one actually sold it...
MS. ESPOSITO: Okay. Well, thank you for listening and I will be in touch.

Coastal Erosion Appeal of LCMG FINY, LLC
RESOLVED the Town Board of the Town of Southold hereby sets Tuesday, July 16, 2019 at
9:00 AM. at the Southold Town Meeting Hall, 53095 Main Road, Southold,New York as
the time and place for a public hearing upon the Coastal Erosion Hazard Board of Review
Appeal of LCMG FINY, LLC, c/o Leslie Goss which seeks relief from Section 111-6 and 111-
11 C of the Town Code to retain and reconstruct+-151 linear feet of existing 8' wide fixed
wood pier with handrails on each side, of which+-120 linear feet is seaward of the AHWL;
replace handrails on each side of pier and install new decking; all of the cribs will be removed,
including timbers and half of the stone from site with removed stone to be disposed of offsite;
the remaining stable stone at each crib location will be left in a stable mound to preserve habitat
with new 12 inch Class B piles to be utilized for support of the pier for its full length; install
Thru-Flow decking for the full level length of the structure over the water; construct a
transitional slope section of the pier from the mainland bluff to meet standard 1:10 maximum
gradient in order to provide 5 feet of clearance for pedestrian access along beach; install ladders
at strategic locations along the length of the pier, and bumpers/fenders at the end of the pier; and
to replace three (3) tie-off piles and install one (1) new tie-off pile; and as depicted on the site
plan prepared by Docko, Inc., received on May 3, 2019 within a near shore area in a Coastal
Erosion Hazard Area located on property on parcel SCTM# 1000-2-1-14.1 at 3773 Clay Point
Road, Fishers Island New York., and directs the Town Clerk to publish notice of such appeal in
the Suffolk Times newspaper not less than ten (10) days nor more than thirty (3 0) days prior to
such hearing and to notify the applicant by first class mail.

Enact Local Law- Chapter 189 Parking-Lighthouse Road
WHEREAS,there has been presented to the Town Board of the Town of Southold, Suffolk
County,New York, on the 21St day of May, 2019, a Local Law entitled "A Local Law in
relation to an Amendment to Chanter 189, Parking, in connection with Parkin$t on
Lighthouse Road in the hamlet of Southold" and
WHEREAS the Town Board of the Town of Southold held a public hearing on the aforesaid
Local Law at which time all interested persons were given an opportunity to be heard, now
therefor be it
RESOLVED that the Town Board of the Town of Southold hereby ENACTS the proposed Local
Law entitled, "A Local Law in relation to an Amendment to Chapter 189, Parking, in
connection with Parking on Lighthouse Road in the hamlet of Southold" which reads as
follows:
LOCAL LAW NO. 2019
A Local Law entitled, "A Local Law in relation to an Amendment to Chapter 189,Parking,
in connection with Parking on Lighthouse Road in the hamlet of Southold"
BE IT ENACTED by the Town Board of the Town of Southold as follows:
I. Purpose
The Purpose of the amendment is to improve safety for emergency vehicles,pedestrian and
passenger vehicles, as well as dealing with impacts to the public's health, safety and welfare
resulting from vehicles parking and standing on a portion of Lighthouse Road in the hamlet of
Southold.
U. Amendment.
The Southold Town Code is hereby amended by removing the struck through words and adding
the underlined words as follows:
§189-2 Designation of areas requiring parking permits.
B. The following road end areas are hereby designated as Town of Southold "Parking by
Southold Town Permit Only" area:

(19) Lighthouse Road, Long Island Sound, Southold, on both sides from the terminus south
dist nee of 650 fee to the intersection with Soundview Avenue.
III. SEVERABILITY
If any clause, sentence,paragraph, section, or part of this Local Law shall be adjudged by any
court of competent jurisdiction to be invalid,the judgment shall not affect the validity of this law
as a whole or any part thereof other than the part so decided to be unconstitutional or invalid.
IV. EFFECTIVE DATE
This Local Law shall take effect immediately upon filing with the Secretary of State as provided
by law.

I have here a copy, a notarized copy that this has been noticed by the Town Clerk's office on the
town website and bulletin board. I do have the same for, that this has been noticed in the Suffolk
Times and I have a letter here from the Kenney's McCabes Beach Civic Association. `Dear
Supervisor Russell, Members of the Town Board, I am sorry that I was unable to attend the

above subject public hearing, hence my letter. Request for the subject change, adding
approximately 250 feet to the no parking without permit area on Lighthouse Road was submitted
by us to the Transportation Commission on March 11 and supported by Chief Flatley and
unanimously approved by the Transportation Commission. While the change might seem like
it's 'insignificant, the result will be significant in assisting traffic control and police officers in
monitoring and ticketing this abused area. This area is prone to garbage and dumping and it has
been explained that violations cannot be given unless dumping is seen happening.. The no
parking without permit change provides the ability to ticket violators. Thank you for your
support and approval.' And they did send up some pictures of dumping that has happened there.
And that's all I have.
