1. STRICT APPLICATION OF THE ORDINANCE would produce UNDUE HARDSHIP because-
The street in question is a 33ft road established ~ny yearsago before the
present highway regulations were adopted.. It is necessary to.have a pubiiCaccessacceSStotO
the waters of ~L~st Creek~ - the property ~ners who do not_ have direct
this creek, and this isthe! logical location forsuch access~. ......
2. The hardship created is UNIQUE and is not shared by oil properties alike in the immediate
vicinity of this p~operty and in this use d,str,ct.because: .... This oarcel to.be dedib~ted to the Town
of ~outhold is directly opposite the end of the public road, where other ~ropertY
would not be so located.
3. The Variance would obse~e the spirit of the Ordinance and' WOULD:. NOT CHANGE THE
CHARACTER OF THE DISTRICT because : T~his is a residential ar~Z; f~6~ng the waters of "~est
Oreek", property on the North ~est side of Grathwohl ~oad is too narrow to meet the
zoning requirements for residences, and ~nv~ property owners now mooring theirnot private
boats along the shoreline of s~ creek. Public access to the creek would
change the charicter of th~s area mu any way.
