SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated February 28, 2019 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. RELIEF REQUESTED: (ZBA#7286).The applicant requests variances for additions and alterations to an existing workforce housing building measuring 20 feet by 80 feet with a proposed rear yard setback of 12.3 feet where the Code requires a minimum of 75 feet and with a proposed side yard setback of 19 feet where the Code requires a minimum of 20 feet (ZBA #7287)Additionally, the applicant proposes to convert the existing workforce housing building, which is an accessory to the existing principle business use of potato packing, to a single-family residence, which is not a permitted use because it is considered to be a second principle use on a parcel of land measuring 98,498.58 square feet where the Code requires a minimum of 80,000 square feet per use . The proposed single-family residence will consist of a living room, eat in kitchen, 2 bedrooms and bath and a master bedroom suite with full bath. An existing, attached mechanical room, with no interior access, will remain on the eastside of the exterior of the structure. ADDITIONAL INFORMATION: The Chairperson of the Zoning Board of Appeals opened both hearings, #7286 & #7287, at the same time. The applicant and their agent spoke at length about the history of the parcel and its development in the early 20th Century as a potato grading and packing facility in order to ship potatoes from area growers to New York City and other markets. In 1961, ZBA decision #372 allowed the prior owner to demolish and rebuild an accessory wood-frame building from the 1920's that housed 30 seasonal employees that was used for workforce (labor camp dormitory) housing, and to replace it with the masonry structure which is the subject of this application. When completed the existing workforce housing structure provided modern housing for 24 seasonal employees. In 1996 the current owner acquired the parcel and the potato packaging and shipping business. In 2006 the owners were forced to demolish an existing accessory agricultural building on the subject property that was used for fertilizer storage after it was destroyed by fire. The applicant indicated that while the facility has been historically productive, in recent years, especially since the fire, potato farming in Southold has waned and the facility is under-utilized. In response to the need for income that would allow the business to continue to operate in today's decreased market and to continue to meet the needs of local farmers, the applicant contracts with specialized growers and offers additional services to area farmers including the packaging and shipping of other vegetables. The applicant stated that the packaging season is seasonal, running primarily from late Summer to early Spring with the peak in production around the end of the year annually. When asked by the Board about the existence of school buses parked on the subject premises, the applicants explained that due to the limited availability of potatoes and vegetables to pack and ship, they have been leasing the open area where the agricultural building lost to fire stood, to the Sunrise Bus Company, for parking of school buses servicing the Mattituck-Cutchogue School District during the academic year. The applicant did not realize that the storage of school buses would constitute an additional third use on the property that would also requiring 80,000 square feet of area, and consequently, they offered to cease this use. The applicant indicated that the subject residential structure is in poor condition and requires updating and that they recently upgraded the on-site waste water and septic system. They also indicated that the need for seasonal, shared housing is no longer needed by employees since most now live locally year-round. Subsequently they are proposing to renovate the structure into a single-family residence and offer it for rent to an area family, as a year- round home. The applicant stated they will look into placing the house, if approved, on the Town's affordable housing registry. No member of the public or an immediate neighbor spoke in favor of or against this application. However, a local potato farmer offered personal testimony about the former and current use of the site, the importance of the business to local farmers, the integrity of the applicant/owners and his decades long relationship with them. Page 3, June 20,2019 #7286 &#7287,East End Realty,LLC SCTM No. 1000-96-2-3 FINDINGS OF FACT/REASONS FOR BOARD ACTION RELATIVE TO APPLICATION#7286 The Zoning Board of Appeals held a public hearing on this application on June 6, 2019 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The subject neighborhood consists of single-family dwellings, agricultural land and vineyards, and a church and restaurant along Depot Lane. The existing workforce residential structure was built in its current location in 1961 as an accessory to the existing potato packing business. The applicant proposes to upgrade and improve the existing building both structurally and aesthetically as a single- family dwelling, but they do not propose any major exterior changes or an increase in the existing non-conforming setbacks. 2.Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The masonry structure was built in 1961, replacing an earlier wood-frame structure, in a non-conforming location based upon area variance relief granted under ZBA file #372. While it is possible to relocate the structure to a conforming location on this site, the expense would be prohibitive. Alternatively, the applicant could demolish the existing structure and rebuild it elsewhere on the site; however,that too would be cost prohibitive. 3. Town Law §267-b(3)(b)(3). The variance granted for the rear yard setback is mathematically substantial, representing 83.6%relief from the code, but the variance for the side yard setback is not mathematically substantial representing only 5% relief from the code. However, the structure was built in 1961 with the benefit of ZBA decision#372 and has a valid Certificate of Occupancy. Furthermore, the applicant does not propose any additions or alterations to the already existing footprint or fagade of the structure. 4. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of additions and alterations to an existing residential structure while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. FINDINGS OF FACT/REASONS FOR BOARD ACTION RELATIVE TO APPLICATION#7287 The Zoning Board of Appeals held a public hearing on this application on June 6, 2019 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: Page 4,June 20,2019 #7286&#7287,East End Realty, LLC SCTM No. 1000-96-2-3 1. The subject workforce housing structure, was granted area variance relief for non-conforming setbacks by this Board on May 31, 1961 under ZBA decision #372, to house 24 seasonal employees as an accessory to the potato packing business that has historically existed on the subject property. 2. The subject workforce housing structure has a Certificate of Occupancy#157 "Multiple Residence—Dormitory (Labor Camp) issued August 21, 1961 3. The proposed conversion to a single-family dwelling of the existing workforce housing structure, measuring 20 feet by 80 feet or a total 1,600 square feet of conditioned living space, exceeds the Town Building Department minimum single-family residence size of 850 square feet. 4. The Notice of Disapproval issued by the Town's Building Department on February 22, 2019 states that the proposed single family dwelling in the LB Zone District is not permitted on the subject property because the bulk schedule requires 80,000 square feet per use, the single family dwelling constitutes a second principle use, and the lot contains 98,498.58 square feet 5. Although the applicants addressed the use variance standards in their written application, they also addressed area variance standards at the public hearing. The Board finds that the application does not require a use variance because the use is permitted if a variance from the bulk schedule is granted for two principal uses on a lot with insufficient lot area as follows: 1. Town Law §267-b(3)(b M. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Both a potato packing business and workforce (labor camp/dormitory) housing have legally existed on the subject property since the 1920's. The proposed single-family residence will replace dormitory housing, will be modernized, will be in keeping with other single-family dwellings in the neighborhood and will not be enlarged, or change in location or appearance. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The existing lot size is smaller in square footage than what the code requires for two principle uses. Subsequently the applicant cannot convert the as built accessory workforce housing to a single-family dwelling while maintaining the business use without obtaining variance relief. 3. Town Law §267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 51% relief from the code. However, a single-family dwelling is consistent with other uses along Depot Lane and a business and related housing have existed without adverse impacts on the subject premises for many years 4. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and the on-site waste water and septic system have already been upgraded. 5. Town Law §267-b(3)(b)(5). The difficulty has not been self-created. The applicants are seeking variance relief in order to address a loss of income cause by historic changes in the local agricultural economy. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a single-family dwelling while maintaining an existing business use, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation front the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when ' Section 280-4 of the Town Code defines "Demolition' as any removal of'a structure or portion thereof, where the total cost of the reconstruction of the structure or portion thereof exceeds 50% of the market value of the existing structure before the start of removal. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Considering the reduced work volume,there is no longer a need for labor crew housing, since only part time, seasonal help is utilized,all of whom live locally. These changes had left only a few sensible options for the property owner: One would be to abandon the potato packing operation altogether,as it will keep bringing the continuously diminishing income,which will eventually make the operation impractical,and the land may need to be sold at loss,or: Seek out the additional source of income which will allow it to keep the potato packing business in place.This Zoning application is seeking this solution. 2. The alleged hardship relating to the property is unique and does not apply to the majority of parcels in the same zoning district or neighborhood because: Based on the property history,the hardship is unique and does not apply to the majority of parcels in the same zoning district or neighborhood because this property is the only one on Long Island,which provides the potato packing service to the local farmers and also has the facility to house a labor force as an accessory use.
