Main Rd. &Youngs Ave.) G @ Southold, NY 11971 Telephone: 631765-1938 � • y0 104UNT`I,� LOCAL WATERFRONT REVITALIZATION PROGRAM TOWN OF SOUTHOLD MEMORANDUM To: Michael Domino, President Town of Southold Board of Trustees From: Mark Terry, Assistant Town Planning Director LWRP Coordinator Date: January 15, 2019 Re: LWRP Coastal Consistency Review for JONATHAN BABKOW& MARIA RUBIN SCTM# 1000-23-1-18.1 Samuels & Steelman Architects on.behalf of JONATHAN BABKOW & MARIA RUBIN requests a Wetland Permit to demolish existing 2,543sq.ft: dwelling with 1,567sq.ft. of decking; remove existing 2,236sq.ft. of vinyl pool, terrace and retaining walls; remove existing 2,830sq.ft.'concrete driveway and walkway; construct new 2,861sq.ft. two-story dwelling with attached 2-car garage; construct a 352sq.ft. landward terrace and a 675sq.ft: seaward side terrace attached to dwelling; construct a 620sq.ft. trellis; construct a combined 2,972sq.ft. gunite swimming pool (20'x40') and a pool terrace seaward of dwelling; install pool enclosure fencing around perimeter of property; install a new well and sanitary system, 2,255sq.ft. of new gravel driveway and parking area and new 322sq.ft. entry walkway, all to be located landward of Trustee jurisdiction; and to install gutters to leaders to drywells to contain roof runoff, and in accordance with Chapter 236 of the Town Code—Stormwater Management. Located: 360 Private Road#8, East Marion. SCTM# 1000-23-1-18.1 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is INCONSISTENT with the Policy Standards and therefore is INCONSISTENT with the LWRP. The ecological value of Dam Pond is high. The proposed action is located within a NYSDOS Significant Fish and Wildlife Habitat Area; Orient Harbor. The NYSDEC Environmental Mapper indicates that he parcel is located within a rare plants and rare animal area. This layer shows generalized locations of animals and plants that are rare in New York State, including but not limited to those listed as endangered and threatened. The occurrence of rare plants or animals on site is very low. While is it recognized that the project design includes many elements that meet or further LWRP policies, to meet Policy 6 the following is recommended: 1. The property slopes towards Dam Pond. Establish a vegetated, non-turf buffer landward of the tidal wetland removing existing turf. Require that the buffer be planted with native vegetation. 2. Fifteen trees are proposed to be removed including four on the bank slope. It is recommended that the cherry trees on the bank and the significant (greater than 18" DBH) cherry tree in the rear yard be retained. The trees provide important nutrient uptake and stabilize soils. 3. Require the installation of a I/A OWTS due to the close proximity to high quality surface waters. Any activity that would substantially degrade water quality in Orient Harbor would affect the biological productivity of this area. All species of fish and wildlife would be adversely affected by water pollution, such as chemical contamination (including food chain effects resulting from bioaccumulation), oil spills, excessive turbidity or sedimentation, stormwater or road runoff, and waste disposal (including boat wastes). It is essential that high water quality be maintained in the area to protect the bay scallop and shellfish fishery. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Lazard Area. 2. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program.
