SUFFOLK COUNTY SOIL AND WATER CONSERVATION DISTRICT: The application was referred for an evaluation and recommendation. According to the information provided in letter dated August 2, 2016, and following an evaluation conducted on August 2, 2016, it was recommended that any small trees on the bluff face be cut at the base leaving the root system intact, and that the proposed swimming pool and patio be placed as far back from the bluff as reasonably feasible to reduce the potential for retaining wall damage and consequent bluff erosion. Also, in order to prevent degradation of the bluff's integrity and to minimize environmental impacts, the Soil District has recommended that construction be handled with care and done by hand wherever possible. Since excess idling of heavy machinery creates the potential for soil erosion and deposition into the Mattituck Creek, all machinery should be turned off when not being used. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on August 4,2016, at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law $267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The pool will be tucked into a side yard surrounded on two sides by the existing dwelling. The pool will not be visible from Cox Neck Road, and will be well screened from the nearest neighbor by established vegetation. The adjacent home closest to the proposed pool area is situated+150 feet from the pool site in this R-80 neighborhood. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. This property slopes downward toward wetlands and Mattituck Creek, and there is no rear yard area suitable for the placement of a swimming pool. 3. Town Law &267-b(3)(b)(3). The variances granted herein are mathematically substantial, representing 100%relief from the code for the side yard location, and 28%relief for the distance from the top-of the bluff.However,the rear yard consists of steeply declining terrain,sloping towards wetlands and Mattituck Creek, and the relatively flat side yard is the most suitable area for the pool placement. The proposed setback for the pool from the creek is greater than the setback of the existing dwelling thereby mitigating any concerns of the LWRP Coordinator. 4. Town Law $267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. The pool placement will have a greater setback from the creek than the existing dwelling, and will not create a detriment to the top of the bluff and the existing wetlands with the conditions imposed herein. It is my understanding that you asked that the wetland permit be postponed for further information regarding the purported property line discrepance. I had a title search done pulling the deeds for both my client's property (Tax Lot 5) and the southerly Frumkin property(Tax Lot 6), attached are the deeds, and we found the following: In 1935 tax lot 3, 4, 5 and 6 were one parcel owned by Charles E. Hamilton. Tax Lot 5: In 1946 the Estate of Charles E. Hamilton sold lot 5 (my client's lot) to John Kennedy. This deed creates Tax lot 5. The lot description was correctly described as is currently shown on my client's survey. Every transfer since 1946 has correctly described the parcel. My client is the last owner of record with an accurate property line decription. Tax Lot 6: In 1948 the Estate of Charles E. Hamilton sold the adjacent southerly lot (Tax Lot 6) to John & Marie Hoff. The lot description corresponds to the same (correct) common property line description of tax lot 5. In 1965 the Administrator of the Estate of Marie Hoff sells to Mary Gladys Oxley(the lot description is again correct); also in 1965 Oxley sells to Fahnstock (same correct description) In 1971 Oxley and Fahnestock sell to Henry & Elizabeth Alec, the common boundary line description is different (close but not exact). This incorrect description has been repeated in the deeds of the last three Frumkin family transfers to the last deed_ of record of William I. Frumkin. In addition to the above chain of title which identifies the first deed where the southerly neighbor's description is incorrect, I have also researched the Town records and I have found the following: 1. The parcel to the north (now or formerly Sidorowicz) and the parcel to the south (now or formally Frumkin) have had discrepancies in the descriptions appearing on surveys for the last 35 years. The description error on the north caused the northerly neighbor's garage to be built over the property line. The northerly property line was corrected through a court action. The owner Sidorowicz brought an "adverse possession" action against Sievernich (prior owner), appealed, and ultimately the Court issued a new description incorporating the adversely possessed land on the north property line. The adverse possession was due to the construction of a garage over the disputed property line. 2. As to the southerly property line, the Frumkin deed description is wrong. The "dispute" has never been adjudicated. According to the above chains of title the Sbarra property lines are correctly shown on the Sbarra survey since the parcel was first created by deed in 1946. 3. The Sbarra property was the subject of a minor subdivision application in 1997. The former owner, Eleanor Sievernich obtained Zoning Board approval (appeal #4068 dated April 30, 1998) granting area variances for a two lot subdivision. In the variance decision, the Board provided for a possible change to the property lines due to a pending Court action. Nevertheless, the Zoning Board acknowledged that both the northerly and southerly property lines had disputed boundaries. The Zoning Board stated in their decision that a court resolution of the property line disputes would not require re-application. The determination would be adjusted to reflect a final court decision. The subdivision application before the Planning Board was continuously adjourned by the Planning Board pending the court decision. Once the court decision was final (after appeal), the property was in foreclosure and the matter was not returned to the Planning Board's calender for the final approval. The southerly property line, as shown on the last survey by Kenneth M. Woychuk Land Surveying, PLLC and prior surveyors (Young & Young), have been accepted by the Town of Southold for years. Building permits have been issued based on the same survey since 1988 under Building Permit#17626, 1994 under building permit#22001, 1997 under building permit 24190, 2006 under building permit#32043 and finally 2010 under building permit#35627; The wetland application is unaffected by the description of the southerly property line.
