The validity of this permit is or may be subject to the approval of other governmental or municipal authorities. The Town accepts no responsibility in applying for or obtaining such approval. In the event that such approval is necessary, the holder of this permit shall not commence operations here- under until such approval has been obtained in writing. The failure to obtain such other approval when required shall subject this permit to immediate revocation by the Town Clerk upon receipt by the Town Clerk of written notice from such other governmental or municipal authorities of its refusal or disapproval. • I.L- The applicant does by the acceptance of this permit, assume all responsibility for operations under- taken pursuant to this permit, and shall take all precautions for the prevention of injuries to persons and property resulting from such operations. By such acceptance, the applicant also agrees to indemni- fy and save harmless the Town, and its officers, agents and employees from any and all claims arising from operations under this permit and any and all acts or omissions of applicant, his agent and employees. The applicant and the owner and occupants of the premises upon which the operations authorized by this permit are being conducted, do, by,the acceptance of this permit, give consent to the Town, and its officers and employees to enter upon the premises where such operations are being conducted to make such inspections as the Town may deem necessary to insure that such operations are being con- ducted in conformity with this permit. This operation will not substantially: A. Adversely affect the wetlands of the town. B. Cause damage from erosion, turbidity or siltation. C. Cause saltwater intrusion into the fresh water resources of the town. D. Adversely affect fish, shellfish or other beneficial marine organisms, aquatic wildlife and vege- tation or the natural habitat thereof. E. Increase the danger of flood and storm-tide damage. F. Adversely affect navigation on tidal waters or the tidal flow of the tidal waters of the town. G. Change the course of any channel or the natural movement or flow of any waters. H. Weaken or undermine the lateral support of other lands in the vicinity. I. Otherwise adversely affect the health, safety and general welfare of the people of the town. Because there has been a response from the Board of Southold Town Trustees and Southold Town Conservation Advisory Council indicating that this project would not have a significant effect to the environment ® Because there has been no response in the allotted time from the New York State Department of Environmental Conservation and the Southold Town Building Department , it is assumed that there are no objections nor comments from those agencies. Is there anyone here who, would• like to speak in behalf of the application of Paul Kelly? MR. ROY;HAJE, President, Enconsultants,. Inc. : The application simply requests permission to replace an existing bulkhead. We have requested that permission be granted-for, construction within' 18 inches of the old structure, while' leaving the old structure, in place. The reason for this 'is 'that if the old structure ,were to be removed it, 'could result in' loss of backfill; which, could, imperil 'the house. The construction technique, therefore, is determined by the proximity to the house and we- request that you apporove it in that fashion. It has already been approved by the New York- State DEC and the, Corps of Engineers as requested. COUNCILMAN STOUTENBURGH: May I ask a question? SUPERVISOR' MURPHY: Sure. COUNCILMAN STOUTENBURGH: If the permission to grant the bulkhead was given only in place, what would be your problem then? MR. HAJE: It would involve removal of the- old structure, and the backfill 'then would be lost. COUNCILMAN STOUTENBURGH: It couldn't be removed part by part? In other words, and then added? An other words, not taking the whole •thing down at one"time? In other words, - I spoke to a'contractor who said that this 'is 'a possibility that it could be done and that way you do not lose all of the, back- fill-' The possibility that we're giving away 18 inches of someone elses property besides the owner's property is 'always a, concern, and this is 'the reason it 'was originally suggested to be in'place. MR. HAJE: Well, to do that would entail 'a significant amount of additional work. COUNCILMAN STOUTENBURGH: Absolutely. That's one of the costs of living on waterfront property. Rambo Dock Building, MR. THOMAS SAMUELS,/Cutchogue: Roy, can I speak"to that point? SUPERVISOR MURPHY: Sure. MR. SAMUELS: We investigated the possibility, after the Trustees suggested that that would be the way to go. Unfortunately there are two problems. Number one, _there isfft any room to place the excavated fill unless it were on the right-of-way adjacent to the property, which isn't owned by the applicant. Number two, you'd' have to bring a, .crane in on that right-of-way, and bucket the fill' and heap it,' remove the bulkhead, build the structure. Anything can be done, but' it 'will'essentially double the cost of the construction and presents problems in' that we're,.not sure that the owners'of the right-of-way would .acquiesce in=our request _to use their 'property as a storage site for the fill. It 'would have to be excavated in'full back at least as far as the tie-rods and in' some areas we'd be within'eight feet of,.the foundation of the house. COUNCILMAN STOUTENBURGH: . Are you. going to excavate to get the tie-rods, the new ones, in? Page 3 - Public 'Heari - Wetland Application Enconsultants, Inc. on behalf of Paul Kelly MR. SAMUELS: Well, you'd have to--no, no, you. jet in'the tie-rods, the jetting procedure, there's no excavation required if 'we can build within' 18 inches. There are practical problems. You're familiar with the area, I know, and the houses are cheek to cheek,' so- to speak. COUNCILMAN STOUTENBURGH: The problem I see is down the road twenty years, from now we put another '1;8• inches out, another twenty years we--the man's got a nice front yard 'and continually keep moving out, when do we stop? When you and I aren't around. MR., SAMUELS: Theoretically I guess that's true. However, we would like to think that a timber structure of the quality that Judge Kelly's making is 35 years, so I'm putting it 'off 70 years. CUUNLILMAN STOUTENBUKGH: I knew I. could count on you. MK. SAMUtLS: Itis a problem throughout the Town, especially where Trustee'* bottom is,'concerned. In this 'particular case it's--it sets a precedent and it's-- it is State bottom that we're concerned with. JIM GRAY, Cutchoque : I was a neighbor of Judge Keily for twenty-some years and I replaced my bulkhead at the same time he replaced his. Now, he . had it 'aone by,'aa non-professional. l had it done by a protessional. My bulkhead, which is 'next door to his, is 'still' standing and looks like it was put in yesterday, so 1 know that if you-re replacing the bulkhead, and it -will be done just like mine, because of a professional, it well last another thirty years, and I was a neighbor twenty years, and that's thirty years ago, and it's thirty years old already, inine:is; and mine looks brand. new. They recommend that the bulkhead be replaced in place. You will note that the application requests permission to install the bulkhead immediately in front of the existing struc- ture (within 18") . Construction of a new structure immediately in front of an existing structure is a standard construction technique and a requirement where loss of backfill resulting from the removal of the old structure would endanger the house. In this instance, the house is extremely near to the bulkhead and could be endangered by removal of the existing bulkhead. Approval of replacement within 18" has been granted by the DEC (copy enclosed) .
