Box 582 Bohemia, NY 11716 RE: MATTHEW STANTON 2725 WELLS AVENUE, SOUTHOLD SCTM# 70-4-16 Dear Mr. Patanjo: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, June 19, 2019 regarding the above matter: WHEREAS, Jeffrey Patanjo, on behalf of MATTHEW STANTON applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance, original application dated April 29, 2019 and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the installation of coir logs be found Consistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, the LWRP Coordinator recommended that the remainder of the proposed action be found Inconsistent with the LWRP, and, / L - WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on June 19, 2019, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the Board has determined that the structure, as applied for does not comply with the standards set forth in Southold Town Code Chapter 275-11(C)(2)(b)(2) — "Within creeks and other narrow waterways, no dock length shall exceed one-third of the total width of the water body. Determination of the length of the dock must include the dimensions of the vessel" and 275-11(C)(2)(c)(1)(b) — `7f any part of a residential dock structure includes a float or floating dock, the float or floating dock portion shall be designed so that, with the exception of the pilings: (ii) No part of the floating dock will contact the bottomland during a normal low tide; and WHEREAS, the Board has determined that the request, as applied for, will have a detrimental effect upon the health, safety and general welfare of the people of the town, and, adversely affect navigation on tidal waters or the tidal flow of the tidal waters of the Town. BE IT FURTHER RESOLVED that the Board of Trustees DENIES WITHOUT PREJUDICE based on no action the application of MATTHEW STANTON for removal of the existing fixed dock, ramp and floating dock and replacement with new 4' wide x 38' long fixed dock - supported with 8" diameter posts and thru-flow decking, 30" wide x 14' long aluminum ramp leading to a 6' wide x 20' long floating dock supported with two 10" diameter piles and un-treated decking in a "L" configuration in approximate location of existing dock. In addition, 30 lineal feet of coir logs to be placed at entrance to fixed pier along shoreline placed in one row being three logs tall as shown on typical section. Area adjacent to logs to be planted with Bearberry or approved native plants acceptable to Town of Southold Trustees; and as depicted on the plan submitted by Jeffrey Patanjo, dated June 13, 2019. SCTM# 1000-70-4-16 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is INCONSISTENT with the Policy Standards and therefore is INCONSISTENT with the LWRP. 6.3 Protect and restore tidal and freshwater wetlands. The applicant has not demonstrated that the following dock standards pursuant to § 275-11. Construction and operation standards have been met. (d) Review and approval of dock applications. Before issuing a permit for a dock structure, the Trustees shall consider whether the dock will have any of the following harmful effects: [1] Whether the dock will impair navigation... in areas of... vessel congestion; Although the dock has received a Wetlands Permit(2109) in 1986, the proposed action extends the dock further into, and exceeds 1/3 of the waterbody. The Board of Trustees placed a condition on the 2004 approval to transfer the Wetlands Permit to the current owner which states: "that a boat will not be moored any further seaward than the dock". The permitted dock in 1986 was approved at 43.30' in total length. ,The new proposed dock is 64' in total length. A vessel moored at the terminus could impede safe navigation of the channel. It is recommended that the original condition be upheld. The installation of coir logs is recommended as CONSISTENT. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
