Samuels, Architect Samuels & Steelman 25235 Main Road Cutchogue, NY 11935 RE: STEVE & MARICA DONADIC 1071 BAY HOME ROAD, SOUTHOLD SCTM# 1000-56-5-37 Dear Mr. Herrmann: The following action was taken by the Southold Town Board of Trustees at their Regular Meeting held on Wednesday, October 28, 2020: WHEREAS, Samuels & Steelman Architects, on behalf of STEVE & MARICA DONADIC applied to the Southold Town Trustees for an Amendment to Wetland Permit#9500 under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated September 22, 2020, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator recommended that the proposed application be found Inconsistent with the LWRP, and, WHEREAS, the Board of Trustees has furthered Policy of the Local Waterfront Revitalization Program to the greatest extent possible through the imposition of the following Best Management Practice requirements: drainage concerns were previously addressed, and _ WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on October 28, 2020, at which time a mferested persons wee given-amoppnrtunity-to-be-heard,— — and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, 2 WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that for the mitigating factors and based upon the Best Management Practice requirement imposed above, the Board of Trustees deems the action to be Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code, and, BE IT FURTHER RESOLVED, that the Board of Trustees APPROVE the Amendment to Wetland Permit#9500 to modify the proposed project to consist of eradicating existing invasive bamboo from site by cutting all bamboo to just above grade and hand excavate all plants and roots within perimeter of property; construct new two-story framed residence on masonry foundation with a footprint of 2,598sq.ft. over flood compliant crawl space, including attached one car garage; construct covered masonry entry terrace of 138sq.ft.; and masonry walkway to grade of 226sq.ft.; .construct new frame deck on waterside of 544sq.1.a of which 280sq.ft. is covered; provide connection to public water supply; provide underground propane tank for fuel; construct concrete retaining.walls along property lines: 60 linear feet along private road'and 65 linear feet along adjacent property to east, for containment of sanitary system per S.C.D.H.S.; install new galley conventional sanitary system per S.C.D.H.S. with required waterproof concrete retaining wall total 174 linear feet; proved "wick hole" under leaching pools area, penetrating clay layer and providing leaching for the sanitary system; provide new coir log reinforced berm 110 feet long by approximately 5 linear feet wide, behind flagged tidal wetlands line, 80 feet long along west property line and 100 linear feet long along east property line, with top of berm at approximately +6' topo; provide 18 linear foot wide non-turf buffer behind berm, planted with approved species; provide 13 underground leaching galleys, 1.5 linear feet high, under new parking area, connected to storm water runoff from roof gutters and grade; construct permeable parking area of 1,943sq.ft. with curbing; place approximately 1,000 cubic yards clean fill on property; install stepping stones on grade from driveway to wetlands border, approximately 100 linear-feet; provide topsoil and landscaping; and as depicted on the site plan prepared Samuels & Steelman, Architects, last dated September 2, 2020, and stamped approved on October 28, 2020 Inspections are required at a fee of$50.00 per inspection. Notice of the planned changes to this property were mailed to me last week, while I was out of State. I have asked Bill Goggins to represent my interests as I am not familiar with this process, the law, the DEC, or topography. I am not looking to be a difficult neighbor and fully appreciate the new owners desire in building a home on their property. However, I do have serious concerns about how the proposed improvements might negatively impact my property. I believe my concerns are very reasonable. Their lot is on very low land and has a large amount of wetlands on it. When there are large storms, this property is where the water from all around it drains. The property also has a large amount of bamboo on it. I'm fully aware of how invasive bamboo is and how much excavation is required to eradicate it (if allowed). My specific concerns are: 1. That changes to drainage not adversely affect our property. 2. That the wetlands are protected, preserved and not damaged. 3. That the removal of the bamboo, if approved, be carefully monitored. 4. That the height of the proposed retaining walls seems excessive and would negatively affect our view and the value of our property. As long as our property is not adversely affected by the plan that is eventually approved, ok to be a cooperative and helpful next door neighbor. SCTM# 1000-56-5-37 The action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, the proposed action is recommended as INCONSISTENT with the below listed LWRP policies. Test hole results indicate that groundwater was encountered 1.8' below the surface. The shallow depth to groundwater poses challenged in the development of the parcel. Policy 1 Foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development. f' 1. The plans call for the excavation of Bamboo that has grown extensively throughout this piece of property Bamboo is an invasive species of plant and the removal of same should be approved. However, I do not recommended over filling the site after the removal of Bamboo. The plans appear to call for anew concrete retaining wall extending seaward that will rise to an elevation of 6' I would recommend that existing grades closer to the wetland boundary be maintained as close to the existing elevations as possible. At this time I would also recommend that the Trustees approve a reasonable dimensional setback from the flagged tidal wetland in an effort to limit the encroachment of concrete retaining walls into the wetland area. To protect this property from storms I would also recommend the use of large rock for the stabilization of the shoreline just landward or the wetland limit. Excavation of this area is already necessary to remove the Bamboo and these larger armor stones could be excavated down and set on filter cloth to stabilize the shoreline without creating a hardened flat surface that could propagate erosion of the shoreline. This plan should be revised to show the limits of proposed concrete retaining walls. In addition they may need to be adjusted to meet any required setbacks that may be established by the Trustees. Contours and/or spot elevations should also be noted to verify existing and final grades of the property to give a better understanding of the proposed work.
