BE IT FURTHER RESOLVED that the Board of Trustees DENIES WITHOUT PREJUDICE the application of SCOTT COLLETTI to replace in-place approximately 86 linear feet of existing timber bulkhead with new 5" vinyl sheeting bulkhead and to raise the height an additional 12"; install a 10' wide (860sq.ft.) wood walk along the landward edge of the bulkhead; and backfill with ±10 cubic yards of clean upland fill; and as depicted on the site plan prepared by Caruso Engineering LLC, dated April 25, 2019. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, the proposed action is recommended as INCONSISTENT with the below listed policy and the LWRP. 6.3. Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction. 9. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. A Wetland Permit was not located within Town records for the existing, as- built structures. In the event the action is approved, a vegetated buffer is recommended in place of the deck. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
