SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated April 15, 2019 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated July 30, 2019. Based upon the information provided on the LWRP Consistency Assessment Form, as well as the records available it is recommended that the proposed action is INCONSISTENT with LWRP policy standards and therefore is INCONSISTENT with the LWRP. The LWRP report states that a portion of the proposed structure is located in a FEMA VE flood zone and a portion of the proposed structure is in a FEMA AO flood zone. The majority of the property is located in an AO flood zone therefore the structure can be moved out of the VE flood zone but cannot be moved out of the AO flood zone. The LWRP report also recommends installing an Advanced IA/OWTS septic system to mitigate environmental impacts. Moving the proposed structure out of the VE flood zone and installing an IA/OWTS septic system will make the proposed structure CONSISTENT to the LWRP. PROPERTY FACTS/DESCRIPTION: The parcel is a non-conforming 28,719 square foot parcel located in an R- 40 zone. The parcel has 117.58 feet of bulkhead frontage along Hog Neck Bay (AKA Little Peconic Bay). The parcel runs 103.15 feet along Nassau Point Road, 318.98 feet on the South side and 271.90 feet on the North side. The parcel is improved with a one-story frame house, a 2-story frame garage, and a frame shed. All is shown on a survey prepared by Nathan Taft Corwin LLS dated July 13, 2016. BASIS OF APPLICATION: Request for Variance(s) from Sections 280-124 and the building inspector's March 22, 2019 Notice of Disapproval based on an application to demolish an existing dwelling and construct a new single family dwelling at, 1) located less than the code required minimum rear yard setback of 50 feet; located at 1725 Nassau Point Road, (Adj. to Hog Neck Bay) Cutchogue,NY SCTM No. 1000-113-6-13. K Page 2,August 15,2019 #7305, Granato SCTM No. 1000-104-13-2.4 RELIEF REQUESTED: The applicant requests a variance to construct a new single-family dwelling and an attached wood deck and steps at a non-conforming setback of+/- 40.5 feet from the rear yard property line. (The site plan depicts the proposed setback at 40 feet, 8 inches). The required rear yard setback is 50 feet. ADDITIONAL INFORMATION: Part of the proposed structure is located in a VE flood zone and part of the proposed structure is located in an AO flood zone. The existing dwelling is located+/-40.5 feet from the rear yard line. There is a two-car garage on the property which the applicant proposes to demolish. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on August 1, 2019 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-b(3)(b)(1). Grant of the variance will produce an undesirable change in the character of the neighborhood or a detriment to nearby properties The neighborhood consists of single family water front homes. The majority of the homes in the neighborhood are not located in a high velocity flood zone. To the north of the subject property is a public beach. The dwelling immediately to the south of the subject property has a much greater setback from the high water mark and the rear yard than the proposed new subject dwelling; and the applicant's agent did not submit evidence or examples of prior variances for non-conforming rear yard setbacks along Nassau Point Road that would address the non-conforming character of the neighborhood. The granting of alternative relief will make the proposed dwelling more conforming to code, and more conforming to the character of the neighborhood than granting the relief as requested. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant could propose the new dwelling with a code conforming rear yard setback. However, the existing dwelling has a non-conforming rear yard setback and the applicant's agent proposes to raise and re-use the existing foundation for the new dwelling. The alternative relief granted is more conforming to code than the existing dwelling and a portion of the as built foundation can still be used for the new construction. 3. Town Law &267-b(3)(b)(3). The variance for alternative relief for a rear yard setback of 49 feet from the rear yard property line granted herein is not mathematically substantial, representing 2%relief from the code. The majority of the property is located in an AO flood zone and any structure on the property will be located in an AO flood zone. However, the alternative relief for a 49 foot rear yard setback will take the proposed dwelling with deck out of the VE flood zone and place the structure in a less risky AO flood zone. 4 Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and install an Advanced IA OWTS septic system as approved by Suffolk County Department of Health. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel and designed the proposed new dwelling after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law §267-b. Grant of alternative relief for a setback of 49 feet from the rear yard property line,is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new dwelling with deck Page 3,August 15,2019 #7305, Granato SCTM No 1000-104-13-2.4 while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Dantes, seconded by Member Lehnert, and duly carried, to DENY as applied for and GRANT ALTERNATIVE RELIEF as follows: The granting of alternative relief for the setback of the single family dwelling and attached wood deck at 49 feet from the rear yard property line. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The proposed rear yard wood deck shall remain uncovered and unenclosed. 2. The existing 8.3 ft, by 6.3 ft. shed located near the northerly property line shall be removed. 3. The applicant shall submit a site plan/ survey stamped by a design professional showing the proposed dwelling with deck located 49 feet from the rear yard property line. 4. No part of the proposed structure may be located in a VE flood zone. 5. The applicant shall install an Advanced IA/OWTS septic system as approved by the Suffolk County Department of Health. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Before applying for a building permit, the applicant or agent must submit to the Board of Appeals for approval and filing, two sets of the final site plan indicating the setback that conforms to the alternative relief granted herein. The ZBA will forward one set of approved, stamped drawings to the Building Department. Failure to follow this procedure may result in the delay or denial of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals., In the event that this is an approval subject to conditions, the approval shall not be deemed effective until such time that the foregoing conditions are met; and failure to comply therewith will render this approval null and void. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk, within three (3) years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1) year terms. FABRIO GRANATO #7305 S CTM#1000-104-13-2.4. FABRIO GRANATO #7305—Request for a Variance from Article XXIII, Section 280-124 and the Building Inspector's March 22, 2019 Notice of Disapproval based on an application to demolish an existing dwelling and construe a new single family dwelling; at, 1) located less than the code required minimum rear yard setback of 50 feet; located, at 1725 Nassau Point Road, (Adj. to Hog Neck Bay) Cutchogue,NY. SCTM No. 1000-104-13-2.4. The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program(LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the actions are INCONSISTENT with the below denoted Policy Standards and therefore are INCONSISTENT with the LWRP. 4.1 Minimize losses of human life and structures from flooding and erosion hazards. A. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. 3. Move existing development and structures as far away from flooding and erosion hazards as practical. Maintaining existing development and structures in hazard areas may be warranted for: a. structures which functionally require-a location on the coast or in coastal waters. The single family residence does not require a coastal location b. water-dependent uses which cannot avoid exposure to hazards. The single family use is not a water dependent use. d. sites where relocation of an existing structure is not practical. The reduction of the setback does not meet this policy and does not mitigate all risks involved with a major storm. The FEMA flood zone is AO where the structure is proposed to be reconstructed and this creates a situation in where the structure(s) are still at risk from flooding. AO designated areas are: "subject to inundation by 1-percent-annual-chance shallow flooding (usually sheet flow on sloping terrain) where average depths are between one and three feet. Average flood depths derived from detailed hydraulic analyses are shown in this zone. Mandatory flood insurance purchase requirements and floodplain management standards apply. " A portion of the structure (wood deck, steps) is located in the VE flood zone. These areas are: "subject to inundation by the 1 percent-annual-chance flood event with additional hazards due to storm-induced velocity wave action. Base Flood Elevations (BFEs) derived from detailed hydraulic analyses are shown. Mandatory flood insurance purchase requirements and floodplain management standards apply. " The proposed location of the structure in this vulnerable area is highly susceptible to damage and loss over time during times of major storms events including hurricanes. There is ability to relocate the deck and steps to outside of the VE flood zone. Due to parcel characteristics there is no ability to relocate the structure to outside of the AO flood zone (Figure 1). 30< 1725 Nassau Point Road,Cutchogue Show 6eaieP,results for 1725 Nassau Pomt Road,Cutchoque 30, 6' XI M" "',02PCTAP4XPL 001)hiiAR 5,Afil E 4z IUE soup'o Rd Is X, X -MW 4-, /MAE 0 IN '7 'J7 AVis. The demolishing of the existing single family structure is recommended as CONSISTENT. Baldwin Appellant 1725 Nassau Point Road Cutchogue,NY 11935 at a meeting of the Zoning Board of Appeals on December 29, 1980, the appeal was considered and the action indicated below was taken on your ( )Request for variance due to lack of access to property ( )Bequest icer a special exception under the Zoning Ordinance (X) Bequest far a variance to the Zoning Ordinance Art. III, Sec. 100-31 for permission to construct attached garage with an insufficient sideyard setback at 1725 Nassau i Point Road, Cutchogue, NY; more particularly known as Nassau Point Club Properties Lot No. 1 ; County Tax Map Item No. 1000-104-13-2.4. (SEE REVERSE SIDE) I 2. VARIANCE.By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce practical difficulties or unnecessary hardship because (SEE REVERSE SIDE) (b) The hardship created (is) (is not) unique and (would)i (would not) be shared by all properties al&e in the immediate vicinity of this property and in the same use district because (SEE REVERSE SIDE) - (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) (would not) change the character of the district because (SEE REVERSE SIDE) and therefore, it was further determined that the requested variance ( ) be granted ( ) be denied and that the previous decisions of the Building Inspector( ) be confirmed ( ) be reversed. ZONING BOARD OF APPEALS iFORM ZB4 r J ' The findings and determination of the Board are as follows: -750 30has appealed to this Board seeking a variance for per- mission to construct an attached garage in the front-side yard area 'RECEIVED with a setback of two feet from the northerly sideyard line. Exist- ing on the subject premises is a one-story one-family frame dwelling. The premises in question has an area of 29,150+ square feet, approxi- MAR 2a" 2W mately 340 feet deep and an average width of 120 feet. The Board recognizes appellant's need for storage area; however it is the feel- ing of the Board that the project proposed herein is not the most ZONING BOARD OF APPEALS feasible location, thereby not warranting justification for the granting of the within variance. The Board finds that the relief requested in relation to the Code requirements is substantial ; that if the variance is granted as applied for a substantial detriment to adjoining properties will ,be created and that a substantial change will be produced in the character of the neighborhood; and that the interests of justice will not be served by the granting of the relief requested herein. On motion by Mr. Douglass, seconded by Mr. Grigonis, it was RESOLVED, that the application of Wilbur A. Baldwin in Appeal No. 2767 be denied without prejudice as applied for. Damon also affirmed that if any portion of the structure is placed in the VE zone, the entire structure is considered as located in that zone. In measuring the survey, the applicant would need to construct the deck 49 feet (at its closest point) from the rear yard property line in order to stay out of the VE zone. The rear yard setback requirement is 50 feet and they are asking for a setback of 40.5 feet. Hope this is helpful. Let me know if you need further information.
