Box 1179 Glenn Goldsmith Southold,New York 11971 A.Nicholas Krupski G Q Telephone (631) 765-1892 Greg Williams Fax(631) 765-6641 o�yCOUNI`I,� BOARD OF TOWN TRUSTEES TOWN OF SOUTHOLD August 14, 2019 Dennis Cole Cole Environmental Services 425 Montauk Highway East Quogue, NY 11942 RE: FLORIANE LAVAUD & THOMAS ANNICQ 305 HALLS CREEK DRIVE, MATTITUCK SCTM# 1000-116-7-2 Dear Mr. Cole: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, August 14, 2019 regarding the above matter: WHEREAS, FLORIANE LAVAUD & THOMAS ANNICQ applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance, application dated June 7, 2019 and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator recommended that the proposed applications be found Inconsistent with the LWRP, and specifically Inconsistent with the following coastal policy: Policy 6.3 —Protect and restore tidal and freshwater wetlands, and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on August 14, 2019, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the Board has determined that the structure, as applied for does not comply with the standards set forth in Southold Town Code Chapter 275-11(C)(2)(b)(2) —"Within creeks and other narrow waterways, no dock length shall exceed one-third of the total width of the water body. Determination of the length of the dock must include the dimensions of the vessel'; and 275-12. Standards for Issuance of Permit. A. Adversely affect the wetlands of the Town; B. Cause damage from erosion, turbidity or siltation; D. Adversely affect fish, shellfish or other beneficial marine organisms, aquatic wildlife and vegetation or the natural habitat thereof, G. Change the course of any channel or the natural movement or flow of any waters, H. Weaken or undermine the lateral support of other lands in the vicinity, 1. Otherwise adversely affect the health, safety and general welfare of the people of the Town; J. Adversely affect the aesthetic value of the wetland and adjacent areas; and WHEREAS, the Board has determined that the request, as applied for, will have a detrimental effect upon the health, safety and general welfare of the people of the town, and, adversely affect navigation on tidal waters or the tidal flow of the tidal waters of the Town. BE IT FURTHER RESOLVED that the Board of Trustees DENIES WITHOUT PREJUDICE based on no action the application of FLORIANE LAVAUD & THOMAS ANNICQ to construct a 169' catwalk with 9'2"x4' stairs to water level for launching kayak, paddle board, canoe, etc.; and as depicted on the site plan prepared by Christopher Caruso PE, dated May 24, 2019. Cause damage from erosion, turbidity or siltation: In that the terminus of the proposed structure is proposed to be placed on unstable sediments comprised of silts, muds and organic matter in excess of six feet (6.01 deep that exists in a liquified state and that are easily dislodged during construction and with water-flow turbulence of each incoming and outgoing tide flowing around the pilings. With a tidal range limited to less than two and one-half feet (2.51, operation of human powered watercraft during most tidal states will dislodge unstable sediments causing turbidity and siltation. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the below Policy Standards and therefore is INCONSISTENT with the LWRP. 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. § 275-2. Definitions; word usage. defines a catwalk as: CATWALK-An elevated walkway, usually built to gain access to a commercial or residential dock, built at a fixed height above grade and which is constructed landward of the high-water mark. The proposal does not fully meet the definition of a catwalk. The catwalk extends past the high water mark and does not "gain access to a...residential dock". The stairs at the terminus of the catwalk exceeds 1/3 of the waterbody (between 0.0 and 0.0 LW) and does not comply with the intent of Chapter 275-11. Construction and operation standards. C.(2)(b)[21 Within creeks and other narrow waterways, no dock length shall exceed 113 the total width of the water body. Determination of the length of the dock must include the dimensions of the vessel. Further, the applicant has not demonstrated that the following dock standards pursuant to § 275-11. Construction and operation standards have been met. (d) Review and approval of dock applications.
