Main Rd. &Youngs Ave.) N Southold, NY 11971 ap Telephone: 631 765-1938 Oro U LOCAL WATERFRONT REVITALIZATION PROGRAM TOWN OF SOUTHOLD MEMORANDUM To- Michael Domino, President Town of Southold Board of Trustees From: Mark Terry, LWRP Coordinator Date: February 8, 2019 Re: LWRP Coastal Consistency Review for MICHAEL KREGER SCTM# 1000-53-3-13.1 Inter-Science Research Associates, Inc. on behalf of MICHAEL KREGER requests a Wetland Permit to demolish existing one-story dwelling, brick stoop, wood deck, shed with wood steps attached to west side of dwelling, shed with wood ramp, brick walkway, A/C unit on slab, and remove existing septic tank and leaching pools; construct new 1,895sq.ft. two-story dwelling to be located 55' from wetlands with two (2) roofed porches, one 50sq.ft. roofed porch on the front southwest side of dwelling and one 21 sq.ft. roofed porch on the northwest side of dwelling with approximately 30sq.ft. of stairs leading down from the roofed porches to the ground; new 13sq.ft. outdoor shower; new 740sq.ft. infinity pool with spa; new 670sq.ft. pool terrace; new 45sq.ft. pool equipment area on concrete slab; new 32sq.ft. generator of concrete slab; new HVAC equipment on 43sq.ft. concrete slab; new pool enclosure fencing to be located 13.5' from landward edge of wetlands; install a new septic tank and leaching pools; reconfigure the existing driveway increasing its area from 2,350sq.ft. to 2,765sq.ft.; existing garage with wood stoop and steps to remain; install a system of gutters to leaders to drywells to the dwelling and garage in order to contain stormwater runoff; expand the existing 5,385sq.ft. Non-Disturbance Buffer by adding another 2,925sq.ft. area to the buffer, including 1,342sq.ft. of existing native vegetation and 1,583sq.ft. of proposed native vegetation which will be planted to the northwest of the proposed dwelling in order to establish and perpetually maintain a 8,310sq.ft. Non-Disturbance Buffer area. Located: 1085 Bay Shore Road, Greenport. SCTM# 1000-53-3-13.1 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is INCONSISTENT with the Policy Standards and therefore is INCONSISTENT with the LWRP due to the following: 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction. 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. In 2000 the Board of Trustees issued Wetland Permit 5238 for a similar action. A condition in the permit required a 40' wide non-disturbance buffer adjacent to the tidal wetland line. In place of those structures,the owner seeks to construct the following structures: • A 1,895 sq. ft. two-story house (including a portion of the house that will be one-story with a roof deck),to be locatedW�;-�om wetlands (an increased setback of 26.7 ft.); • A 740 sq. ft. infinity pool with spa, located northeast of the proposed house, 34 ft. from wetlands. The pool will be located within the footprint of the existing deck and house. • A 670 sq.ft.pool terrace, located northeast of the proposed house, 40- . from wetlands. • A 13 sq. ft. outdoor shower attached to the west side of the proposed house, located 50 ft. from wetlands; • Two roofed porches will be attached to the proposed house: one 50 sq. ft. roofed porch on the front southwest side of the house; and one 21 sq. ft. roofed porch on the northwest side of the house. They will be no closer to the wetlands than the proposed house. • Approximately 30 sq. ft. of stairs leading down from the roofed porches to the ground. They will be no closer to the wetlands than the proposed house. • Pool equipment on a 45 sq. ft. concrete slab, 34 ft. from wetlands. • A generator on a 32 sq. ft. concrete slab, 58 ft. from wetlands. • HVAC equipment on a 43 sq. ft. concrete slab, 58 ft. from wetlands. • A pool fence to be located 13.5 ft. from wetlands, which will serve as a visual and physical barrier for anyone mowing tlf�,lawn within the fence and prevent removal of vegetation towards the wetlands. , • Installation of aseptic tank 101om wetlands , • Installation of leaching pools,which will be 113 ft;, o'm wetlands at their closest point. INTEIZ50ENCE In addition to the above new construction, the ex0gravel ay will be reconfigured, increasing its area from 2,350 sq. ft. to 2,765 sqt decreasing its wetland setback from 56 ft. to 58 ft. The existing garage and its attached wood stoop and steps will remain. Stormwater drywells will be installed to capture stormwater runoff from the house and the garage. The existing house does not have drywells to ca ture ru f; utter only water out to the ground surface. - Lastly, the owner proposed to exp the exist' 5,385 sq. ft. No-Disturbance Buffer, which was added to the property under To Trustees Wetlands Permit. 5238, issued October 30, 2000. The expansion will add 2,925 sq. ft.to the buffer,including 1,342 sq. ft. of existing native vegetation and 1,583 sq. ft. of proposed native vegetation, which will be planted to the northwest of the proposed house. If the project is approved, the owner would propose to record a covenant to protect all 8,310 sq. ft. of the new No Disturbance Buffer.
