Any other activity within 100' of the wetland boundary requires a permit from this office. This is not an approval from any other agency. The Permittee is required to provide evidence that a copy of this Trustee permit has been recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to the deed of the subject parcel. Such evidence shall be provided within ninety(90)calendar days of issuance of this permit. 9. That the said Board will be notified by the Permittee of the completion of the work authorized. 10. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit,which may be subject to revoke upon failure to obtain same. 11. No right to trespass or interfere with riparian rights. RICH 1470 HOBART ROAD, SOUTHOLD SCTM# 1000-64-3-2.1 Dear Mr. Patanjo: The Board of Town Trustees took the following,action during its regular meeting held on Wednesday, July 17, 2019 regarding the above matter: WHEREAS, Jeffrey Patanjo on behalf of JAMES H. RICH III, LESLIE E. RICH & CRAIG B. RICH applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated December 31, 2018, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator recommended that the proposed application be found Inconsistent with the LWRP, and, WHEREAS, the Board of Trustees has furthered Policy 6.3 of the Local Waterfront Revitalization Program to the greatest extent possible through the imposition of the following Best Management Practice requirements: the issuance of a permit for the structures; and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on June 18, 2019 and July 17, 2019, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, 2 li WHEREAS, the Board has considered all the testimony and documentation submitted concerning this,application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the j Southold Town'bode, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, ; RESOLVED, that for the mitigating factors and based upon the Best Management Practice requirement imposed above, the Board of Trustees deems the action to be Consistent withjthe Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold,'Town Code, and, RESOLVED, that the Board of Trustees APPROVE the application-of JAMES H. Depths for the dock terminus are within Town Trustees, New York State Department of Environmental Conservation and United States'Army Corps. of Engineers guidelines and there is no recognized Federal/New York State/Town navigation channel in the immediate vicinity of the proposed structure. • Scope: The proposed dock is comparable in length to docks on neighboring properties in an area where docks historically are used for commercial and recreational purposes. • Scope in relation to the riparian rights of shellfishers: The plan allows a standard ramp to float design that will not impede access for those seeking shellfish and crustacea in season. • Scope in relation to view sheds: The seaward end of the proposed dock will not extend appreciably beyond existing docks. As such the perspective will not be discernibly different from the existing view. • Environmental upkeep: The dock design projects a usual lifespan of 30 years, with limited pile replacement so as to minimize disturbance of the bottom. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions Wetland Permits for the 120 linear feet of existing bulkhead; 30 linear feet of existing bulkhead return and 22 linear feet of existing groin were not located in Town records. ` The applicant fails to prove that the proposed dock meets the following requirements § 275-11 Construction and operation standards C. 2 (d) of the Southold Town Code: (d) Review and approval of dock applications. Before issuing a permit for a dock structure, the Trustees shall consider whether the dock will have any of the following harmful effects: [2] Whether the dock will unduly interfere with the public use of waterways for swimming, boating, fishing, shellfishing, waterskiing and other water-dependant activities, A net loss in public use of waterways is expected as a result of the construction of such a structure in/on public waterways. (7] Whether the dock will result in the destruction of or prevent the growth of vegetated wetlands, seagrasses including eelgrass (Zosters marina) and widgeon grass (Ruppia maritima) or shellfish; The introduction of a dock structure (piles) will result in a net loss of shellfish habitat. [11] Whether the cumulative impacts of a residential and commercial dock will change the waterway or the ,environment and whether alternate design, construction, and location of the dock will minimize cumulative impacts, and The construction method has not been identified. § 275-11 Construction and operation standards requires that all intertidal construction and excavation employ the installation of a silt boom that will retain all suspended sediments within the immediate project area.
