STRICT APPLICATION OF THE ORDINANCE would produce UNDUE HARDSHIP because : There are at present four tanks totaling ~0 thousand gallons of fuel and gasoline buried in the SoutheaSt corner of the premises all of which are within the distance requested for the new installation~-~.-E, to the south of the front Qf.-,the present loading dock. The prope>ty is zoned "C" industrial,having been used for storage yard for many years. The adjoining property to the West ~ L.I.Produce & Ferterlizer Co has a large grading station & Ferterlizer factory which is located 'immediately adjacent to the R.R.r~gn,. of way aproximately the same dz~ance as we request. 2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate vicinity of this p'~opbr-ty an'd[ in this use district because t' We are the only fuel dealer in thio area, ~nd our requirements are vastly different than other businesse~ in the area. 3. The Variance would observe thb spirit ~of'the Orainanc~ an~ WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because ~ This is an e×~sting storage yara of ~¥ ~ears duration~ ~ving been used for building supplies., coal yard, fuel dispensing facilities otc, it is in the heart of the commercial and heavy business district of the village, and has its own rail siding and highway access. The proposed use will not change the charicter of the ne. ighborhood, .or harm any prooerty values in the area. We maintain fire fighti~g-:£ac~iities 6f~o~r eWn~on~th~-pre~ise~, and have hydrant service for other fire protection. The gasoiLne tank vents are of flash proof co_.s~ructzon,~ ~ all construction is of aDn?ov~dma~g~als~ the new tanks are for the storage of fue2 oil and will meet alt safety requirements.
