Russell SUPERVISOR RUSSELL: Please rise and join in the Pledge to the Flag. Thank you. I am going to ask anyone that would like to comment on any of the agenda items to please feel free? Bob Hanlon, Orient BOB HANLON: Good evening, Bob Hanlon from Orient. On the agenda tonight, item 2019- 606, is a contract change order to the Southold Comprehensive Plan and authorizing money to be used for printing copies of that plan which was discussed this morning at the work session. SUPERVISOR RUSSELL: Right. MR. HANLON: Work on the Comprehensive Plan started over 10 years ago. It was originally scheduled in 18 months and the plan looking ahead to 2020 was even called Southold 2020. We are at the edge of 2020 and the plan is just now about to arrive. Much has changed in this town since 2009, we have (inaudible)to manage those changes. In the past 10 years, we have not been basing our legislation for rentals, wineries, farm issues, traffic, water pollution on well thought out policies developed (inaudible) of our communities. Rather, our town government has waited for each crisis to arise and then rushed in with a quick fix that often proved unworkable, failed to address legitimate needs of some affected groups or had unintended consequences. Now the plan is about to be issued. In the final draft form, it still requires community review and passage by the Town Board. The Supervisor and the Town Board made it clear to those working on it that it must be done and passed by early this fall. At today's work session, the Town Board authorized the printing of 35 copies to Town Board members and for distribution to libraries. This is so all 15,000 plus voters can review the draft before the Planning Board's hearing scheduled for July 291h. Unfortunately, not everyone can or wants to read a document online and wait for the few library copies that might be available. The Town then plans to schedule several community meetings before the final adoption of the Town Board in September or October, although civic associations had been involved earlier, in this round the town declined to involve Southold Town Board Regular Meeting July 2, 2019 page 4 these groups as one channel for scheduling or hosting the next meetings. The rationale was that not everyone belongs to a civic association, however, all civic association meetings are open to the public and civic association meetings regularly draw crowds of over 100 while attendees at town sponsored meetings typically number in the dozens. Finally, these town sponsored meetings can be held at height of the summer season when our schedules are most busy with family and recreational activities. We need a comprehensive plan, we have needed it for the past 10 years and we need adequate community input. These delays should not be laid at the feet of the planning staff who have not been given adequate resources, in fact, their resources were cut shortly after this project was started. The plan was simply not a town priority until now. it seems hardly a coincidence that this sudden rush for adoption is slated to be completed just weeks before election day. Thank you. SUPERVISOR RUSSELL: Thanks, Bob. Let me just say, first of all, I didn't know we were going to have a debate on the comp plan, I thought we were going to address the specific agenda items but let me point out a few things. The comp plan is a working, living, breathing document. It has been amended, it included, it has unprecedented public support and participation over the years. Chapters have been revised, revisited because of the changing nature of things like the agricultural chapter. All of those things are already part of the public decision, government decision making process. And also, the comp plan is a reciprocal document. It just doesn't guide our future decision making and our firture needs but current needs and current decision making influence that. Also, the notion that we are not including civic associations is specious. We do. we make sure everybody knows, we have plenty of public input meetings, we make sure everybody knows but there are so many groups out there, to suggest that we need to go to this civic group, this chamber, this civic group, this chamber, it's cumbersome and it is a community wide document that belongs to the entire community, not just civic associations, not just chambers, not just anybody but everybody and also, the idea that we have been scheduling it in the summer at the height of the season, that's a no win for us because if we schedule it when it wasn't during the summer, then people would say, well, you scheduled it when we weren't here and we didn't even know about it. Sure, we could have scheduled it off season, so we couldn't attend. Don't forget this town has a huge summer population, they are every bit as important a part of this town as you or I are. And they need to be, they need to know what the plan is going to say, they need to have their voices heard. The summertime is the optimum time to have meetings like this. MR. The proposed Local Law entitled, "A Local Law in relation to an Amendment to Chapter 280, Zoning, in connection with Administration and Enforcement in the Town of Southold" which reads as follows: LOCAL LAW NO. 2019 A Local Law entitled, "A Local Law in relation to an Amendment to Chapter 280, Zoning, in connection with Administration and Enforcement in the Town of Southold" BE IT ENACTED by the Town Board of the Town of Southold as follows: I. Purpose The Purpose of the amendment is to clarify the Town's intention to supersede Section 268 of the Town Law of the State of New York. 11. Amendment. The Southold Town Code is hereby amended by removing the struck through words and adding Southold Town Board Regular Meeting July 2, 2019 page 11 the underlined words as follows: §280-155. Penalties for offenses A. The Town Board of the Southold has determined in order to obtain satisfactory enforcement and compliance with the law, it is necessary to increase the fines for zoning violations in excess of the maximums authorized by §268(1) of the Town Law of the State of New York. It is the intent of the Town Board pursuant to the Municipal Home Rule Law of the State of New York to supersede the portion of§2680 of the Town Law of the State of New York as enacted by Chqpter 598 of the Laws of 1985, insofar as to authorize the Town Board to establish maximum fines for violations of the Building Zone Ordinance set forth in the said §268 of the Town Law. A.B. For each offense against any of the provisions of this chapter or any regulations made pursuant thereto or for failure to comply with a written notice or order of any Building Inspector within the time fixed for compliance therewith, the owner, occupant, builder, architect, contractor, or their agents, or any other person who commits, or takes part or assists in the commission of any such offense or any person, including an owner, contractor, agent or other person who fails to comply with a written order or notice of any Building Inspector or Zoning Inspector shall, upon a first conviction thereof, be guilty of a violation,punishable by a fine not exceeding $5,000 or by imprisonment for a period not to exceed 15 days, or both. Each day on which such violation shall occur shall constitute a separate, additional offense. For a second and subsequent conviction within 18 months thereafter, such person shall be guilty of a violation punishable by a fine not exceeding $10,000 or by imprisonment for a period not to exceed 15 days, or by both such fine and imprisonment, B.C. Notwithstanding the foregoing, any violations of§280-13A(6), 280-13B(13), 280-13D, and 280-111J are hereby declared to be offenses punishable by a fine not less than $1,500 nor more than $8,000 or imprisonment for a period not to exceed six months, or both, for a conviction of a first offense; for convictions of a second or subsequent offense within 18 months, a fine not less than $3,000 nor more than $15,000 or imprisonment not to exceed a period of six months, or both. However, for the purpose of conferring jurisdiction upon courts and judicial officers in general, violations of this chapter shall be deemed misdemeanors, and, for such purpose only, all provisions of law relating to misdemeanors shall apply. Each day's continued violation shall constitute a separate additional violation. Additionally, in lieu of imposing the fine authorized in this section, in accordance with Penal Law §80.05(5), the court may sentence the defendant(s) to pay an amount, fixed by the court, not exceeding double the amount of the rent collected over the term of occupancy. III. SEVERABILITY If any clause, sentence,paragraph, section, or part of this Local Law shall be adjudged by any court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law Southold Town Board Regular Meeting July 2, 2019 page 12 as a whole or any part thereof other than the part so decided to be unconstitutional or invalid. IV. II. AMENDMENT. Chapter 280 of the Code of the Town of Southold is hereby amended adding the underlined portion to read as follows: § 280-4 Definitions. B. Definitions and usages. Unless otherwise expressly stated, the following terms shall, for the purpose of this chapter, have the meanings as herein defined. Any word or term not noted below shall be used with a meaning as defined in Webster's Third New International Dictionary of the English Language, unabridged (or latest edition). RECREATION FACILITY, MINOR- Fully enclosed indoor recreation facility that provides soccer, baseball, basketball, tennis, cheerleading, swimming and other sport activities instruction or education to participants in multiple classes, sessions or events. Facilities are open to members, participants and guests only. A member, participant or guest charge may be applied. Recreational uses shall not include gambling, racing and amusement parks. § 280-58 Use regulations. In the LIO District, no building or premises shall be used and no building or part of a building shall be erected or altered which is arranged, intended or designed to be used, in whole or in part, for any purpose except the following: A. Permitted uses. The following uses are permitted uses and, except for those uses permitted under Subsection A(1) hereof, are subject to site plan approval by the Planning Board: (1) The agricultural operations and accessory uses, including irrigation, the raising of field and garden crops, vineyard and orchard farming, the maintenance of nurseries and the seasonal sale of products grown on the premises, the keeping, breeding, raising and training of horses, domestic animals and fowl, barns, storage buildings, greenhouses and other related structures to the same extent and subject to the same conditions allowed in the AC Zone. ' (2) Buildings, structures and uses owned or operated by the Town of Southold, school districts, park districts and fire districts. (3) Wholesale businesses,private warehousing and public warehousing, and building material storage and sale, but excluding storage of coal, coke, fuel oil or junk. (4) Building, electrical and plumbing contractors' businesses or yards. (5) Cold storage plants, baking and other food processing and packaging plants that Southold Town Board Regular Meeting July 2, 2019 page 36 are not offensive, obnoxious or detrimental to neighboring uses by reason of dust, smoke, vibration,noise, odor or effluent. (6) Office buildings for businesses, governmental and professional uses, including administrative training, data processing, publication, financial and sales offices. (7) Telephone exchanges. (8) Wineries as regulated by § 280-48A(11). (9) Tourist camp. (10) Recreational facilities which meet the following conditions: (a) Minimum parcel size shall be three acres. ,(b) There shall be three acres for each use. (11) Standard regulation golf course. (12) Food catering facility. (13) Machine and equipment workshop. (14) Boat building, boat servicing and boat storage facilities, excluding retail sales of boats and accessories. (15) Light industrial uses, subject to the following conditions: (a) No such process or operation shall involve the handling, storage or discharge of explosives or permit upon the premises any virus or other type of infectious organisms identified with diseases of animals or humans. (b) No offensive noises, gases, fumes, smoke, odors, dust, effluent or vibrations shall emanate from such use and no waste products shall be discharged therefrom of a character to create a nuisance or to be injurious to health or to negatively impact groundwater. (c) Such processes shall involve the use of only oil, gas or electricity for fuel. (16) Printing and publishing plants. (17) Land-based aquaculture operations, including research and development, which meet the following standards: (a) Any land-based aquaculture operation shall take place in a fully enclosed structure. (b) Any land-based aquaculture operation shall be entitled to a retail area not more than 10%'of the gross floor area of the structure in which the land-based aquaculture takes place for the direct marketing of its products. (18) Recreational Facility, Minor § 280-62 Use regulations. In the LI District, no building or premises shall be used and no building or part of a building shall be erected or altered which is arranged, intended or designed to be used, in whole or in part, for any purpose except the following: A. Permitted uses. (3) Wholesale businesses, private warehousing and public warehousing, and building material storage and sale, but excluding storage of coal, coke, fuel oil or junk. (4) Contractors' businesses or yards, including but not limited to building, electrical, plumbing, and landscapers' yards. (5) Cold storage plants, baking and other food processing and packaging plants that are not offensive, obnoxious or detrimental to neighboring uses by reason of dust, smoke, vibration, noise, odor or effluent. (6) Office buildings for businesses, governmental and professional uses, including administrative training, data processing,publication, financial and sales offices. (7) Telephone exchanges. (8) Wineries as regulated by § 280-48A(11). (9) Auto repair shop. (10) Repair shop (not including auto and marine). (11) Custom workshop. (12) Machine and equipment workshop. (13) Light industrial uses. (14) Publishing and printing plants. (15) Boat building, servicing and storage, excluding wholesale and retail sales of boats and accessories. (16) Land-based aquaculture operations, including research and development, which meet the following standards: (a) Any land-based aquaculture operation shall take place in a fully enclosed structure. (b) Any land-based aquaculture operation shall be entitled to a retail area not more than 10% of the gross floor area of the structure in which the land-based aquaculture takes place for the direct marketing of its products. (17) Recreational Facility, Minor II. SEVERABILITY If any clause, sentence,paragraph, section, or part of this Local Law shall be adjudged by any court of competent jurisdiction to be invalid,the judgment shall not affect the validity of this law as a whole or any part thereof other than the part so decided to be unconstitutional or invalid. IV. Fair point, people do raise that all the time. The applicant does have a substantial amount of parking on site, also if we are serious about creating robust downtowns, some of the onus on parking needs to fall on towns and municipalities. one thing I did want to make clear to the public is that the parking lot is under restoration and redesign,that has a little over 50 spaces; right now,that will go to over 80 parking spaces once that is done in September. The question is the necessity of this? COUNCILWOMAN DOHERTY: I feel that we discussed that because we did go back and forth on this, and in order for that committee to get anything accomplished,they need a quorum and Jim has been the liaison, he's come back many times saying they didn't have a quorum and they had to put things off. So... SUPERVISOR RUSSELL: So now we should move forward. COUNCILWOMAN DOHERTY: That's how I feel. COUNCILMAN RULAND: I agree. COUNCILMAN DINIZIO: I just want to comment that I agree with what was just said, that I have been the liaison for that committee since I have been on the Board and I watched that committee bang their heads against the wall for that many years, trying to get some results and it used to be pretty diverse, it used to be east and west, you know, there used to be some people in Mattituck, people from the east end but now it's not, one committee person doesn't even live in the town, one person on there. They are all very dedicated to housing in Southold Town but like I said, they were banging their heads against a wall. You are exactly right, we are going to be coming in to some money here soon and quite honestly, the more concentrated that committee can be, I believe the more productive they will be. Ten people is unwieldy no matter how you look at it, seven to my mind is still too many, I would have gone with five but in the interest of compromise, I will settle for seven. So I vote yes. COUNCILMAN GHOSIO: I agree with Jim, I think seven is too many, I think that five would be a better number but again, in the interest of compromise, I vote yes. Southold Town Board Regular Meeting July 2, 2019 page 44 SUPERVISOR RUSSELL: I just want to put Jim's comments into context with regard to banging their head against the wall, I do want to point out that one of the challenges has is it does not have the infrastructure in many instances to support higher density apartments which the town decided was the goal to go in, the bigger bang for the buck, that's where the need is. The problem is that we have a lot of developers that walk in, they propose ideas, they do the math, they walk out and never hear from them again. In the near future, we will (inaudible) changes and I will concede to Bob Hanlon's point that we do have, first we have (inaudible) zoning now which means that if you build a subdivision you either need to commit some of the units for affordable housing or you can pay into the housing fund. So money is being generated there now particularly with the construction of the condominium project in Cutchogue, we also have the possibility of the 2 %transfer tax that will produce income that will allow a committee, a housing committee, to offset some of those infrastructure costs down the road so I do think although it might have been frustrating in the past for all sorts of reasons, (inaudible) infrastructure, I hope (inaudible) in the near future that should change, now that we are going to anticipate new opportunities. The following additional matters are hereby determined and stated: (a) The period of probable usefulness of the object or purpose for which said bonds are authorized to be issued, within the limitations of Section 11.00 a. 28 of the Law, is fifteen (15) years. (b) The proceeds of the bonds herein authorized and any bond anticipation notes issued in anticipation of said bonds may be applied to reimburse the Town for expenditures made after the effective date of this resolution. And that is it. Supervisor Russell SUPERVISOR RUSSELL: Who would like to address the Town Board on this particular local law? Gail Wickham. Esq. ABIGAIL WICKHAM: My name is Abigail Wickham, of Wickham, Bressler and Geasa in Mattituck. I represent the owner/applicant tonight, I also have with me in case there are questions from the Board Chris Weiss, who is with H2M, our engineering consultant. Clay Coffey, our architect and Gary Salice on behalf of the owner. I want to go briefly through this as an application which we are making to address what we hope is going to be a realistic and Southold Town Board Regular Meeting July 2, 2019 page 50 effective redevelopment of the very large, very old building which is located in the center of the business district of Love Lane. The redevelopment of this property provides a number of special challenges because it is an assemblage of many buildings that were built over quite a few decades, going back many, many years. It's old construction, it's pieced together, it's chopped up, it's on different levels and it requires considerable amount of upgrading and work in order to make it work, unlike a new construction project. It is in the focal point of the hamlet business district and halo center of Mattituck Love Lane district. The plan is to use it for a mixed use, mixed uses to accommodate what has been quite a significant Love Lane revival as a dynamic commercial destination in the heart of Mattituck. The owner is going to include an affordable apartment in the project which although that would limit his return also does provide much needed community benefit. Another benefit would be to update the building and the sanitary system. All of this will be at tremendous expense and would require multiple layers of approval. This is the first of many, we hope and I just want to mention that while the approvals evolve and are (inaudible), we have to start with the health department and that's where we get to the sanitary credit transfer. We went through an extensive review with the engineers of 1-12M and our architect which revealed that in order to include the affordable apartment and other mixed uses which lend themselves to the downtown atmosphere, specifically a small restaurant, retail and the apartment, an additional 1.6 sanitary credits would be required to obtain a double density and use the facility in what we think is a very beneficial manner. This is the minimum necessary to effect a viable economic project and I think that's reflected by the fact of the number of municipal letters of support which Mr. Ghosio referred to, the certification of use from the building inspector, we have memorandums in support from the Planning Board, both in terms of SEQRA and the LWRP and an extensive memorandum from the Planning Board addressing the aspects of the project on a preliminary basis and indicating that the unit is compatible with the hamlet density sites, stakeholder recommendations, LWRP and draft comprehensive plan town chapter goals and objectives. We also have, I understand in the record, a letter of support from the Mattituck Community Civic Association which the owner has met with several times to discuss before we even got started. in fact, there were a couple, they actually polled the membership and thanked them for their interest and their feedback, the only concerns from them, a minority, where regarding parking and traffic and I think while that's not the subject of this hearing I just want to address it briefly because there are two points that people, you are aware of but they may not be. Historically this was a bank building for many, many years (inaudible). It housed over 40 employees, it was the corporate headquarters for North Fork Bank for many, many years and during that time the people that they employed had one car, per day, each all day long other than maybe Debbie Orlowski who walked to work but there was a lot of people that came into that building and they left their cars there all day long while they were working. They had the branch office there, they had the executive offices, the trust department, the audit department, the retail banking, mortgages, commercial loans, filming, microfilming, security and board meetings. So contrast the mixed use that we are proposing which has a lot of in and out trips that aren't going to be there for the duration, there will be much more circulation in the availability of parking spaces and the second point, that again your Board is aware of, that approximately 50 parking spaces behind this building all the way over to Westphalia as well as along the railroad are owned by this property but for many, many years have been leased to the town for municipal parking because that was basically how the community business district function most effectively and we would envision that that would continue as we go through this Southold Town Board Regular Meeting July 2, 2019 page 51 project and we fully intend to continue to pursue that plan of shared parking. The town has, per your May 2018 sanitary credit log and that's the most recent one posted, 17.14 credits remaining in the Mattituck vicinity, 55 town wide and most of them have been there since 2006, 2008, so we would like to submit that this is the appropriate time to start using these, it will help the affordable housing redevelopment of the property and we are using less than 2, it will only be 1.6. That is all illustrated in the information, the plans that you have, as well as the application. If you would like me to go through any of the numbers, I will probably rely on the engineer but they are all there and consequently, we ask that you approve this project for 1.6 sanitary credits, transferred into the district. The same district from which they would be coming, the Mattituck district, to allow the project to obtain (inaudible) density and meet the health department criteria of transfer of development rights under their guidelines. If you have any questions, or if you would like me to say anything further under a different topic, I would be glad to do that. SUPERVISOR RUSSELL: I just wanted to mention, you mentioned the lease to the town from the bank, it was for a dollar a year. We haven't paid them in a decade to be perfectly candid. MS. WICKHAM: Well, you got a good deal. SUPERVISOR RUSSELL: They wouldn't take a post-dated, third party check. They should have told us that in the beginning. MS. WICKHAM: They're a bank, what can I say? But you have maintained it and you have certainly expended money on it and we (inaudible) a large part of both of the parking lots. Thank you. Bob Hanlon, Orient BOB HANLON: Bob Hanlon, Orient. The Housing Advisory Commission plays a vital role in assisting the town in the very complex issue of our critical housing needs. Despite the recent approval of the Vineyard View project, overall the housing situation is getting worse not better. The law currently states that the commission shall reflect the diverse membership with individuals from various geographic locations. And would include a broad representation from the community, such as landowners, persons with skill and knowledge about the environment, real estate, banking, building and farming. The law also currently provides for 10 members, this will proposal will reduce the number to 7. With the commitment to diversity in the code, it's hard to fathom how we can cover all those phases even with 10, without reducing the commission. The town is about to receive an influx of payments into the Southold housing fund (inaudible) to about $1,000,000.00. We also might have the ability to obtain additional funds through the States recently passed community housing fund that could permit (inaudible). The town will need much thought and planning to find sensitive and creative ways to invest these monies in our community. We need more informed and expert input, not less. I've attended several meetings of the Housing Advisory Commission and many meetings of other committees that are charged with assisting the town in planning, legislation and operations. I cannot help but notice a movement of the town away from letting the committees and commissions carry out the roles that they were authorized to play. So the question remains, why are we reducing the number of Housing Advisory Commission members? SUPERVISOR RUSSELL: I will answer that. Because 10 was unworkable because we couldn't get quorums to the meetings. Every year we advertise for people to volunteer for a variety of committees and we don't really get good responses. We have difficulty filling seats, we have difficulty when we do fill the seats with people with busy lives, being able to show up to meetings on at least a regular basis and it's very difficult to reach quorums. That was one of the issues, I think one of the challenges here. COUNCILMAN DINIZIO: Sure. SUPERVISOR RUSSELL: And with regard to diversity, I completely agree with you. Under the current committee, everybody is from the east, we haven't been able to find anybody in terms of geographic diversity from the west, Cutchogue, etc., to apply. But we need names and I would certainly welcome (inaudible) you would like to submit. MR. HANLON: I have another activity that is consuming my time these days but thanks for the offer. Southold Town Board Regular Meeting July 2, 2019 page 54 SUPERVISOR RUSSELL: Everybody has that, that's the problem. MR. HANLON: The process of trying to find committee members by putting an ad in the paper and assuming that's going to draw the right people (inaudible) I think is not really looking far enough afield. If there were a more concerted effort to enlist the (inaudible) of the various groups that we discussed earlier in another matter, the community civic associations, the chambers of commerce, the various associations that represent different business organizations in the town and solicit them to have representatives from their groups join and in a very active way, we might have a better chance to get people to take part in these meetings. SUPERVISOR RUSSELL: We engage with civic associations all the time and I think you are aware of the fact that I have been out to a civic association� that you used, to spearhead (inaudible), they all know the challenges but people do live busy lives and committee positions here are very difficult to fill regardless of the subject matter, the reality is, this is one of the biggest committees we had, we need to reduce the number to at the very least get a number where we can at least get four people in the room at one time, given everybody's busy lives. People have a lot to do, they have families, they have (inaudible). All these things. So trying to get them in and (inaudible) we do a great deal more than just run ads, we do, we count on committee people that are part of those committees, they/bring people in. We try to generate interest wherever we can. There's a lot of committee's in town government. We try to fill them all as best we can. MR. HANLON: I respectfully disagree. Anne Murray, East Marion ANNE MURRAY: Good evening, my name is Anne Murray, East Marion. I have a bureaucracy question. The town doesn't have a really huge bureaucracy, which is a good thing but sometimes it's not very efficient. Back in November of the past year, there was a house in East Marion next to (inaudible) an old farmhouse that has been boarded up for probably five or six years now, and the grass is about a foot high. So I called code enforcement, I also filed a complaint on line and asked them to please come and mow the property because it's really an eyesore when you first come into East Marion. And nothing was done, the winter went by, the spring came, so on May 16`x' I took photos again and actually went into Town Hall and spoke to the gentleman, I forget his name, but he was very nice and I showed him the picture and he was like oh, yeah, wow. I think Lester was handling that and let me have him get back to you. I said wonderful and I left. A couple of days later, Lester called me and said we finally tracked this guy down. I am thinking, it took you that long to track this guy down? And he said, yeah, he hasn't paid his taxes and we are going to get the lawn mowed but we have to get the Town Board to pass a resolution to get the lawn mowed, and I said what? They have to pass a resolution? That doesn't seem efficient, he said, well I guess it has to do with the budget of the highway department, I am not really sure DPW, blah, blah, blah. I said thank you very much, Lester for getting back to me, I look forward to seeing it mowed. And it still hasn't been mowed, and that was probably two weeks ago? So can you explain to me, is that true that you have to pass a resolution? SUPERVISOR RUSSELL: Yes, let me just explain.... MS. MURRAY: To get the lawn mowed on one piece of property? SUPERVISOR RUSSELL: Let me just explain, and I think that's been a problem property for years and you know the difficulty we had in trying to find the owner, I believe he used to own a multiple family... MS. MURRAY: I think he still does and I think he was not that difficult to find. Southold Town Board Regular Meeting July 2, 2019 page 56 SUPERVISOR RUSSELL: Very elusive. Well, he was for us, I 'remember working with it years ago, very elusive. What happens is, the reason the town Board needs to get involved ultimately is because we are going through property maintenance code, we have to do the work ourselves. I order to do the work ourselves and then bill it back to the owner we need to have a formal action of the Board so that we can attach it to the tax bill for collection when the bills go out in January. And if he doesn't pay:the bill, it still gets paid by Suffolk County. MS. MURRAY: And will that resolution be coming in the next couple of weeks? SUPERVISOR RUSSELL: I will direct the Town Attorney to make sure.... MS. MURRAY: Because I was looking for it and I didn't see it. SUPERVISOR RUSSELL: I will direct the Town Attorney right now to make sure it's on for the next agenda. Also we have been short-staffed. One of our code enforcement officers retired, we finally were able to hire one recently. We had to canvass the list several times, very difficult to get people off the list to hire,particularly in town's like Southold that don't pay as much as the western towns, the jobs are more compelling up there but we just did hire again, so we are in the process of expanding that staff. MS. MURRAY: So that was my other bureaucracy question, how many code enforcement people will you have in August when the new rental code comes into effect? SUPERVISOR RUSSELL: I believe 2 and a half plus the building department. MS. MURRAY: Two and a half. But the building department doesn't go out and inspect and issue violations, that has to be done by the code enforcement, correct? SUPERVISOR RUSSELL: The review process for the permit itself, what we are finding now is that it's turning up a lot of work that was done without a permit, that is in fact the enforcement issue and then those people then have to come in and apply for permits and go through the regular inspection process (inaudible) and all of that is done by the building department. MS. MURRAY: And does anybody have any idea, maybe you do Jill because you came up with the code, are there a lot of applications for rental permits coming in, given that it's almost a month away? COUNCILWOMAN DOHERTY: There's been quite a few since January and for the most part, if your house, if you have a CO for everything it's a quick turnaround, they get on the inspection list which is usually within 10 days, they get inspected and that afternoon they get a call saying come pick up your permit and for the majority of them, that's how it's been working but as Scott said, there's areas where they go out and inspect and they find out they don't have permits for certain things that have been built over the years. l Southold Town Board Regular Meeting July 2, 2019 page 57 MS. MURRAY: Okay but that's, and getting back to how many code enforcement, I remember that two or three years ago I asked about that and I think you had two and a half people back then, you had what's her name that was part-time on the weekends, the woman from Riverhead. SUPERVISOR RUSSELL: Did we budget for two and a half or three and a half? COUNCILWOMAN DOHERTY: We are trying to get up to three and a half but since we started the code enforcement department, we have had some change over which we can't anticipate when that is going to happen, we had a retirement and then we had the part-time person that you just talked about leave and so you know, we replaced her and then as Scott said, it's been hard to replace the full-time through civil service regulations.... SUPERVISOR RUSSELL: Yes, and also one thing that I just remembered, also is that we did have the two and a half, we added one other title as the fire marshal who has full authority to enforce the code just like the code enforcement officer. In fact, probably more so. COUNCILWOMAN DOHERTY: And the electrical inspector can do inspections as well, that's why we hired the full time electrical inspector. So between all these new hires, they are to help each other out and work together under the town attorney's office and Mike Verity in the building department. MS. MURRAY: Will the code enforcer be issuing a report at the end of the year about how many violations they issued? I have never seen that in the town report. That might be something people would be interested in. I know I would be. TOWN ATTORNEY DUFFY: We usually put it in at the end of the year. Usually put it in the numbers of complaints written and received and answered and how many summons issued, it's under the town attorney report. MS. MURRAY: Do you issue the number of fines paid and how much? TOWN ATTORNEY DUFFY: I don't actually put that in, no. MS. MURRAY: That might be something people would be interested in, because the reputation of this town is that you don't necessarily get caught and pay a fine. SUPERVISOR RUSSELL: Well, one of the issues you have to remember is that any of those violations that gets adjudicated, the judge decides what the fines are. I do think we have put legislation in place that creates ceiling amounts on the fines, that could be no less than, no more than. But ultimately, those cases, they go before a judge, it's not the town attorney that impose the fine, it's the town attorneys that request the fine and that ultimately gets decided by a judge. COUNCILMAN DINIZIO: I think that you have to remember that our code enforcement officer, they seek compliance not necessarily fines. So you know, they will see a violation, you get it fixed and I will come back and take a look at that. A lot of our code enforcement is that. Southold Town Board Regular Meeting July 2, 2019 page 58 so whether or not there is a fine or not, it's not going to be reflected in the fact that we got more CO's and more up to date homes as a result of the rental law. MS. MURRAY: I understand Jim, and I appreciate that but I think that given the amount of short term rentals that are still in the town, there hasn't been much compliance on that score. COUNCILMAN DINIZIO: Yeah, I agree with you there. MS. MURRAY: And I don't know what's happening with that but I do think we need a little of that as well. SUPERVISOR RUSSELL: I did meet with you specific when we talked about the challenges and we need to work together to solve those but you, we had a meeting, you are well aware of what we are facing but we certainly need to do more... MS. MURRAY: Inaudible, and then the next month when it's going to be even more apparent but anyway, I don't want to keep this meeting really long because it's the end but I had two other things I wanted to bring up, one is the Planning Board hearing on the comp plan, it's going to be July 29`", this is the first day that I have heard of this and I think it's a little soon. I realize that people have waited 10 years to see the plan, the end of it but I think the residents here need a little more time to absorb it before a September vote and it was my impression that before the comp plan process began and we have had three meetings with the Planning Board people at EMCA and they were wonderful, on the different chapters and explaining, taking feedback from the residents and we are very proud.to participate but I do think that a plan of that size needs a lot of time to be digested and I know the different groups asked for different things to be put in the plan, I am not sure they are in there, I have not gone online and read it all yet but I think that's kind of going fast. Maybe we should wait until the beginning of next year to vote and also, I am wondering, I seem to recall that when the plan was first started that the town residents were going to vote on this.Not just the Town Board, wasn't there a referendum on this or something? SUPERVISOR RUSSELL: There is no provision that would call for a referendum on this. There would be public hearings but ultimately the authority, unfortunately,just the Town Board has the, the Planning Board votes for recommendations, the Town Board votes for adoption. That's why we have had so many public input meetings, was to make sure that the public had not just participation and knowledge but authorship in the plan. MS. MURRAY: I understand that but given that some of the meetings are so long ago, I think the public needs more time than just a month, not even, to show up for a Planning Board public hearing to express their views on this. COUNCILWOMAN DOHERTY: Can I clarify the process? SUPERVISOR RUSSELL: Sure. Southold Town Board Regular Meeting July 2, 2019 page 59 COUNCILWOMAN DOHERTY: So what the process, the Planning Board has to have their public hearing in order to deem their work complete and recommend it to the Town Board. Then the Town Board will have a public hearing, we won't just go to vote. So there's two public hearings that the public can come to and before and in between those public hearings, we hope to get it out to as many people as possible and have as many meetings that we are trying to schedule now. So it's not just, okay, one public hearing and two weeks and it's done, it's a series of public hearings.... MS. MURRAY: Okay, two formal public hearings, one for the Town Board... COUNCILWOMAN DOHERTY: Yes. MS. MURRAY: One for the Planning Board and then you'll have community meetings in between? COUNCILWOMAN DOHERTY: Yes. Before and in between. MS. MURRAY: But it will all be done before September, so if any member of the public really has any issue with anything in the plan, then they need to read it and go to one of these meetings or a hearing before September? SUPERVISOR RUSSELL: Inaudible. So there's outreach and you have to remember, every chapter, they are not 'new, they are chapters that have already been before the public and thoroughly vetted, thoroughly discussed... MS. MURRAY: Well some of them have been revised since they were originally drafted. SUPERVISOR RUSSELL: Right. MS. MURRAY: And people may not know that, so they need to read it. It's not the Mueller report but people should read it. SUPERVISOR RUSSELL: We didn't redact any of it. MS. MURRAY: And the last thing, just a question out of my own curiosity, what is the Southold Local Development Corporation? And what does it do? SUPERVISOR RUSSELL: The Local Development Corporation was developed by the Town Board a few years ago, there was a time where not for profits, hospitals, healthcare facilities, could go through Suffolk County Industrial Development Agency and secure financing for expansion and things like that, some years ago, about seven or eight years ago the law was changed so not for profits could no longer qualify to go to this development agency. There was a void there, the hospitals, healthcare facilities that had no access to the bond markets, so the Local Development Corporation was created, it's a free standing board of five members, there's an executive director, they are self-funded, they are by prescription at a very arms-length from the Southold Town Board Regular Meeting July 2, 2019 page 60 Town Board. There's not a lot of interworking there, there shouldn't be. They are a free standing board. They work with the applicant, most recently the Eastern Long Island, the LDC gave them access to the bond market, they were able to refinance and they said in fact, the refinancing was what made the merger with Stony Brook possible. Those are the types of things that they do. They fill that void. MS. MURRAY: I was just curious. How many people are on that board? SUPERVISOR RUSSELL: Five. MS. MURRAY: And how many citizens are on that board? SUPERVISOR RUSSELL: Five. And one executive director. The gentleman we had who has a lot of expertise, he was paid. But again, he was paid by the applicants, by Peconic Landing or Eastern Long Island Hospital, not with town dollars. And he had a lot of knowledge, he passed away so we are trying to fill the position now. MS. MURRAY: Okay, thank you. SUPERVISOR RUSSELL: Who else would like to address the Town Board? Robert Dunn, Peconic ROBERT DUNN: Robert Dunn, Peconic. Just a question, the sanitary flow credits, I am kind of catching up with the concept, they don't have a cash value? I mean, when you give them to somebody or transfer them to somebody or swap them, there is no cash value? SUPERVISOR RUSSELL: Well, we are going to revisit MR. DUNN: I'm not implying there is something wrong here where you guys make those decisions, I am just curious about it. SUPERVISOR RUSSELL: Yes, we are going to revisit the fees issue but generally sanitary flow which you know comes from land we preserve, transfer into a bank, the fee for credit was about $17,500 because you need to keep the fee low to make the affordable housing component,viable. The whole purpose of the sanitary flow credit. MR. DUNN: I get that, I get it. SUPERVISOR RUSSELL: so we keep the fee low at $17,500. MR. DUNK: So there is a monetary value? SUPERVISOR RUSSELL: Yes. MR. DUNN: Okay. Jill said 10 days for inspections? Southold Town Board Regular Meeting ' July 2, 2019 page 61 COUNCILWOMAN DOHERTY: I said that the building department is general, on all inspections, tries to keep it within 10 days. This time of year when they have a lot of influx of building and everything, they do go out a lot further. Sometimes 30 days. MR. DUNN: Okay. COUNCILWOMAN DOHERTY: The general rule is... MR. DUNN: Okay, I am not complaining at all about it but I, my second time here now and things are really up in the air for me, literally, that's where my house is now. And waiting, it's going on three weeks and more;they had bent over backwards to do it but I just think with this rental issue and the subsequent things people have found they have to do to their building to bring it into code compliance and then have to be re-inspected, the window is getting wider. 1 COUNCILWOMAN DOHERTY: And we are cognizant of that but also Jim had checked the inspection list number and where it's at now compared to last year and we were pretty much on par with where we were... COUNCILMAN DINIZIO: It's pretty normal at this time of year to see that... MR. DUNN: It is the busy season, of course. COUNCILMAN DINIZIO: And most of the people that come in normally, builders, architects, they know the schedule, they know if they need an insulation inspection to schedule it well ahead of time and then meet that date themselves. A'lot of people are just coming in and they want to get something done right away, that's where you get the 30-40 days out. MR. DUNN: Oh, yeah. When you come in on Monday and expect it done Tuesday... 'COUNCILMAN DINIZIO: Right. Right. That happens every May, June, July. You know, honestly this year, I can tell you definitely the rental law had an effect. MR. DUNN: It's had an impact. COUNCILMAN DINIZIO: It did have an impact on it. And you know, maybe it gave them more work. MR. DUNN: And the issue I am raising is not a criticism of them but perhaps they need more support? COUNCILMAN DINIZIO: Well, yes they could always use more support but you know, we are getting'them other ways, we did hire a full-time electrical inspector, we have a part-time one, so you know that's a big help right there to the electricians. We have a fire marshal now. We just did hire an ordinance inspector, so we are moving on. Honestly, though, the toughest part is Southold Town Board Regular Meeting July 2, 2019 page 62 finding qualified people who are willing to come out here for the money we are offering them. It's a very difficult task. MR. DUNN: It goes under the topic of support. COUNCILMAN DINIZO: Under the topic of whether the town can afford.... MR. DUNN: Okay,-but if the town sets up a barrier for wage and obviouslythey can't fulfill their needs, so the Town Board needs to examine what they are doing there so it's not to have it... COUNCILMAN DINIZIO: Well, our resolutions reflect that today, I mean, there's raises in here for people that are under... SUPERVISOR RUSSELL: Let me just clarify though, there's only certain instances where we can give raises based on a decision of the Board, it would generally be just for exempt positions but for positions where we advertise, code enforcement, code ordnance inspector, fire marshal, those are all titled positions that are part of a collective bargaining agreement with the union, so you can't really give them raises... MR. DUNN: So their salaries are no lower than anybody else's? SUPERVISOR RUSSELL: Well, you can't advertise a salary that's higher than reflected in the contract. You would have to go to the union and get permission to pay someone, for instance, if our salary isn't competitive with other towns, we would need to go to the union and strike an agreement with the union to raise that salary. Easier said than done with a very large union with a very broad membership. MR. DUNN: Like the collective bargaining pretty much informs... SUPERVISOR RUSSELL: That's right but that's a two-three year process. MR. DUNN: When you go into collective bargaining, you are bargaining against Islip, in sense because they are going to (inaudible) SUPERVISOR RUSSELL: Without getting into the details of negotiating, the problem is what are our priorities on what salaries to raise may be very different than the priorities of the union, so all of that has to be part of a collective bargaining negotiation and you know, Southold is unique because we have one union that covers so many different factions, a highway department, public safety, and they all have different needs because of the nature of their jobs. So it's very cumbersome for the union itself, we work with them well but it's tough for all of us. As it is, our pay scale on a whole is less than other towns, so, unless we are willing, you know, payroll is probably 40% of my budget. Unless we are willing to start spending a lot of money across the board;we, the die is cast on this. And we do ultimately, it takes some work but we do ultimately find people. I will say, Mike Verity recognized that the rental code was going to put a lot of f Southold Town Board Regular Meeting July 2, 2019 page 63 onus on his department but he also knew once everything was set, once the permits were issued, then it just goes into maintenance mode. And so I think he was willing to accept the huge responsibility right now and he didn't want to saddle the town with another salary that might not be required after the permit process... MR. DUNN: A year from now. SUPERVISOR RUSSELL: Yes. MR. DUNN: And he's been fine, he came out and personally did do one of the inspections because it couldn't go through the process quick enough, I went into see him and he said I'll come do it. 'SUPERVISOR RUSSELL: He's trying to get it all done and keep payroll lower. MR. DUNN: No question. COUNCILMAN DINIZIO: There's a lot of overtime coming from that department now. I mean, they are working extremely hard, a lot of hours... MR. DUNN: I am sure they are. No matter how many hours they work, there always so much work they can do. You can give all the overtime in the world but they can only do so much in the hours they work. COUNCILMAN DINIZI0: One thing we have is employees that are willing to do it. It's a lot of work, you know, it's summer, everybody wants to go out and go to the beach. These guys are buckling down and they recognize the fact that we have more on their plate then maybe they can use. Hopefully if you listen to Mike, the most commonsense person in the world, you know if you talk to him, in January we'll probably be right back where we were, which is you know, kind of like a clock. COUNCILWOMAN DOHERTY: All of us are constantly talking to them, saying, you know, do you need you know. We talked two weeks ago about maybe hiring a seasonal employee and Jim is the liaison to the building department, he went and talked to Mike, Mike said no, I think we are getting things done. It will take more of our time if we had to train somebody new just for two months. So they felt it wasn't necessary. SUPERVISOR RUSSELL: Who else would like to address the Town Board?
