S®u hold Town Clerk FINDINGS, DELIBERATIONS AND DETERMINATION MEETING OF AUGUST 15, 2019 ZBA FILE: 7307 NAME OF APPLICANT: North Fork Haven, LLC PROPERTY LOCATION: 8871 Oregon Road, Cutchogue,NY SCTM#1000-83-1-34.1 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 thru A 14-25 and the Suffolk County Department of Planning issued its reply dated April 10, 2019 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated July 30, 2019. Based upon the information provided on the LWRP Consistency Assessment Form, as well as records available it is recommended that the proposed action is CONSISTENT with LWRP policy standards and therefore is CONSISTENT with the LWRP. SUFFOLK COUNTY SOIL AND WATER CONSERVATION DISTRICT: This application was referred for an evaluation and recommendation to the Suffolk County Soil and Water Conservation District. According to a report from the agency, dated July 31, 2019, an inventory and evaluation was performed on July 30, 2019. The technician reported that the bluff face directly in back of the property was covered in vegetation and that some species could be identified as non-native. The base of the bluff is lined with large rocks and sections of bulkheading classifying it as a hardened shoreline. There are no apparent signs of erosion at the toe although the northwest corner of the retaining wall lining the base is in disrepair. In comparing the property ridgeline of the bluff with surrounding properties, subject property may have had a more recent erosion event than the rest of the cliff face. Importantly, there is a storm drain located downslope of the backyard of the property which increases the chance of lateral water flow to the bluff face, causing instability and eventually another erosion event. In conclusion, it is believed that the addition of the pergola on the existing patio will have no adverse effects to the physical or environmental conditions. J Page 2,August 15,2019 #7307,North Fork Haven, LLC SCTM No. 1000-83.-1-34.1. PROPERTY FACTS/DESCRIPTION: The subject property, measuring 115, 012 sq. ft. (2.64 acres), is located in a R-80 Zoning District. The westerly property measures 771.93 feet, the northerly property line measures 151.52 feet and is adjacent to the Long Island Sound, the easterly property line measures 747.47 feet then extends 157.17 feet further east to a southerly direction of 27.00 feet meeting the southerly property line measuring of 315.37 feet that leads to the stone and oil roadway ( 25 feet wide right of way) leading to Oregon Road. The property is improved with a single-family one- and one-half story residence with an attached garage, a covered wood deck with a brick patio under the deck attached to the rear portion of the residence. There is also an in-ground swimming pool with a pool house where the proposed pergola would be located, and a tennis court located in the front yard of the property. All as shown on the survey map prepared by Nathan Taft Corwin III, LS, last revised April 1, 2019. BASIS OF APPLICATION: Request for Variance from Article XXII, Section 280-116A(1) and the Building Inspector's February 27, 2019 Notice of Disapproval based on an application to construct and accessory pergola; at, 1) located less than the code required 100 feet from the top of the bluff, located, at 8871 Oregon Road, (Adj. to the Long Island Sound) Cutchogue,NY. SCTM#1000-83-1-34.1. RELIEF REQUESTED: The applicant requests a variance to construct an accessory pergola to be located 85 feet from the top of the bluff instead of the required 100 feet and to be placed upon an existing on grade patio, surrounding an in-ground swimming pool. ADDITIONAL INFORMATION: The applicant submitted a copy of a Board of Town Trustees approval determination dated January 28, 2019 for the construction of a 370 sq. ft. on grade patio adjacent to an existing patio. The document did not mention a proposed pergola. In 2002, (ZBA#5131)the prior owners received Zoning Board variance relief for a 60 ft. by 100 ft.tennis court set back 15.8 feet from the southerly property line and 24 feet from the easterly property line instead of the required 'setback of 60 feet. Pursuant to the condition of the aforementioned approval, on March 29, 2017, the Planning Board approved a lot line modification in order increase the distance of the tennis court to a conforming 60 feet from the front property line. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on August 1, 2019 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law &267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The subject property is accessed by a long private Right Of Way used only by one other waterfront dwelling and is isolated visually from other properties and from Oregon Road. No neighbors have objected to the proposed construction. The pool, patio and pool shed are located in the same area as the proposed pergola, none of which can be seen by the neighboring properties. The proposed pergola is a common accessory to swimming pools on residential properties and the applicant wishes to construct the pergola to provide shade from the sun. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. Due to the sloping topography of the area surrounding the existing swimming pool and the other as built accessory structures there is no other practical location available that would be suitable. The variance granted herein is mathematically substantial, representing 15% relief from the code. However, the pool and pool shed already exist on the property and the proposed pergola will be located in close proximity to other accessory structures. Additionally, the pergola is a small open-roofed structure that is to be used only for shade. 4. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The proposed pergola will be located in the pool area on an existing at grade patio where proper drainage is in place and the applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law X267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law $267-b. Grant of the variance is the minimum action necessary to enable the applicant to enjoy the benefit of a pergola while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Acampora , seconded by Member Lehnert, and duly carried, to GRANT the variance as applied for, and shown on the survey map prepared by Nathan Taft Corwin III, L.S. and last revised April 1, 2019 SUBJECT TO THE FOLLOWING CONDITION: 1. The subject pergola shall not be enclosed with a solid roof or walls. i That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variances) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. In the event that an approval is granted subject to conditions, the approval shall not be deemed effective until the required conditions have been met; and failure to comply therewith will render this approval null and void. The variance in question is granting the homeowner permission to construct an accessory pergola on the property. The proposed location, on the homeowner's back patio, sits 85 feet from the bluff edge at its closest point. Upon arriving at the address, we met the homeowner in the backyard and introduced ourselves.The homeowner did not have access to the stairway leading down the bluff face, so we were granted access through a gate leading to the neighbor's yard. The homeowner's backyard was well vegetated, consisting of a healthy lawn, and a vegetative buffer of thicker plant species including beach grass lining the back fence. The bluff face directly in back of the homeowner's property was covered in vegetation. Some species could be identified as non-native to Long Island, including mile-a-minute weed, wild grape, and mugwort. The base of the bluff is lined with large rocks and sections of bulkheading, classifying it as a hardened shoreline. Because of this, there were no apparent signs of erosion at the toe. AREA VARIANCE REQUESTED: Applicants are requesting a variance under Section 100-33C to Ideate a 60' x 100' tennis court structure in the southerly yard with a setback of 15.8 feet from the southerly property line,24 ft'from the easterly lot line. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on June 20, 2002, at which time written and oral evidence was presented. Based upon all testimony, documentation, personal inspection of the property and the'area, and other evidence, the Zoning Board finds the following facts to be true and relevant. PROPERTY ,DESCRIPTION: Applicants' property is located on a private right-of-way extending from the north side of Oregon Road in Cutchogue. This lot is referred to as Lot 2 in.the Minor Subdivision of Henry Domaleski, and contains an area of 2.05 acres, or 89,350 sq. ft., with a width of 145.75 feet, depth of 604.17 along the east side, and 148.27 ft. along the Long Island Sound. The lot is -improved with a two-story frame dwelling and accessory pool structure as depicted on the February 3, 2000 survey revised June 27,2001 prepared by S.Isaksen,Jr. REASONS FOR BOARD ACTION: In accordance with the review standards set forth in Town Law 267b-3 "area variances," the Board has considered the benefit to the applicant if the variance is granted, as weighed against the detriment to the health, safety and welfare of the neighborhood and community by such grant,and determines that: 1. ,Grant of the area variance will not produce an undesirable change in the character of the neighborhood or detriment to nearby properties. The same family owns the "only" neighboring house. Also in this water front area it is typical to have accessory buildings in the front yard. 2.
