WITNESSETH,that the party of the first part, in consideration of the sum of One
($1.00) Dollar lawful money of the United States, and other good and valuable
consideration paid by the party of the second part, does hereby remise, release and
quitclaim unto the party of the second part and the heirs, successors and assigns of the
party of the second part forever, all of the right, title and interdst of the party of the first
part in and to:
All of that certain plot, piece or parcel of land with the buildings and improvements
thereon erected, situate, lying and being in Laurel, the Town of Southold, County of
Suffolk and State of New York, and said parcel being more particularly bounded and
described as follows, to wit:
BEGINNING,at a point of the southeasterly side of the Peconic Bay Boulevard,
distant 432.4 feet as measured in a southeasterly direction from the division line between
lands now or formerly of Van Brunt Tandy and Elizabeth Tandy, his wife, and lands now
or formerly of Frederick Russell;
RUNNING THENCE from said point and place of-the beginning along lands
now or formerly of Anna Marie Dogherty and lands now or formerly of McAllister,
South 15 degrees, 10 minutes, 00 seconds East a distance of 535.69 feet to a point and the
mean high water mark of the Great Peconic Bay;
THENCE along a tie line South 26 degrees, 54 minutes, 50 seconds West a
distance of 118.57 feet to a point and the mean high water mark of the Great Peconic
Bay;
THENCE North 15 degrees, 16 minutes, 00 seconds West along lands now or
formerly of Corydon and Sealy a distance of 551.46 feet to a point and the southeasterly
line,of Peconic Bay Boulevard;
THENCE North 32 degrees, 54 minutes, 20 seconds East a distance of 108.10
feet to the point and place of the beginning.
SAID PREMISES known as 4030 Peconic Bay Boulevard, Laurel, Southold,
New York.
TOGETHER with all right, title and interest, if any, of the party of the first part,
in and to any streets and roads abutting the above described premises to the center lines
thereof; TOGETHER with the appurtenances and all the estate and rights of the party of
the part which the party of the first part has or has power to convey or dispose of, in and
to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party
of the second part, and the heirs, successors and/or assigns of the party of the second part
forever.
AND the party of the first part, in compliance with Section 13 of the Lien Law,
covenants that the party of the first part will receive the consideration for this conveyance
and will hold the right to receive such consideration as a trust fund to be applied first for
the purpose of paying the cost of the improvement and will apply the same first to the
payment of the cost of the improvement before using any part of the total of the same for
any other purpose. The word"party" shall be construed as if it read "parties"whenever
the sense of this indenture so requires.
BEING AND INTENDED TO BE the same premises conveyed to the party of
the first part by Quitclaim Deed from Alan E. Fidellow, Judith A. Fidellow, Beth A.
Fidellow and Barbara F. Vercollone by a deed dated December 20, 2009 and recorded on
May 6, 2013 in the Suffolk County Clerk's Office at book D00012728 at page 646 (DT #
12-21805).
IN WITNESS WHEREOF, the party of the first part has hereunto duly executed
this deed on the day and the year first written above.
