(17.5'x22.5') on-grade, semi-pervious masonry patio (stone set in sand with gravel joints); install 2'x4' stone paver between proposed patio and wood landing; install 4' high wire mesh fence with gate; supplement existing vegetation on face of embankment with native grasses and shrubs; establish and perpetually maintain a 10' wide non-turf buffer along top of bank; remove non- native/invasive vegetation and establish native plantings within approximately 1,650sq.ft. area along northerly property line; establish approximately 855sq.ft. of native plantings along southerly property line; and remove existing well, concrete cover, flag pole, split-rail fence, and four (4) trees landward of bank. SCTM# 1000-118-6-10 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. INSTRUCTIONS 1 , All applicants for permits* including Town of Southold agencies, shall complete this CCAF for proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions'including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2Do- conditions, Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its si nif beneficial and adverse effects upon the coastal area (which includes all of Southold Town). Minimize loss of life, structures, and natural resources from flooding and erosion. See LWRP Section III- Policies Pages 8 through 16 for evaluation criteria ® Yes ❑ No ❑ Not Applicable The project seeks to replace an aging timber bulkhead,whose presence is noted in the 1987 application for the"Trustees waiver" that authorized construction of the deck landward of the bulkhead,which is now proposed to be replaced with an on-grade patio. The bulkhead replacement is proposed along a section of shoreline and embankment that has been improved with and supported and protected from flooding and erosion by a bulkhead for more than 30 years,and there is no viable non-structural alternative means of maintaining and protecting the same portion of property from erosion. Rather,without replacement and maintenance of the bulkhead, the subject property and the adjacent property to the north,whose bulkhead ties into the applicants'bulkhead,would be exposed to severe erosion and flood damage. Therefore the project is consistent with Policy 4. Attach additional sheets if necessary Policy 5. Protect and improve water quality and supply in the Town of Southold. See LWRP Section III - Policies Pages 16 through 21 for evaluation criteria ® Yes ❑ No ❑ Not Applicable The new bulkhead will be constructed with untreated vinyl sheathing,and the existing treated timber,deck is to be replaced with a semi-pervious,on-grade patio consisting of stone pavers set in sand with gravel joints,which will improve site drainage and reduce the area of treated materials adjacent to tidal waters Additionally,a 1,650 sf area of invasive/non-native vegetation on the north side of the property is to be replaced with native vegetation,native grasses and shrubs are proposed to supplement the existing embankment plantings authorized in 2013 by Town Wetlands Permit 8251,a 10'wide non-turf buffer will be maintained along the top of bank; and 855 sf of native plantings will be established on the south side of the property Therefore,the project will effectively maintain the historically existing conditions along the shoreline while creating an overall improvement to the environmental condition of the site through reduced treated materials,improved drainage,and vegetative restoration. Consistent with the objectives of Polices 5 and 6 of the LWRP,the project will thus protect and improve water quality and the quality and function of the surrounding coastal ecosystem of Great Peconic Bay.
