I have been in contact with the agent for the owner of the project on several occasions and several modifications were made. The most significant change was the terminus of the road adjacent to lot # 1. The road should terminate with a leg that extends into Lot #1 in a Northerly direction for a distance of 50' beyond the right turn to lot #2. A second 50' section of road should be provided in the Easterly direction. These clear areas are required for providing access and turning areas for emergency equipment. These areas should be described in covenants in such a manner that would prevent property owners from creating obstructions that may limit access to these areas. Front yard building setbacks should also be maintained from the areas as described above. The bond estimate submitted by the applicant has been reviewed by my office and revised. They agree that applicants pursuing limited development should have some relief from the high parks fees. As this matter is still under discussion with the Town Attorney, we do not yet know how much relief will be granted. The Planning Board does not see a problem with eliminating the drainage plan, but they are requiring a stone blend road as per the Town Highway Code. They have required roads on all other Soundfront subdivisions. The road is too long to be unimproved. It is not a problem if you want to keep the original proposed setbacks. However, between this and the removal of the drainage plan we would ask for a covenant stating that each lot owner is responsible for preventing runoffonto neighboring properties. This would require drainage control devices only after a problem is identified. The existing bluff deck is not a problem during the subdivision process. Because this project has a significant conservation component, the Peconic Land Trust is requesting that the Planning Board reexamine and provide relief from the following requirements: 1. Park and Playground Fee: The proposed plan provides a undevelopable open space component that is significantly greater than what would be required under a 50% cluster scenario. In the past, this fee has been waived on projects with a significant conservation component (e.g. Thorton Smith and Richmond Creek subdivisions). 2. Road Grading and Drainage Plan: The proposed mad is private and runs adjacent to open farmland. The cost and time associated with engineering this minor roadway is significant. In the past, other minor subdivisions (e.g. Richmond Creek subdivision) have not required this type of documentation. 3. Setback Requirements: We have taken into consideration the comments made concerning the setback requirement for proposed lot number three. The suggested location of the new front yard setback of 60'-0" beyond the zoning line would impede the flexibility of future development for this lot. 4. Existing Bluff Deck: The existing deck structure should not be a concern during the subdivision process. We would ask that the deck issue be addressed when, and if, a building permit is requested for one of the proposed building lots. Approximately 32.27 acres of the 47.4 acre farm, which is located on the north side of Oregon Road, approximately 350' west of the intersection of Alvah's Lane and Oregon Road, in Cutchogue, are proposed for the purchase of a development rights easement. The purchase is pursuant to the provisions of either Chapter 6 or Chapter 25 of the Town Code. The exact area of the development rights easement is to be determined by a town provided survey, acceptable to the LPC prior to the contract closing. The purchase price will be approximately $467,915.00, and is based on a unit price of $14,500.00 (fourteen thousand five hundred dollars) per acre, as supported by an August 1999 appraisal prepared by Given Associates. No new residential structure or sanitary disposal facility shall be constructed or otherwise located xvithin I00 feet of the top of bluff. Within 50 feet of the top of bluff a conservation easemem shall be established wherein there shall not be any grading except that may be necessary to control or remedy erosion or to prevent stormwater from flowing over the edge of the bluff. Clearing and cutting within this area shall be limited to that necessary for proper maintenance and removal of diseased, decayed or dead material and obnoxious plant species. Such clearing and grading shall be subject to review by the Town to insure proper maintenance and preservation of the natural buffer. 4. No stonnwater mnoffresulting from the development and improvement of the subdMsion or an), of its lots shall be discharged down the face of the bluff in any manner. There shall not be an3' individual access structure to the beach fi.om lots 1 or 2. Access to the beach shall be limited to a single structure to serve all residents of the subdivision. The structure shall be designed and constructed in a manner that will result in the least disturbance to the stability of the bluff. 6. The subdivider shall acknowledge in writing to the Planning Board that the creation of this subdivision in no way commits either the Town or the County of Suffolk to any program to ~, 2001 APF:cc UFFOLK COUNTY PLANNING DEPARTMENT Page 2 protect this property from bluffand shoreline erosiou though the construction of engineering or other works. There is concern by the Commission that the creation of flag lots with exceedingly long access "poles" can result in safety problems for residents. In the event of a house fire or other emergency, excessive driveway length may cause the emergency vehicle difficult3, in locating or reaching the residence on the main portion of the parcel, thereby losing precious seconds. Flag lots should not be created where the length of the flag strip is greater than 300 fi. The form of approval of this subdivision should be mindful of the potential to develop the vacant lands to the west. Particularly how it may relate to motor vehicular access and the situating of future d~vellings. The proposed "common driveway" ma3' be located in such a way as to assure close proximity to future dwellings on adjoining parcels. The proposed subdivision will result in the creation of landlocked parcels; lots 2 and 3. A land locked parcel is a parcel that does not have frontage on an existing or proposed public road. The creation of such lots is contrary to good subdivision layout principles and creates problems as far as access by emergency and service equipment is concerned. This lack of access to a public right-of-way could result in health, safety and welfare problems for the future residents of the landlocked lots, in addition to potential disputes over the use and maintenance of any right-of-way over an adjacent parcel that may be created for the purpose of access. Creation of a landlocked lot also places the Zoning Board of Appeals in the awkward position of having to grant a building permit of the lot under Section 280-a of the Town Law as the future owners of the landlocked lot cannot be held responsible for the landlocked nature of their parcel. In order to be mindful of potential development to the west and to address contradictions to Planning Commission guidelines, the common driveway access of 25.10 ft. wide and approximately 3,500 fi. long shall be placed in a right-of-way that can be dedicated to the Town in the future. Said right-of-way shall be designed so when combined with a similar access strip to the west may be converted to a 50 ft. wide public right-of-way that secures through covenants or otherwise guaranteed motor vehicle and pedestrian access. A sale of Development Rights is proposed on one lot for 32.27 acres. Four acres of this lot have been left out of the sale. This area contains a house and farm buildings. Three new residential lots are proposed, ranging hi size fi.om 2.71 to 3.45 acres. Two of these lots are adjacent to Long Island Sound The th[rd lot is immediately haadward of those two. The three lots are curt-early kbrested, part of a forest system that stretches along Long Island Sound. The agricultural portiett of the property is split between a vineyard and field crops. There is a vertical bluffaiong the Sound approximately 65 f~et in height. The bluffon the western portion &the property has collapse& caused by illegal excavations by the neighboring landowaer The slope is mostly bare, and this leads to erosion. The process is natural and not caused in any way by the actions of the landowner. The Town of Southold Trustees have confirmed the location of the top ofbiuffline, but indicated that a coastal erosion line should be added as well. The existing deck on the blur while not appearing to cause any problems, is in violation of the Toxin Code because it has not been approved by the Trustees. This should be addressed before the subdivisinn is approved. The top of bluff line appears to be accurate and ac wetlands were found on the property. However, 1 do have some concern with Lot #3 The southern portion slopes down towards the farmland and is less vegetated than the rest of the land proposed for residential use. Kunofffrom developmant should be prevented from flowing onto the farm proper:y; this can probably be solved in the Covenants and Restrictions. The Planning Board would also like to see a covenant limiting lot clearance. Since the bluff area of neighboring lots is also wooded, substantial cleating would be a visual nuisance and possibly cause runoff problems. I would also propose an increased build/rog setback for the southern side of Lot #3 to decrease nmoffand separate the house from conflicts with farming activity. II~e Planning Board suggests that a 60' setback from the zoning line might be ap pro pdate (see attached map). This would fit w4th the layout of the land. It would leave a building envelope of at least 150' in width, the same as Lot #2 This would be labeled as a side yard setback, to eliminate concerns over accessory structures and other issues. The Town Trustees have reviewed the proposed map and found no problem with the location o£the bluff'line. However, they have made a number ofcommants. The bluff line should be distinct from the topogu'aphical lines~ by either darker shading or different- length dashes. They request that the Coastal Erosion line be added to the map. The existing deck on the bluffis illegal. After the map changes are completed, the applicant should contact the Trustees about keeping or dismantling thc deck. The good physical condition of the deck is a factor itt the approvai process. Road plans should be prepared along with any necessary, drainage for the road.
