It would appear that the proposed reconstruction of the pool and enlargement of the patio will require once again the raising the property on the water side of the residence. The more this section of property is raised the more adverse effect it will have on the neighboring properties. The resident to the easterly side of this new work has already submitted one or more complaints about the stormwater that ponds on his property due to the original construction of the home and pool. The proposed retaining wall shown in the northwesterly corner of the site extends out into the drainage easement of the Town. This retaining wall should be pulled back to the easement line with an extension in the southerly direction to support the proposed patio without encroachment. Drainage calculations should be provided to show all new work and verify the existing size and location of all existing drainage installed with the original construction. Additional information should also be included to show all new drainage calculations, construction section details and grade elevations for Town Review. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated September 14, 2018 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. ' •t LWRP DETERMINATION: This, application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated December 19, 2018. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available it is recommended that the proposed action is CONSISTENT with LWRP policy standards and therefore is CONSISTENT with the LWRP. PROPERTY FACTS/DESCRIPTION: The subject property is located in an R-40 Zoning District along Willow Point Road with frontage on an underwater canal (Budd's Pond), Southold. The property measures 18, 217.38 sq. ft. as shown on survey prepared by Lisa McQuilkin, Land Surveyor, dated May 24, 2017. The property starts out at its southwest corner on Willow Point Road and runs. 148.92 feet to the east where it turns north 127.44 ft. to the Canal, then turns west 110.04 ft. before finally returning south 148.73 ft. to Willow Point Road. The property is improved with a one-story frame house with an attached garage, sunroom, and wood deck areas, an existing accessory in-ground swimming pool in the rear yard and floating docks with metal landings and ramps. BASIS OF APPLICATION: Request for a Variance from Article XXIII, Section 280-124 and the Building Inspector's September 4, 2018,Notice of Disapproval based on an application for a building permit to reconstruct an accessory in-ground swimming pool; at; 1)more than the code permitted maximum lot coverage of 20%;at: 325 Willow Point Road,(Adj. Budd's Pond/CanaI), Southold,NY. SCTM#1000-56-5-26. RELIEF REQUESTED: The applicant requests a Variance to reconstruct an accessory in-ground swimming pool in the rear yard at 22.309%lot coverage which exceeds the code permitted maximum lot coverage of 20%. Page 2,January 17,2019 97235,Donadic SCTM No. 1000-56-5-26 ADDITIONAL INFORMATION: As per testimony and material provided by the applicant's agent, and the applicant, this parcel was granted a variance for lot coverage relief not to exceed 23.6% in Appeal # 4602 dated October 8, 1998. The currentproposal is for an in-kind replacement of the pool due to a failing liner. Additionally a neighbor testified in support of this application. The current proposal shows a lot coverage of only 22.309 %, which is less than the last variance granted in 1998. On March 6,2018,a de minimus request was denied in a letter by the ZBA Chairperson for the reconstruction of a swimming pool in-kind, pursuant to the Building Department's assessment that once a structure is demolished, the certificate of occupancy and any prior variance relief is extinguished, and therefore an area variance for lot coverage relief is required in order to rebuild. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on January 3,2019 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The pool and deck are existing, and this proposal is for an in-kind replacement. Therefore, there will be no change in the character of the neighborhood. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The existing pool and deck on the property already exist with previous lot coverage relief. When the existing pool was demolished through a major storm event, the previous relief granted was extinguished. Therefore, the applicant now requires new relief to proceed with the proposed in-kind pool replacement. 3. Town Law§267-b(3)(b)(3). The variance granted herein is not mathematically substantial, representing 11.5% relief from the code. However, the previous variances granted the applicant 18% relief from the code, thereby, making the current proposal less substantial than previous approvals. 4. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law§267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. The applicant has also received variance relief for this property in the past. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a accessory in-ground swimming pool while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Lehnert, seconded by Member Dantes, and duly carried,to GRANT the variance as applied for, and shown on the drawings provided by Joseph Fischetti,P.E., dated August 22,2018;and the survey prepared by Lisa McQuilkin,Land Surveyor, dated May 24,2017. Page 3,January 17,2019 #7235,Donadic 3CTM No. 1000-56-5-26 SUBJECT TO THE FOLLOWING CONDITIONS: 1. Pool mechanicals shall be placed in a sound deadening enclosure. 2. Drywell for pool de-watering shall be installed. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s)granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving honconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. In the event that this is an approval subject to conditions, the approval shall not be deemed effective until such time that the foregoing conditions are met; and failure to comply therewith will render this approval null and void. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured,and/or a subdivision map has not been filed with the Suffolk County Clerk, within three(3)years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three(3)consecutive one(1)year terms.
