BE IT FURTHER RESOLVED that the Board of Trustees DENIES WITHOUT PREJUDICE the application of GARY MANGUS & MIRIAM MEYERS to install a 4'x16' catwalk access using Thru- Flow decking built directly off existing bulkhead; and install a 6'x20' fixed dock supported by 6'x6' CCA timber posts with steps down to a 6'x4' lower fixed platform; and as depicted on the plan submitted by Gary Mangus R.A., dated May 14, 2019. My name is Michael Carlucci, 865 Island View Lane, Greenport (631) 880-8557. 1 am Gary's neighbor. As of April 2019 the proposed dock consists of a 22'x 4' access ramp with railings attached to a 24'x 6'fixed dock. The configuration would put the dock 28 feet into the creek.With a boat attached having a 8' to 10' beam, it would be 38 feet into the creek. The creek is shallow at low tide and not navigable by a power boat.Whether the dock is placed near the shore or 130 feet out, the depth at low tide is 6 inches or less. Even in 6 inches of water, a power boat will still be resting on the creek bottom at low tide. The dock would be the only one that far out in the creek. The adjoining homeowners with fixed dock's are all located at the shoreline. Where I am located at the north side of the creek, myself and three homeowners have floating docks that are 16 feet long or less adjacent to the shoreline (two are attached to fixed docks, two to bulkheads). We had the same problem as Gary, not having water at low tide at the shoreline with low water beyond the shore.We resolved by dredging a boat basin, instead of placing the docks further out into the creek. I have attached a photograph of Gary's waterfront taken at low tide on 4/19/19 @ 6:25PM. The photo shows the proposed location of the dock the shore line at low tide, and his boat sitting in water and resting on the bottom of the creek I request the trustees consider bringing the dock closer into the shore near the bulkhead as are adjoining property owners docks.As far as the size of the dock, I recommend the trustees take into consideration the size of other docks in the creek, and especially the docks of adjacent property owners. Depths for the dock terminus are within Town Trustees, New York State Department of Environmental Conservation and United States Army Corps. of Engineers guidelines and there is no recognized Federal/New York State/Town navigation channel in the immediate vicinity of the proposed structure. • Scope: The proposed dock is comparable to docks on neighboring properties in an area where docks historically are used for commercial and recreational purposes • Scope in relation to the riparian rights of shell fishers: The plan allows a standard fixed dock to platform design that will not impede access for those seeking shellfish and crustacea in season. • Environmental upkeep: The dock design projects a usual lifespan of 30 years with limited pile replacement so as to minimize disturbance of the bottom. After discussions with family and neighbors, our thoughts and concerns are as follows: It appears that the neighbors are constructing a dock that protrudes out and into the creek and appears to be 6x24 which is a large dock and ramp thereby effecting the esthetics of the area. There is no other house here in the creek who has docks with protruding docks or ramps. All docks are lined up or adjacent to their property. Enclosed are the revised submission documents: History We initially proposed a 6'x20' fixed dock with a 6' x 4' lower platform to afford boat and water access with the dock accessed via a 4'x16' ramp. We subsequently changed our proposal for an access via a 4'x22' ramp, setting the dock further into the waterway. (Since Conkling Point Creek is privately owned, Sue Mulholland,the owner, reviewed both sets of plans and she has given her written permission as per the previously submitted documentation.) The trustees, I believe in response to LWRP considerations ask if we could revise our proposal to begin the dock 10' from our bulkhead(4'x10' access ramp) and to see if we could make a 4' wide dock and platform work. We very much appreciate the trustees efforts in working with us to get a dock that will allow us to access the boat and water while remaining sensitive to environmental considerations. We feel privledged to live where we do and want to keep this area as pristine as it is. A set of revised plans showing a 4'x10' access ramp is enclosed. The revised plans still show the dock and platform at 6' wide due to functional considerations for safe access. We tried G A R Y M A N GU S@ G MAIL . COM CELL 9 1 7 -6 9 0- 9 8 7 8 2 but were unable to make a dock narrower than 6' work out while still providing safe access to the lower platform. A pdf is attached with studies showing why a 4' wide dock does not work and why a 6' width is necessary. A second set of plans is also attached that show the dock and lower platform accessed via a 4'x16' ramp, as originally submitted. Given the waterway studies that were previously submitted, we believe the dock would not adversely intrude on the waterway or adversely impact the aesthetics of the area, or otherwise make a difference environmentally. We understand one of our neighbors wrote a letter expressing concerns about the aesthetics of a dock and it interfering with the waterway -we respectfully dis agree with his assessment, and we have spoken to other neighbors whose properties are within the inlet and they find our proposed plans not only acceptable but in keeping with the character of our shared access to the bay. They also foresee no change as to how they currently enter and exit the inlet to their docks since they travel the center of the inlet within the existing channel. So, while we would prefer the 16' solution- given all the reasons stated above—we trust the experience and expertise of the board of trustees, and we will go with whichever set of plans the trustees deem most appropriate. In summary: 1. The very low water depths in the area are inadequate for the operation of a motorized vessel during periods of low water. 2. The dock will result in adverse, ecological impacts. Operation of motorized vessels in areas of with very low water depths can cause bottom scarring, turbidity and loss of benthic species. 3. The continued construction of dock structures within a Significant Fish and Wildlife Habitat/Critical Environmental Area will affect the public use of the area and degrade the ecological quality_of the area through introduction of contaminants, disruption of marine life habits etc. . .. Correspondingly, physical and functional loss to wildlife has been found to occur through the loss and/or impairment of habitat, disruption of habits and migration patterns (structure and activity) and introduction of harmful contaminants. The most common contaminant associated with docks is wood preservatives impregnated into the wood used to prolong the life of a dock. Three trace metals; arsenic, chromium and copper are the most common. These three metals have the greatest potential to increase in estuarine environments from docks (Sanger and Holland 2002). 4. The dock does not comply with the existing "pier line". The extension beyond the existing "pier line" creates a navigational hazard for small watercraft. 5. Approval of the dock would establish the precedent of allowing longer docks in this sensitive waterbody. $ 6. The extension of dock structures into public waters hinders the public use of such waters where the dock is located. 7. The applicant presently enjoys access to the waterbody due to the waterfront location of the lot. Due to the shallow water depths and environmental sensitivity of this waterbody, the seasonal moorinq of vessels is more appropriate in this area. Before issuing a permit for a dock structure, the Trustees shall consider whether the dock will have any of the following harmful effects: (2] Whether the dock will unduly interfere with the public use of waterways for swimming, boating, fishing, shellfishing, waterskiing and other water-dependant activities; The dock is expected to reduce public use in the area for water dependent activities. Chapter 275 requires that the determination of the length of the dock must include the dimensions of the vessel. The dimensions of a vessel are not specified. [6] Whether the dock will cause habitat fragmentation and loss of significant coastal fish and wildlife habitats; The dock structure is proposed in shallow water. The draft of a representative vessel has not been provided. Operation in-areas of shallow water can cause turbidity, loss of submerged vegetation and damage to bottomlands. Furthermore the dock is proposed in the New York State Significant Coastal and Fish and Widlife Habitat Area/ NYSDEC Critical Environmental Area. At the discretion of the Board of Trustees, any operations proposed in!'critical environmental areas (§ 275-2) may be subject to more stringent requirements than detailed in this section. Such requirements may include, but are not limited to, denial of certain operations, shortening or reducing the size of structures, and increasing the width of non-disturbance buffers. [7] Whether the dock will result in the destruction of or prevent the growth of vegetated wetlands, seagrasses including eelgrass (Zosters marina) and widgeon grass (Ruppia maritima) or shellfish; The dock will not impact emergent, wetland vegetation. The occurrence of seagrass is unknown but, not expected. [10] Whether the dock will adversely affect views, viewsheds and vistas important to the community; The important view sheds and vistas to the community have not been identified or discussed. [11] Whether the cumulative impacts of a residential and commercial dock will change the waterway or the environment and whether alternate design, construction, and location of the dock will minimize cumulative impacts, and The continued construction of dock structures within a Significant Fish and Wildlife Habitat/Critical Environmental Area will affect the public use of the area and degrade the ecological quality of the area through introduction of contaminants, disruption of marine life habits etc. .... Correspondingly, physical and functional loss to wildlife has been found to occur through the loss and/or impairment of habitat, disruption of habits and migration patterns (structure and activity) and introduction of harmful contaminants. The most common contaminant associated with docks is wood preservatives impregnated into the wood used to prolong the life of a dock. Three trace metals; arsenic, chromium and copper are the most common. These three metals have the greatest potential to increase in estuarine environments from docks (Sanger and Holland 2002). [12] Whether adequate facilities are available to boat owners and/or operators for fueling, discharge of waste and rubbish, electrical service and water service. No such facilities are proposed or discussed i i 9.3 Preserve the public interest in and use of lands and waters held in public trust by the state and the Town of Southold. A.
