hereby apply to THE ZONING BOARD OF APPEALS lor 0 SPECIAL EXCEPTION in accordance
with the ZONING ORDINANCE ARTICLES IV and VII SECTION s 408( a) and 70JA,
~ to erect a neon ground sign in front of applicant's ~remises,
1210 feet east of Peconic Lane, Main Road, Peconic, New York, ~n place
of and instead of the present sign,
THE SPECIAL EXCEPTION IS REQUESTED BECAUSE of the requirements of Section
70JA, and because Section 408(a) limits signs in business zones to a
size 6' 611 x 12' 611 with a maximum height not more than 1.5' 611,
Applicant proposes to erect a sign in place and instead of the present-
ly existing sign, substantially in accordance with the annexed drawing.
Applicant further proposes to remove the presently existing sign from
the building. The proposed sign will be located 10' in from the high-
way line; the lower edge will be 10' from the ground, the upper edge
23'; the sign itself will measure B~' x 13' without the arrow, as per
the annexed drawing; the sign will be supported on a steel beam 10' high.
The present sign is 4' x 8'; bottom averages 4' from ground; top
averages 8' from ground; no lighting.

A special exception is requested for the proposed size and height of
the neon sign for the following reasons:
1. The size is required to make the sign reasonably visible in pro-
portion to the proposed height above ground. The proposed height is
essential as hereafter indicated.
2. The present sign constitutes an eye-level traffic hazard, neces-
sitating sudden stops and turns for persons intending to patronize
applicant's establishment and who are proceeding in either direction
on the ~~in Road, a .50 mile per hour state highway, without being
familiar with the location of applicant's premises.
3. The proposed height is required to avoid a substantial and ever-
present danger of breakage to the neon sign by stones thrown up by
passing traffic. Applicant is advised that neen signs on main high-
speed highways sustain breakage averaging between three and ten times
per year from thrown stones.
4. Applicant's large front yard is used by many cars as a turn-around
with concurrent danger to a low level neon sign.
.5. Applicant's large front yard is used as an entrance and exit by
potatoe trucks, fertilizer trucks and other agricultural vehicles

proceeding to and from Gregory and Doyle's ~otatoe House, which is
located directly to the rear of applicant's premises, access to which
is across applicant's front yard. These large commercial and in-
dustrial vehicles in the course of turning to and from the ~~in Road
would, in all likelihood, strike and damage a sign not placed on a
raised pole. The present non-electric sign has been struck many
times by such trucks.
6. Applicant is advised that he will be unable to obtain insurance
at the usual commercial rates on this neon sign unless the sign is
raised at least 8' to 10' above ground level.
The premises in question are of a pre-existing non-conforming business
use in an "A 11 district. Adjacent to and behind applicant's premises
is an in-part business and in-part industrial plant, potatoe warehouse
and farm produce facility operated by Gregory and Doyle Inc.
Approval of the location and size of the sign has been obtained by
applicant from the State Liquor Authority by letter dated October
22, 1959.
