Moore, Esq. 51020 Main Road Southold, NY 11971 RE: BIM STRASBERG & ALEXANDRA LEWIS 21225 SOUNDVIEW AVENUE, SOUTHOLD SCTM# 1000-135-1-1 Dear Ms. Moore: The following action was taken by the Southold Town Board of Trustees at their Regular Meeting held on Wednesday, August 14, 2019: WHEREAS, Patricia C. Moore, Esq., on behalf of BIM STRASBERG & ALEXANDRA LEWIS applied to the Southold Town Trustees for an Amendment to Wetland Permit #9342 and Coastal Erosion Permit #9342C under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, and Chapter 111 of the Southold Town Code, Coastal Erosion Hazard Areas, application dated July 31, 2019, and WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator recommended that the proposed application be found Inconsistent with the LWRP, and, WHEREAS, the Board of Trustees has furthered Policy 6.3 of the Local Waterfront Revitalization Program to the greatest extent possible through the imposition of the following Best Management Practice requirements: the issuance of a permit, and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on August 14, 2019, at which time all interested persons were given an opportunity to be heard, and, 2 WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that for the mitigating factors and based upon the Best Management Practice.requirement imposed above, the Board of Trustees deems the action to be Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code, and, BE IT FURTHER RESOLVED, that the Board of Trustees APPROVE the Amendment to Wetland Permit #9342 and Coastal Erosion Permit#9342C for bluff construction of equipment access for bulkhead replacement consisting of cutting the bluff perpendicular to the shoreline with the slope not to exceed 1:6 grade; the side slope will be terraced and stabilized; the installation of haybales and silt fencing during construction; upon completion of work, contractor will re-establish natural grade of slope by adding ±200 cubic yards of additional clean fill and restoration of disturbed areas with beach grass planted 12",on center; extend proposed new galvanized steel bulkhead approximately 40' in order to connect to neighbor's bulkhead to the east; with the condition that the 200+/- cubic yards of additional fill have a grain size at least as large as the existing soils on the bluff; and as depicted on the project plan prepared by Patricia Moore, Esq., received on July 31, 2019, and stamped approved on August 14, 2019. I visited the site of 21225 Sound Ave, Southold where the Sound Bluff was completely cut away. That act was an egregious violation of the Town Code and the Environment. The work compromises the subject property and neighboring properties. Board of Trustees records indicate that the contractor was not licensed to do work in the Town at the time of the violation, and it is my opinion that the company should never be licensed in our Town. I believe it fitting to fine the contractor to the maximum extent of the law and to tighten up the licensing of the profession so work like this never occurs again. Thank you. With that retaining wall in place first, contractor will construct the bulkhead (per the approved plans)...the Strasberg bluff will appear in line with the slope of the westerly neighbor's bluff...gradual & planted...... The Concern Chris (contractor raised) is that the "temporary structures" will cost several thousand to install with the risk that it will fail and the property will be further damaged and cost the client even more to restore as it continues to deteriorate. We would respectfully request 5 minutes of the Board's time at their Monday work session- this will enable the Board to get clarification and consensus on protecting the Client's home.
