SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated April 10, 2019 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated July 31, 2019. Based upon the information provided on the LWRP Consistency Assessment Form submitted, as well as the records submitted, it is recommended that the proposed action is EXEMPT from Coastal Consistency Review. PROPERTY FACTS/DESCRIPTION: The subject property is a non-conforming 13, 610 sq. ft. parcel located in an R-40 Residential Zoning District. The property has a frontage of 30 feet on Holbrook Road, where it then runs 332.10 feet south to Mattituck Creek with a creek frontage of 51.79 feet. It then returns 336.81 feet north to the road. The property is improved with an existing one- and one-half story residence, and a one- and one-half story garage all shown of survey prepared by Nathan Taft Corwin, 111, L.S., dated July 6, 2015. The existing residence has a certificate of occupancy dated February 1971; the existing garage has a certificate of occupancy dated June 1975. There is an accessory shed and boardwalk set towards the water that has a certificate of occupancy dated April 1993. BASIS OF APPLICATION: Request for Variances from Article XXIII, Section 280-124 and the Building Inspector's March 15, 2019 Notice of Disapproval based on an application to construct additions and alterations to an existing single family dwelling; at, 1) located less than the code required minimum side yard setback of 10 feet; 2) located less than the code required minimum combined side yard setback of 25 feet located, at 1040 Holbrook Road (Adj. to Howards Branch of Mattituck Creek)Mattituck,NY. SCTM No. 1000-113-6-13. Page 2, August 15,2019 #7306, Cacchioli SCTM No. 1000-113-6-13 RELIEF REQUESTED: The applicant request variances to add a second-floor addition and a rear second floor deck to the existing residence with a side yard setback of 5.2 feet where a 10 feet setback is required and a combined side yard setback of 10.4 feet where a 25 feet setback is required. ADDITIONAL INFORMATION: Testimony was given by the applicant that the proposed additions were just a second-floor addition to add more bedrooms for their children. The proposed rear addition does not require any variance relief. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on August 1, 2019 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law X267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Many homes in this neighborhood have a second story and what is proposed is similar to what exists in the neighborhood. 2. Town Law &267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The as built one and one half story dwelling has a non- conforming side yard and a non-conforming combined side yard. . Therefore, any proposed second story addition and alteration will require variances. The subject parcel is long and narrow, having only 30 feet of road frontage and 52 feet of width at the high-water mark. 3. Town Law &267-b(3)(b)(3). The variances granted herein for a side yard and combined side yard are mathematically substantial, respectively representing 48% and 57% relief from the code. However, this parcel is long and narrow as are the other parcels in this neighborhood having similar non-conforming side yard setbacks. 4. Town Law X267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law &267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law &267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a second story addition while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Lehnert, seconded by Member Planamento, and duly carried, to GRANT the variances as applied for, and shown on the site plan prepared by Mark Schwartz,Architect, and dated March 25, 2019. Prior to receiving a building permit, the owner(s) of the subject property cited herein must sign a statement acknowledging: a. That the applicant(s) have read this determination and understand the limits of the variance relief granted herein; b. That the applicant(s)will immediately contact the Building Department if a demolition,as defined by Section 280-4 of the Town Code,I occurs during construction,or any construction undertaken in any other way exceeds the scope of the approvals granted herein,or the issued building permit; c. That the applicants are aware that the Zoning Board of Appeals retains jurisdiction until the issuance of the Certificate of Occupancy and has the right,after a public hearing,to modify,suspend or revoke such approvals or any term or condition thereof or to impose thereon one or more new conditions, pursuant to Article XXV, Section 280-141 of the Town Code. 2. This action does not authorize or condone any current or future use, setback or other-feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action In the event that an approval is granted subject to conditions, the approval shall not be deemed effective until the required conditions have been met; and failure to comply therewith will render this approval null and void The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree ofnonconformity Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured,and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3)years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1)year terms. Town Law 5267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Many homes in this neighborhood have a second story and what is proposed is similar to what exists in the neighborhood. 2. Town Law 5267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The existing 1-1/2 story dwelling exists in its non- conforming side yard and non-conforming combined side yard locations. Therefore any proposed second story addition and alteration will require variances. The subject parcel is long and narrow, having only 30 feet of road frontage and 52 feet of width at the high water mark. 3. Town Law &267-b(3)(b)(3). The variances granted herein for a side yard and combined side yard are mathematically substantial, respectively representing 48% and 57% relief from the code. However, this parcel is long and narrow as are other parcels in this neighborhood having similar non-conforming side yard setbacks. 4. Town Law 5267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 5267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 5267-b. Grant of the amended relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a second story addition and alteration, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. In your letter you explain that the owners would like to utilize an approved screened in porch addition as conditioned habitable space. At the April 1,2021 Regular Meeting,the members of the Zoning Board of Appeals and I reviewed and discussed determinations No. 7306, dated August 15,2019, in which the applicant was granted relief for less than the code required side yard setback and combined side yard setback in order to add a second-floor addition and a rear second floor deck. The proposed first floor plan shows a porch to be"screened in". The Board has determined,per our long standing practice,that the proposed change of the"screened in"porch to habitable space is not de minimus in nature. Should you wish to pursue an approval for the conditioned habitable living area,you will need variance relief with a new application and a public hearing.
