Docko, Inc. on behalf'of R. B. BURNHAM III requests a Wetland Permit to construct±66 linear feet
of 4' wide fixed wood pile and timber pier of which ±48 linear feet is waterward of the AHWL,
including hand rails on each side, electric and water utilities; install a 3.5'x22' hinged ramp to a
6'x20' float with four (4) 8" diameter restraint piles. Located: Right of Way off Peninsula Road,
Fishers Island. SCTM# 1000-10-4-10
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation that
the action is CONSISTENT with the below listed Policy Standards and therefore is CONSISTENT
with LWRP provided the following is considered:
6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town Board of
Trustees laws and regulations for all Andros Patent and other lands under their

1. Comply with Trustee regulations and recommendations as set forth in Trustee
permit conditions.
It is recommended the Board assess the dock structure to § 275-11 Construction
and operation standards C. 2 (d) of the Southold Town Code; in particular:
j61 Whether the dock will cause habitat fragmentation and loss of significant
coastal fish and wildlife habitats,
The dock structure is proposed in the New York State Significant Coastal and
Fish and Widlife Habitat Area/ NYSDEC Critical Environmental Area. At the
discretion of the Board of Trustees, any operations proposed in critical
environmental areas (§ 275-2) may be subject to more stringent requirements
than detailed in this section. Such requirements may include, but are not limited
to, denial of certain operations, shortening or reducing the size of structures,
and increasing the width of non-disturbance buffers.
Alteration of tidal patterns in the Fishers Island Beaches, Pine Islands, and
Shallows habitat could have negative impacts on the fish and wildlife
communities present. Construction of shoreline structures, such as docks and
piers in areas not previously disturbed by development may result in the loss of
productive areas which support the fish and wildlife resources of the Fishers
Island Beaches, Pine Islands, and Shallows habitat.
Unrestricted use of motorized vessels including personal watercraft in the
protected, shallow waters of this habitat can have adverse effects on aquatic
vegetation and fish and wildlife populations. Use of motorized vessels should be
controlled (e.g., no wake zones, speed zones, zones of exclusion) in
and adjacent to the area's shallow waters and vegetated wetlands. (NYSDOS)
[7] Whether the dock will result in the destruction of or prevent the growth of
vegetated wetlands, seagrasses including eelgrass (Zosters marina) and
,widgeon grass (Ruppia maritima) or shellfish;
[11] Whether the cumulative impacts of a residential and commercial dock will
change the waterway or the environment and whether alternate design,
construction, and location of the dock will minimize cumulative impacts; and
The continued construction of dock structures within a Significant Fish and
Wildlife Habitat/Critical Environmental Area will affect the public use of the area
and degrade the ecological quality of the area through introduction of
contaminants, disruption of marine life habits etc. .... Correspondingly, physical
and functional loss to wildlife has been found to occur through the loss and/or
impairment of habitat, disruption of habits and migration patterns (structure and
activity) and introduction of harmful contaminants. The most common
contaminant associated with docks is wood preservatives impregnated into the
wood used to prolong the life of a dock. Three trace metals; arsenic, chromium
and copper are the most common. These three metals have the greatest
potential to increase in estuarine environments from docks (Sanger and Holland
2002). The use of treated materials should be minimized.
In the event the action is approved, it is recommended that:
1. That a vegetated buffer be established to mitigate the local impacts from the dock
structure to public surface waters and bottomlands.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area. '
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local i
Waterfront Revitalization Program. A urouosed action will be evaluated as to its significant
beneficial and adverse effects IMon the coastal area(which includes all of Southold Town.

Darbles Cove is a small estuary,almost a pond except for the tidal creek flowway and accessway at the northeasterly quadrant.
Passage through the entryway is partly blocked by two huge boulders in the thalweg so visitors are rare. The view of the cove is significantly
shaded by trees which also limits visibility of the cove. The cove is hardly a scenic resource. Except for a few residents around the perimeter,
no one can really get more than a glimpse of the cove. The proposed dock will be similar to the dock of Jim Baker across the cove.

to allow continued growth of what little tidal wetlands vegetation grows in the shade of shoreline trees if other conditions are suitable.
In addition,the NYS DEC prepared a study showing that the proposed pressure-treated Southern Yellow Pine timber product

There is no solid waste or hazardous substances to be generated from this project.The pressure-treated wood trimmings from the
dock construction will be collected and disppsed of in accordance with current regulations so as to minimize harmful effects.
PUBLIC COAST POLICIES
Policy 9. Provide for public access to, and recreational use of, coastal waters, public lands, and public
resources of the Town of Southold. See LWRP Section III—Policies; Pages 38 through 46 for evaluation
criteria.

This project is being undertaken and the pier will originate from private land. The Public Trust Lands and Waters constitutes the area between the Mean High
Water line and Mean Low Water line and the resources are from the High Tide line out. These environmental resources are being protected by the design -
standards dictated by the NYS DEC and the Town's tidal wetlands law. The intertidal zone beneath the pier landing is sand with intermittent stone and boulders.
There is virtually no public use of the waterfront in this area due to the overgrown nature of the bank and the steep slope down to the water's edge. The new
construction of the pier and landware extension above the AHWL are not likely to influence or change these conditions or entice access to the site

that an element of diversity in the water colonies benefits the support of small and juvenile species since it provides a site for algae
growth, barnacles,small crabs,other custaceans,mollusks,and shellfish even sponges. Reference is made to the 2000 DEC report
that found pressure-treated timbers to be acceptable for construction use in marine environments.
