Permit Transfer Permits are transferrable unless specifically prohibited by statute,regulation or another permit condition. Applications for permit transfer should be submitted prior to actual transfer of ownership. r ' NOTIFICATION OF OTHER PERMITTEE OBLIGATIONS Item A: Permittee Accepts Legal Responsibility and Agrees to Indemnification The permittee, excepting state or federal agencies, expressly agrees to indemnify and hold harmless the Department of Environmental Conservation of the State of New York, its representatives,employees, and agents("DEC")for all claims, suits,actions, and damages, to the extent attributable to the permittee's acts or omissions in connection with the permittee's undertaking of activities in connection with, or operation and maintenance of,the facility or facilities authorized by the permit whether in ; compliance or not in compliance with the terms and conditions of the permit. This indemnification does not extend to any claims, suits, actions,or damages to the extent attributable to DEC's own negligent or intentional acts or omissions, or to any claims, suits,or actions naming the DEC and arising under Article 78 of the New York Civil Practice Laws and Rules or any citizen suit or civil rights provision under federal or state laws. The house is constructed, drywells were installed in accordance with the architect's recommendations to capture the roof runoff and storm water from the impervious surfaces. In addition, during the construction of the house, the driveway on the back of the house is compacted and my client has proposed to remove the compacted material and install a pervious driveway that is designed in accordance with the cross-section on the stamped plans. Please review the attached plan and advise the Trustees if this stamped plan is acceptable(please send me a copy of your written comments). Background (if you want to know): The Trustees are reviewing an application for the "as built" relocation of the deck to the' rear yard. In order to persuade the Board that the rear yard attached deck which is 10' above grade will not adversely impact the environment I provided the attached site plan showing as an overlay plan with the previously issued wetland permits: 1' determination in 2003: Pursuant to Chapter 97, in 2003 the Board issued a "letter of no 1 _ L r jurisdiction" to Mazzaferro. The letter of no jurisdiction was based on the Trustee's field inspections and John Ehler's survey dated 2002. In reliance on this letter of no jurisdiction, Mr. Drouzas purchased the property. 2nd determination in 2006: Permit#6386 pursuant to Chapter 97 on June 21, 2006, owner was granted a wetland permit"to construct a single family dwelling with conditions of staked hay bales 25' from freshwater wetland and 100' from salt water wetlands, to designate these areas between the wetlands and any clearing or construction to remain NON-DISTURBANCE BUFFERS, the four corners of the house will be staked and inspected after the building envelope has been cleared, all trees over 8"DBH not in the building envelope will be preserved, a 4' path may be cleared by hand, with no machinery within 100'of the wetlands, to the saltwater wetland edge, drywells to contain roof runoff, and all as depicted on the plan surveyed by John Ehlers and revised and approved by the Trustees 6/12/06. The owner applied to the Building Department for a building permit pursuant to the above permit. Building Permit#328527 dated 3/27/07 was issued. Yd determination in 2008 Permit#6943 the proposed house shown on survey was a larger house than the existing house,the proposed house which was approved by the Trustees,NYSDEC and Building Department was a large 52' x 80'footprint. This house 48.7 feet from the 100' buffer (Tidal Wetland non jurisdiction line). The permit was extended on 7/21/10 and 5/18/11. Thereafter the NYSDEC improperly stopped the progress of the job. The matter was resolved, however, the project was delayed for many months. This permit expired. 4th determination: Permit #7891 (approved 8/22/12) and amended 9/12/14 with plans stamped 9/17/2014. The originally proposed house was made smaller and portico added. The proposed house is 42' x 62'and 58' beyond 100' non-jurisdiction line; 75' from edge of freshwater wetlands. Trustees required a 25' non-disturbance setback from freshwater wetland line. The proposed setback from CR 48 for the smaller house is at 62.1 feet. (See outline of 2014 house on the plan). This plan showed the deck on the side of the house. 5th determination: Thereafter, the owner proposed an "amendment" to move the house away from the road and 25' from the 100' setback and this amendment was denied. Existing House: 6th and Final Permit Request: The house which was constructed with a building permit and permit #7891 (as amended) was again made smaller, and pushed 10' away from wetlands and closer to the road (CR 48) located at 52.5 from CR 48; the house was reduced in size to 42' x 60.3,with an open deck 16.1 x 21.5 elevated 10' above grade was moved from the die to the rear of the house. Because the house, when constructed, was moved 10' closer to the road, the owner believed that the deck was permitted (since that was the previously approved wetland setback). However, the Trustees asked the owner to obtain a new trustee's permit for the house with the deck in the rear yard. The constructed house and constructed deck is set back away from the wetlands more than the 2006 Trustee's permit. The applicant was directed in writing to request an amendment for this minor change, however, the Board changed their request and treated this change as a full permit review with double application fees (as built). Clearly intended to penalize the applicant. The owner failed to keep track of his final approval and mistakenly believed that the deck in the rear yard did not require another permit. This application corrects this misunderstanding. The elevated deck remains out of Tidal Wetland jurisdiction and at @70' from edge of small pocket of freshwater wetlands. The location of the house and deck is shown on the overlay plan. The final house and deck fits substantially within the building envelopes of the previously issued Trustee's permits#7891. Because the constructed house was moved 10' away from the wetlands,prior to construction,and the size of the house was smaller, 10' of the 16' deck falls within permit #7819 and completely within the originally approved permit#6386 reviewed and granted by the NYSDEC & Trustees. Notwithstanding, the horizontal distance to the wetlands,the open deck is elevated 10 feet above grade. The deck sits on posts and the area under and around the deck is a non-turf buffer. The relocation of the deck is a minimal change to the Trustee's 2014 permit and, most importantly, absolutely no impact to the wetlands. The wetlands have continuously been protected by the non-disturbance buffer which has been delineated with a split rail fence(as was requested by the Board). A pervious(gravel),non- turf area around the house further protects the wetlands and provides access to the lower level (below grade garage cut into the foundation). The extra garage door(like windows or doors which are exempt from permits) did not change the footprint. The "walk-out" garage provides access for storage under the house. The drywells have been placed, as required,to conform to the drainage requirements of the Town. The Drywells were professionally designed and approved by the Town Engineer. The applicant requested a small amount of clean fill to complete the grading of the perviousrg avel driveway (which conforms to a typical non-turf area). The temporary crushed stone(RCA) used during construction will be removed and replaced with a permeable grave driveway. A detail of the permeable gravel driveway is on the plans. The plans detail 20 yards of top soil to be placed around the flower beds and trees, 10 yards of fill to grade the driveway and 10 yards of mulch for the flower beds,trees and 4' path. I would respectfully request that the applicant be charged $250 rather than $500. Pursuant to Chapter 97, in 2003 the Board issued a "letter of no jurisdiction" to Mazzaferro. The letter of no jurisdiction was based on the Trustee's field inspections,*d John Ehler's survey dated 2002. In reliance on this letter of no jurisdiction,Mr. Drouzas purchased the property. puCwi fant to and acting on this determination of no jurisdiction, he began to clear his property landward of the 100' setback. The project was stopped despite the Board's issuance of their determiitttl'!'on. Here is the progression of permits which have been issued to construct his personal residence: Pursuant to Chapter 97 on June 21, 2006 was granted a wetland permit "to copzwuct a single family dwelling with conditions of staked hay bales 25' from freshwater wetland and 100' from salt water wetlands, to designate these areas between the wetlands and any clearing or construction to remain NON-DISTURBANCE BUFFERS, the four corners of the hougt!will be staked and inspected after the building envelope has been cleared, all trees over 8"DBH'.not in the building envelope will be preserved, a 4' path may be cleared by hand, with no mactiffieN within 100'of the wetlands, to the saltwater wetland edge, drywells to contain roof runoff, and all as depicted on the plan surveyed by John Ehlers and revised and approved by the Trustees 6/12/06. The proposed house shown on survey was 52' x 80' Permit extended for one year on 7/21/10 and 5/18/11 In 2012 John Ehler's survey was stamped approved with a 52' x 80' house (building envelope);'48`7 feet from the 100' buffer(Tidal Wetland non jurisdiction line). In 2015 originally proposed house was made smaller. The proposed house is 42'x 62'and 58' beyond 100' non jurisdiction line; 75' from edge of freshwater wetlands. Trustees Er uked'` a 25' non-disturbance setback from freshwater wetland line. Proposed Setback from CR 48 is at 62.1 feet In 2018 the house was constructed 10' closer to the-road-(CR 48) at 52.5 from CR 48;the house was again reduced in size to 42' x 60.3, an open deck 16.1 x 21.5 elevated 10' above grade was added. The deck remains out of Tidal wetland jurisdiction and at @70' from edge of small pocket of freshwater wetlands. The required non-disturbance buffer remains and is delineated with a row of shrubs. A pervious(gravel),non-turf area around the house will provide access to the lower level (below grade garage cut into the foundation). This garage(like windows or doors which are exempt from permits) did not change the footprint. The "walk-out" garage provides access for storage under the house. The drywells have been placed,as required,to conform to the drainage requirements of the Town. The Drywells were professionally designed and approved by the Town Engine: The applicant requested a small amount of clean fill to complete the grading of the perviousrg avel driveway(which conforms to a typical non-turf area). To require a full, new permit, at double the fee for this house which has received multiple prior permits for larger homes and fill, as well as a"letter of no jurisdiction" is excessive. One- half of the property is undisturbed, in a community with 8,000 square foot lots, no bulgy` and no vegetation.
