Polyurethane products manufactured or produced from this liquid system may present a serious fire hazard if improperly used or allowed to remain exposed or unprotected The character and magnitude of any such hazard will depend on a broad range of factors, which are controlled and influenced by the manufacturing and production process,by the mode of application or installation and by the function and usage of the particular product Any flammability rating contained in this literature is not intended to reflect hazards presented by this or any other material under actual fire conditions These ratings are used solely to measure and describe the product's response to heat and flame under controlled laboratory conditions. Each person, firm or corporation engaged in the manufacture, production, application, installation or use of any polyurethane product should carefully determine whether there is a potential fire hazard associated with such product in a specific usage, and utilize all appropriate precautionary and safety measures InsulStar° Insulation Fact Sheet R-Values* R-Value Moisture Installation Limitations Limitations with DC 315 Thickness (*Fhrft2/ with a prescriptive Coating on the foam in lieu orches Btu) Vapor Perm Thermal Barrier of a Thermal Barrier 1" 6.8- 1.3 In vertical wall 2" 13'. 0.65 No limit for Thickness max thickness 8Y4' In walls with DC 315 coating 3" 19 0.43 18 wet mils(12 dry mils) 3.5" 22 0.37 Underside of roof.decks 8'/" 52 0.16 No limit to Thickness max thickness10%a" . Read This Before You Buy What you should know about R values The chart shows R value of this insulation. R value means resistance to heat flow. The higher the R value, the greater the insulating power. Compare insulation R values before you buy. There are other factors to consider. The amount of insulation you need depends mainly on the climate you live in. Also, your fuel savings from insulation will depend upon the climate, the type and size of your house;,the amount of insulation already in your house, and your fuel use patterns and family size. If you buy too much insulation,it will cost you more than what you'll save on fuel. To get the marked R-value, it is essential that this insulation be installed properly. 2 InsulStae Application Information STORAGE AND USE OF CHEMICALS: APPLICATION AROUND PLASTIC PIPES: The InsulStar@ chemicals should be between Based on a series of extensive studies, the 65oF and 80°F for proper processing through the InsulStar®system can be applied in contact with spray equipment. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated October 13, 2011 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated October 25, 2011, based upon the recommendation, as well as the records available to us, it is the Board's determination that the proposed bulkhead setback action is CONSISTENT with the LWRP. It is the Board's determination that the proposed single side yard and combined side yard setback action is EXEMPT from Coastal Consistency Review. PROPERTY FACTS/DESCRIPTION: Subject parcel is improved with a one and a half story dwelling, accessory cottage and garage situated on 22,481 sq.ft. It has 70.00 feet of frontage on Peconic Bay Blvd.,345.86 feet on the northern property line, 68.86 feet along the Great Peconic Bay and 338.20 feet on the southern property line as shown on the site plan prepared by Garrett Strang,Architect dated 11-7-11. BASIS OF APPLICATION: Request for Variances from Code Article XXII Section 280-116 and Article XXIII Section 280-124 and the Building Inspector's September 21,2011 Notice of Disapproval based on an application for building permit for demolition and construction of a new single family dwelling at: 1)less than the code required setback of 75 feet from a bulkhead,2)less than the code required single side yard setback of 15 feet,3) less than the code required combined side yard setback of 35. RELIEF REQUESTED: The applicant proposes to construct a new dwelling partially in the locations of the existing dwelling and accessory structures, upon their demolition. The proposed dwelling location will require variances for: 1) a single side yard of 5 feet, where the Code requires 15 feet, 2)a total side yard of 17 feet where the Code requires 35 feet, and 3)a bulkhead set back of 64 feet, where the Code requires 75 feet. AMENDED APPLICATION: During the hearing, the applicant was asked to bring the plan into more conformity with the code. The applicant on November 9, 2011, submitted a plan increasing the western side yard setback to 10' feet and thus increasing the total side yard setback to 22 feet, bringing the plan into more conformity with the code with respect to the side yard and total side yard relief requested. Pane z of 3—November I7,2011 ZBA File#6516-Heidt i CTM:1000-126-11-22 FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on November 3,2011,at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Granting of the requested variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The new dwelling that the applicant proposes to construct in the proposed location is characteristic of the neighborhood and there is no evidence presented indicating that the proposed structure and its location will be a detriment to nearby properties. The proposed bulkhead setback is consistent with the dwellings on either side of the proposed subject dwelling. 2. Town Law 4267-b(3)(b)(2).The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than area variances. The applicant proposes to demolish and remove the existing structures which would permit the applicant to construct a new dwelling at a code conforming bulkhead set back. The width of the parcel is approximately 65 feet which would permit a proposed dwelling having a 30 foot width to be located in a code conforming side yard and total side yard location. 3. Town Law 4267-b(3)(b)(3). The variance granted herein for a 64 foot bulkhead set back, requiring an 11 foot or 15% relaxation of the code required 75 is not mathematically substantial. The adjacent parcels have lesser bulkhead setbacks than what the applicant proposes. The variances granted herein and as amended for a 10 foot side yard setback and a 22 foot total side yard, respectively requiring a 5 foot (33%) and 13 foot(37%) relaxation of the code required 15 feet and 35 feet are both mathematically substantial. However, their substantiality is mitigated when comparing the requested setbacks to the setbacks that which exist on similar parcels in this waterfront neighborhood. 4. Town Law 4267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. In fact, the applicant is proposing to demolish the existing accessory cottage and garage and install a new septic system and drywells to contain storm water runoff on site which will improve the subject parcel. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief for a 64 foot bulkhead setback, a 10 foot side yard and a 22 foot total side yard(as amended)is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new dwelling with the applicants.desired design, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Schneider, seconded by Member Weisman (Chairperson), and duly carried,to DENY,the application as applied for and GRANT ALTERNATIVE RELIEF,as noted below; The minimum side yard setback shall be 10 feet with a combined side yard of 22 feet,as shown on the revised site plan prepared by Garrett Strang,Architect dated 11-7-11. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals.. Page of 3—November 17,2011 ZBA File#6516-Heidt +CPM: 100-126-11-22 Any deviation from the variance given such as extensions,or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use,-setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. The building department has determined that a change in the South and North Elevations requires review by the Board as they deviate from the drawing annexed to the Variance Determination. Specifically;there - ------is-the-addition-of-dog-house dormers-in-the-upperr-part of_the.South-roof,-a-subtle_change-in the South._ _.. facing porch roof, addition of an eyebrow window in the upper part of the North roof and subtle change in _. the-reverse gables-on the North, elevation. All of the above were intended to be architectural details and features added as the final design developed. Please note the mean roof height is still code compliant at 33' and all other aspects of the variance granted remain unaltered. In addition, the.Building Department found that the conventional stair from the second floor to the unfinished storage attic created a third story. It was never the intention of my client to have a finished third story but to only have an easy way to move stored items up to and down from the unfinished attic. To alleviate-the third story issue,my client agrees to delete the conventional stair to the attic and substitute a pull down attic stair. The drawings on file with the building department will be noted accordingly. I am hopeful the Board will determine that these architectural changes are de minimis in nature and will advise the building department accordingly. Your current proposal is not de minimis in nature. The third story windows in the east and west elevations should be removed and the collar ties lowered to a maximum of six feet. The plan should label the area as non-habitable attic storage only. However, if this is not acceptable, you have the option of applying for additional variance relief. Please return to the Building department for further action. Sin erel , i /D'. slie anes Weisman ChairpersonMept. Head Cc: Mike Verity, Southold Town Building Dept. The inspector indicated that there were items that needed to be addressed prior to the issuance of the C of O. He directed me to contact the Building Department in writing to request a six month extension in order to rectify the issues that he cited. Please let me know if there is anything further that I need to do with respect to this request. Thank you for your attention to this matter. TOWN OF SOUTHOLD V Ken Heidt APR "9 2019 17 Crinkle Court Northport, NY 11768 Cell 516-527-4214 TOWN OF 3OUT il' John, Enclosed please find materials provided to me from Anthony Steward from The Green Bubble, the company that handled the insulation at 8530 Peconic Bay Boulevard in Laurel. I explained to him that during our final inspection, the need for a fire retardant on the open cell in the attic was cited. According to Anthony, the open cell in the attic contained a fire retardant when it was applied. I would appreciate it if you could review the materials enclosed and let me know if this meets the requirements. We are also in the process of scheduling the installation of the insulation in the basement ceiling. We have spoken with Mark. Davis, and he'will be taking care of adjusting the door from the garage to the house to be self closing. With respect to the notation regarding the ZBA, please let us know how we proceed. Our architect dealt with all the various departments and boards, but he is no longer available as he moved quite some time ago to Georgia. Thank you for your time, and I look'forward to hearing from you. We have Anthony Steward from The Green Bubble scheduled to come and install the basement ceiling insulation on Monday, May 6th.As the company that installed the insulation, he provided me with the paperwork regarding their product. I want to be sure that I obtain any additional documentation from him that may still be required prior to making the final payment for the insulation work performed. As I mentioned in the cover letter enclosed with the paperwork, please let me know what we need to do with respect to the ZBA notation.
