SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated April 15, 2019 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated July 30, 2019. Based upon the information provided on the LWRP Consistency Assessment Form submitted, as well as the records available, it is recommended that the,proposed action is EXEMPT from Coastal Consistency Review. SUFFOLK COUNTY SOIL AND WATER CONSERVATION DISTRICT: This application was referred for an evaluation and recommendation to the Suffolk County Soil and Water Conservation District. According to a report from the agency, received August 5, 2019, an inventory and evaluation was performed on August 2, 2019. The technician reported that the front and rear yard is well vegetated and that the house has an adequate drainage system installed to direct and infiltrate roof runoff. The bluff face was vegetated mostly by non-native plants and there were areas with significant lack of vegetative cover which revealed a path of the surface water runoff traveling down the bluff. There are sections of retaining wall and some check logs down the bluff face that were constructed in an attempt to mitigate erosion and sloughing. These appear to be a short-term solution and a proper retaining system should be designed for this bluff. The toe of the bottom of the bluff was unprotected and absent of any vegetation. Evidence that this bluff has suffered from multiple storm and erosion events suggest it is susceptible to further degradation due to undermining, erosion gullies and lack of vegetation. During construction, it is not recommended that heavy machinery be operated near the slopes and never cross the coastal erosion hazard line. Areas of concern should be clearly flagged out for the construction crew to recognize these areas as unstable. Page 2,August 15,2019 97301,Reed-Schubert SCTM No 1000-21-1-1 3 PROPERTY FACTS/DESCRIPTION: The subject property is a conforming 45,179 square foot waterfront parcel located in an R-40 Zoning District. The parcel measures 173.49 feet along the northerly property line fronting Long Island Sound, measures 337.00 feet along the easterly property line, measures 183.41 feet along the southerly property line adjacent to a right of way, and measures 257.00 feet along the westerly property line. The parcel is improved with a one-story frame house with wood deck and steps and screened porch. There is also a frame cottage and two sets of wood steps going down to the beach. All is shown on a survey prepared by John C. Ehlers, LLS, dated August 26, 2003. BASIS OF APPLICATION: Request for a Variance from Sections 280-116A(1) and the Building Inspector's March 5, 2019 Notice of disapproval based on an application to construct additions and alterations to a single family dwelling at 1) located less than the code required 100 feet from the top of the bluff, located at 815 Rosenburg Road (Adj. to the Long Island Sound)East Marion,NY SCTM No. 1000-21-1-1.3. RELIEF REQUESTED: The applicant requests a variance to extend the existing second floor of the dwelling over an existing first floor of the dwelling that will maintain the dwelling's non-conforming bluff setback of 37.1 feet. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on August 1, 2019 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law &267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood consists of single-family waterfront homes. The subject property is heavily wooded and landscaped and is accessed via a private unimproved road. Therefore, the proposed additions and alterations will not be visible from a public street or from adjacent properties. The existing home has a non-conforming bluff setback. The proposed addition is landward of an existing seaward deck and will largely be within the existing footprint of the dwelling. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The existing home has a non-conforming bluff setback and any additions and alterations will require the benefit of an area variance. 3. Town Law 4267-b(3)(b)(3). The variance(s) granted herein is mathematically substantial, representing 72.9% relief from the code. However, the non-conforming bluff setback is existing and will not be increased by the proposed additions and alterations. 4. Town Law 4267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new second floor addition while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. SUBJECT TO THE FOLLOWING CONDITIONS: 1. Prior to receiving a building permit, the owner(s) of the subject property cited herein must sign a statement acknowledging: a. That the applicant(s) have read this determination and understand the limits of the variance relief granted herein; b. That the applicant(s) will immediately contact the Building Department if a demolition,as defined by Section 280-4 of the Town Code,' occurs during construction,or any construction undertaken in any other way exceeds the scope of the approvals granted herein, or the issued building permit; C. That the applicants are aware that the Zoning Board of Appeals retains jurisdiction until the issuance of the Certificate of Occupancy and has the right,after a public hearing,to modify, suspend or revoke such approvals or any term or condition thereof or to impose thereon one or more new conditions, pursuant to Article XXV, Section 280-141 of the Town Code. 2. Any deviation from the variances) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. In the event that an approval is granted subject to conditions, the approval shall not be deemed effective until the required conditions have been met; and failure to comply therewith will render this approval null and void. Upon arriving at the house,we surveyed the condition of the bluff and the surrounding property to identify the status of the landscape.The house itself sits within 100 feet of the bluff edge. There /sa noticeable slope in the backyard of the property leading up until the edge of the bluff.This is an area of potential concern because surface runoff travels directly over the bluff edge. � 04' The front and rear yard is well vegetated, including the area at the edge of the bluff.Vegetation included ornamental plants,grasses, and non-native species. Our first impression of the bluff was its vertical face. Vertical faces are notoriously unstable and slough often, especially when unvegetated or vegetated with woody and tall shrubs or trees that are subject to wind action. The bluff face was vegetated, mostly with non-native plants, and woody shrubs and trees. There were areas with significant lack of vegetative cover,which revealed a path of surface water runoff traveling down the bluff. There are sections of retaining wall and some check logs down the bluff face that were constructed in an attempt to mitigate erosion and sloughing. You could see the high tide line coming all of the way to the toe. There were multiple areas where undermining has occurred. This results in instability at the toe of the bluff, causing a sloughing event due to the unsupportable weight from the bluff above. Evidence that this bluff has suffered from multiple storm and erosion events suggests it is susceptible to further degradation due to undermining, erosion gullies, and lack of vegetation. It should be noted that the area in which the spot foundations will be installed is an area of lower grade from the rest of the house. This is a potential path for both roof and surface runoff to travel to the bluff edge. Misdirection of runoff could have an impact on the surrounding environment. Any additional structures should have adequate stormwater capture and management. The location for the proposed extension has significant changes in elevation over a short distance, see photos below. In order to add the proposed to the dwelling, land clearing and excavation must occur. Land clearing and excavation are significant land disturbing events even in small areas. It is not recommended that heavy machinery be operated near slopes and never cross the coastal erosion hazard line. Areas of concern should be clearly flagged out for the construction crew to recognize these areas as unstable.
