Enforcement in the Town of Southold” now, therefore, be it
RESOLVED that the Town Board of the Town of Southold will hold a public hearing on the

aforesaid Local Law at Southold Town Hall, 53095 Main Road, Southold, New York, on the 30
day of July, 2019 at 7:00 p.m. at which time all interested persons will be given an opportunity
to be heard.
The proposed Local Law entitled, “A Local Law in relation to an Amendment to Chapter
280, Zoning, in connection with Administration and Enforcement in the Town of Southold”
which reads as follows:
LOCAL LAW NO. 2019
A Local Law entitled, “A Local Law in relation to an Amendment to Chapter 280, Zoning,
in connection with Administration and Enforcement in the Town of Southold”
BE IT ENACTED by the Town Board of the Town of Southold as follows:
I. Purpose
The Purpose of the amendment is to clarify the Town’s intention to supersede Section 268 of the
Southold Town Meeting Agenda - July 2, 2019

Town Law of the State of New York.
II. Amendment.
The Southold Town Code is hereby amended by removing the struck through words and adding
the underlined words as follows:
§280-155. Penalties for offenses
A. The Town Board of the Southold has determined in order to obtain satisfactory
enforcement and compliance with the law, it is necessary to increase the fines for zoning
violations in excess of the maximums authorized by §268(1) of the Town Law of the
State of New York. It is the intent of the Town Board pursuant to the Municipal Home
Rule Law of the State of New York to supersede the portion of §268(1) of the Town Law
of the State of New York as enacted by Chapter 598 of the Laws of 1985, insofar as to
authorize the Town Board to establish maximum fines for violations of the Building Zone
Ordinance set forth in the said §268 of the Town Law.
A.B. For each offense against any of the provisions of this chapter or any regulations made
pursuant thereto or for failure to comply with a written notice or order of any Building
Inspector within the time fixed for compliance therewith, the owner, occupant, builder,
architect, contractor, or their agents, or any other person who commits, or takes part or
assists in the commission of any such offense or any person, including an owner,
contractor, agent or other person who fails to comply with a written order or notice of any
Building Inspector or Zoning Inspector shall, upon a first conviction thereof, be guilty of
a violation, punishable by a fine not exceeding $5,000 or by imprisonment for a period
not to exceed 15 days, or both. Each day on which such violation shall occur shall
constitute a separate, additional offense. For a second and subsequent conviction within
18 months thereafter, such person shall be guilty of a violation punishable by a fine not
exceeding $10,000 or by imprisonment for a period not to exceed 15 days, or by both
such fine and imprisonment,
B.C. Notwithstanding the foregoing, any violations of §280-13A(6), 280-13B(13), 280-13D,
and 280-111J are hereby declared to be offenses punishable by a fine not less than $1,500
nor more than $8,000 or imprisonment for a period not to exceed six months, or both, for
a conviction of a first offense; for convictions of a second or subsequent offense within
18 months, a fine not less than $3,000 nor more than $15,000 or imprisonment not to
exceed a period of six months, or both. However, for the purpose of conferring
jurisdiction upon courts and judicial officers in general, violations of this chapter shall be
deemed misdemeanors, and, for such purpose only, all provisions of law relating to
misdemeanors shall apply. Each day’s continued violation shall constitute a separate
additional violation. Additionally, in lieu of imposing the fine authorized in this section,
in accordance with Penal Law §80.05(5), the court may sentence the defendant(s) to pay
an amount, fixed by the court, not exceeding double the amount of the rent collected over
the term of occupancy.

III. SEVERABILITY
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any
court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law
as a whole or any part thereof other than the part so decided to be unconstitutional or invalid.
IV. EFFECTIVE DATE
This Local Law shall take effect immediately upon filing with the Secretary of State as provided
by law.

be waived for participants who do not have Southold Town Beach Parking Permits, placards
provided by the Yacht Club should be placed on the vehicle?s dashboard for those participants

at 9:00 A.M. at the Southold Town Meeting Hall, 53095 Main Road, Southold, New York
as the time and place for a public hearing upon the Coastal Erosion Hazard Board of
Review Appeal of Harry and Haykuhi Bashian, which seeks relief from Section 111-6
Definitions and 111-12D Beach Area of the Town Code to replace existing storm-damaged bulk-
heading with new untreated timber navy bulkheading consisting of removing a 14’northwesterly
section, a 61.5’ northerly section and a 4’northeasterly section of existing storm-damaged
bulkheading; replace the existing 41’ westerly section with a new 27.5’ section, a new
62.5’northerly section installed in an angled position, and replace existing 41.5’ section with new
38.5’ easterly section; install 61.5’ of proposed toe-armor consisting of 2-4 ton (minimum
of>18”x18”x18”) stone laid out in a single row with geotextile filter fabric placed underneath
along the seaward edge of new northerly bulkheading; replace existing 10'wide by 36.5’ long
seaward side deck with untreated lumber in same place supported by five (5) 10”x20” pressure
treated timber pilings with the westerly side of the deck to be cantilevered over new bulkhead;
remove two (2) existing storm damaged 12’x36.5’+- side yard decks; remove existing 5.5’ wide
by 61.5’ long section of northerly decking; install approximately 320 cubic yards of clean beach
sand backfill within a +-38x5’x61.5’ area to raise the grade landward of the new bulk heading to
be level with County Road 48; and for the existing 26.4’x36.3’ two-story dwelling; and as
depicted on the site plan prepared by Bulkhead Permits by Gary, Inc., last dated February 14,
2019 within a near shore area in a Coastal Erosion Hazard Area located on property on parcel
SCTM#1000-44-2-15 at 58425 North Road, Greenport, New York and directs the Town Clerk to
publish a notice of such appeal in the Suffolk Times newspaper not less than ten (10) days nor
more than thirty (30) days prior to such hearing and to notify the applicant by first class mail.

A Local Law entitled, “A Local Law in Relation to Amending Chapter 280 Zoning, to Allow
Recreational Uses in the Light Industrial Park/Planned Office Park (LIO) and Light
Industrial (LI) Districts”
BE IT ENACTED by the Town Board of the Town of Southold as follows:
I. PURPOSE.
The purpose of the amendment is to amend Chapter 280 of the Code of the Town of Southold to
allow for minor recreational uses in the Light Industrial Park/Planned Office Park (LIO) and
Light Industrial (LI) Districts.
II. AMENDMENT.
Chapter 280 of the Code of the Town of Southold is hereby amended adding the underlined
portion to read as follows:
§ 280-4 Definitions.
B. Definitions and usages. Unless otherwise expressly stated, the following terms shall, for
the purpose of this chapter, have the meanings as herein defined. Any word or term not
noted below shall be used with a meaning as defined in Webster's Third New
International Dictionary of the English Language, unabridged (or latest edition).
RECREATION FACILITY, MINOR - Fully enclosed indoor recreation facility that
provides soccer, baseball, basketball, tennis, cheerleading, swimming and other
sport activities instruction or education to participants in multiple classes, sessions
or events. Facilities are open to members, participants and guests only. A member,
participant or guest charge may be applied. Recreational uses shall not include
gambling, racing and amusement parks.
§ 280-58 Use regulations.
In the LIO District, no building or premises shall be used and no building or part of a building
shall be erected or altered which is arranged, intended or designed to be used, in whole or in part,
for any purpose except the following:
A. Permitted uses. The following uses are permitted uses and, except for those uses
permitted under Subsection A(1) hereof, are subject to site plan approval by the Planning
Board:
(1) The agricultural operations and accessory uses, including irrigation, the raising of
field and garden crops, vineyard and orchard farming, the maintenance of
nurseries and the seasonal sale of products grown on the premises, the keeping,
breeding, raising and training of horses, domestic animals and fowl, barns, storage
buildings, greenhouses and other related structures to the same extent and subject
to the same conditions allowed in the AC Zone.
(2) Buildings, structures and uses owned or operated by the Town of Southold, school
districts, park districts and fire districts.

(3) Wholesale businesses, private warehousing and public warehousing, and building
material storage and sale, but excluding storage of coal, coke, fuel oil or junk.
(4) Building, electrical and plumbing contractors' businesses or yards.
(5) Cold storage plants, baking and other food processing and packaging plants that
are not offensive, obnoxious or detrimental to neighboring uses by reason of dust,
smoke, vibration, noise, odor or effluent.
(6) Office buildings for businesses, governmental and professional uses, including
administrative training, data processing, publication, financial and sales offices.
(7) Telephone exchanges.
(8) Wineries as regulated by § 280-48A(11).
(9) Tourist camp.
(10) Recreational facilities which meet the following conditions:
(a) Minimum parcel size shall be three acres.
(b) There shall be three acres for each use.
(11) Standard regulation golf course.
(12) Food catering facility.
(13) Machine and equipment workshop.
(14) Boat building, boat servicing and boat storage facilities, excluding retail sales of
boats and accessories.
(15) Light industrial uses, subject to the following conditions:
(a) No such process or operation shall involve the handling, storage or
discharge of explosives or permit upon the premises any virus or other
type of infectious organisms identified with diseases of animals or
humans.
(b) No offensive noises, gases, fumes, smoke, odors, dust, effluent or
vibrations shall emanate from such use and no waste products shall be
discharged therefrom of a character to create a nuisance or to be injurious
to health or to negatively impact groundwater.
(c) Such processes shall involve the use of only oil, gas or electricity for fuel.
(16) Printing and publishing plants.
(17) Land-based aquaculture operations, including research and development, which
meet the following standards:
(a) Any land-based aquaculture operation shall take place in a fully enclosed
structure.
(b) Any land-based aquaculture operation shall be entitled to a retail area not
more than 10% of the gross floor area of the structure in which the
land-based aquaculture takes place for the direct marketing of its products.
(18) Recreational Facility, Minor
§ 280-62 Use regulations.
In the LI District, no building or premises shall be used and no building or part of a building

(10) Repair shop (not including auto and marine).
(11) Custom workshop.
(12) Machine and equipment workshop.
(13) Light industrial uses.

(15) Boat building, servicing and storage, excluding wholesale and retail sales of boats
and accessories.
(16) Land-based aquaculture operations, including research and development, which
meet the following standards:
(a) Any land-based aquaculture operation shall take place in a fully enclosed
structure.
(b) Any land-based aquaculture operation shall be entitled to a retail area not
more than 10% of the gross floor area of the structure in which the

II. SEVERABILITY
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any
court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law
as a whole or any part thereof other than the part so decided to be unconstitutional or invalid.
IV. EFFECTIVE DATE
This Local Law shall take effect immediately upon filing with the Secretary of State as provided
by law.

WHEREAS, the Town of Southold has established a Transfer of Development Rights Program
whereby Sanitary Flow Credits can be transferred into a TDR Bank from open space lands
purchased by the Town of Southold; and
WHEREAS the TDR Bank currently has 17.14 credits on deposit from lands purchased by the
Town of Southold that are located within the Mattituck-Cutchogue School District; and
WHEREAS an application for transfer of Sanitary Flow Credits was filed by Hard Corner
Properties, LLC on May 16, 2019 seeking transfer of 1.6 credits to the property known as
SCTM# 1000-141-4-6.1, 1000-141-4-6.2 and 1000-141-4-6.3 located at 50 Pike Street in
Mattituck, in the Mattituck-Cutchogue school district; and
WHEREAS the applicant seeks to utilize the credits on land designated as Hamlet Business
District (HB) to create affordable homes that will remain affordable in perpetuity, pursuant to
Town Code Sections 100-50 et al, and Chapter 87; and
WHEREAS the applicant seeks to utilize the credits on land within a designated receiving area;
and it is hereby
WHEREAS the Town Board held a public hearing on the action on July 2, 2019, at which time
all persons were given the opportunity to be heard; and
WHEREAS the applicant modified its application and now seeks the transfer of 1.6 credits, to
create a development of 1 affordable home on the aforementioned property; and
WHEREAS the Town Board conducted a coordinated SEQRA review of the action, and issued
a Negative Declaration on July 2, 2019; and it is hereby
RESOLVED that the Town Board has evaluated the effects of the proposed transfer and finds
that the district contains adequate resources, environmental quality and public facilities,
including adequate transportation, water supply, waste disposal and fire protection, and further
finds that that there will be no significant environmentally damaging consequences and that such
development is compatible with the comprehensive planning efforts of the Town, and the Town
Board incorporates the report of the Planning Board dated June 27, 2019 regarding the same; and
it is further
RESOLVED that the Town Board of the Town of Southold hereby transfers one point six (1.6)
sanitary flow credits from the Town TDR Bank and to Hard Corner Properties, LLC for

its proposed development of a single family affordable home for the 50 Pike Street Project
at SCTM# 1000-141-4-6.1, 1000-141-4-6.2 and 1000-141-4-6.3; and it is further
RESOLVED that upon issuance of the Sanitary Flow Credit Certificate, the Town Clerk shall
enter this deduction of one point six (1.6) sanitary flow credits from the Sanitary Flow Credit
Log; and be it further
RESOLVED that the applicant shall receive a Sanitary Flow Credit Certificate, which shall not
be signed by the Supervisor and released by the Town Clerk to the applicant until the covenants
and restrictions required by Town Code Section 87-9 have been filed and such filing has been
approved by the Town Attorney; and be it further
RESOLVED that the Town Clerk shall forward this resolution to the Tax Assessors Office, the
Land Preservation Department, the Special Projects Coordinator and the Planning Department

A. The Town Board hereby formally establishes a Housing Advisory Commission
to review and make recommendations regarding the Town of Southold Housing
Fund. This Commission would supplant the efforts of the former Affordable
Housing Committee that no longer meets as a working group. This Board will
consist of 10 7 residents of the Town who shall serve without compensation. No
member of the Town Board shall serve on the Commission. The Commission
shall reflect a diverse membership, with individuals from various geographic
locations. In addition, membership will include a broad representation from the
community, such as landowners, persons with skill and knowledge about the
environment, real estate, banking, building and farming. The Commission may
also seek members who were/are recipients of housing assistance.
II. SEVERABILITY

called the “Town”), in the County of Suffolk, New York, on behalf of the Southold Solid Waste
Management District, in the Town (herein called the “District”) adopted an Order describing in
general terms a proposed increase and improvement of facilities of the District, consisting of the
acquisition of heavy equipment at the aggregate estimated maximum cost of $850,000, pursuant
to Section 202-b of the Town Law, and said Order stated that the Town Board would meet to
hear all persons interested in said increase and improvement of facilities on July 2, 2019 at 7:00
o’clock P.M. (Prevailing Time) at the Town Hall, 53095 Main Road, Southold, New York; and
WHEREAS, it is expected that approximately 50% of such cost may be
reimbursed by the State of New York and, in such event, the amount of bonds or notes issued
shall be reduced by a like amount; and
WHEREAS, a Notice of such public hearing was duly published and posted
pursuant to the provisions of Article 12 of the Town Law; and
WHEREAS, such public hearing was duly held by the Town Board on July 2,
2019 at 7:00 o’clock P.M. (Prevailing Time) at the Town Hall, 53095 Main Road, Southold,
New York, with considerable discussion on the matter having been had and all persons desiring
to be heard having been heard, including those in favor of and those in opposition to said
increase and improvement of such facilities; and
WHEREAS, the Town Board, as lead agency, has given due consideration to the
impact that the project may have upon the environment and, on the basis of such consideration,
the Town Board, acting as Lead Agency pursuant to the New York State Environmental Quality
Review Act (“SEQRA”) has found and determined that the project is a Type II Action and no
further environmental review is required;

Now, therefore, on the basis of the information given at such hearing, it is hereby
DETERMINED, that it is in the public interest to increase and improve the
facilities of the District by the acquisition of heavy equipment, at the estimated maximum cost of
$850,000; and it is expected that approximately 50% of such cost may be reimbursed by the
State of New York and, in such event, the amount of bonds or notes issued shall be reduced by a
like amount; and that the Town will issue bonds in the principal amount of not to exceed
$850,000 to finance part of the cost of the project; and it is hereby
ORDERED, that the facilities of the District shall be so increased and improved
and that the District, with the assistance of the Town Attorney, shall prepare a proposed contract
for such increase and improvement of facilities of the District, which proposed contract shall be
presented to the Town Board as soon as possible; and it is hereby
FURTHER ORDERED, that the Town Clerk record, or cause to be recorded, a
certified copy of this Resolution and Order After Public Hearing in the office of the Clerk of
Suffolk County within ten (10) days after adoption hereof.

increase and improvement of facilities of the District, consisting of the acquisition of heavy
equipment. The estimated maximum cost thereof, including preliminary costs and costs
incidental thereto and the financing thereof, is $850,000. The plan of financing includes the
expenditure of any grant funds which may be received from the State of New York to pay a part
of said cost, the issuance of bonds in the principal amount of not to exceed $850,000 to finance
the part of said cost not covered by grant funds, and the assessment, levy and collection of
assessments upon the several lots and parcels of land within the District which the Town Board
shall determine and specify to be especially benefited by such increase and improvement, so
much upon and from each as shall be in just proportion to the amount of benefit which the
increase and improvement shall confer upon the same.
Section 2. Bonds of the Town are hereby authorized to be issued in the principal
amount of not to exceed $850,000 pursuant to the provisions of the Local Finance Law,
constituting Chapter 33-a of the Consolidated Laws of the State of New York (herein called the
“Law”), to finance a part of said appropriation.
Section 3. The following additional matters are hereby determined and stated:
(a) The period of probable usefulness of the object or purpose for which said
bonds are authorized to be issued, within the limitations of Section 11.00 a. 28 of the Law, is
fifteen (15) years.
(b) The proceeds of the bonds herein authorized and any bond anticipation notes
issued in anticipation of said bonds may be applied to reimburse the Town for expenditures made
after the effective date of this resolution. The foregoing statement of intent with respect to
reimbursement is made in conformity with Treasury Regulation Section 1.150-2 of the United
States Treasury Department.
(c) The proposed maturity of the bonds authorized by this resolution will exceed
five (5) years.
Section 4. Each of the bonds authorized by this resolution and any bond
anticipation notes issued in anticipation of said bonds shall contain the recital of validity
prescribed by Section 52.00 of the Law and said bonds and any notes issued in anticipation said
bonds shall be general obligations of the Town, payable as to both principal and interest by a
general tax upon all the taxable real property within the Town. The faith and credit of the Town
are hereby irrevocably pledged to the punctual payment of the principal of and interest on said
bonds and any notes issued in anticipation of the sale of said bonds, and provision shall be made
annually in the budget of the Town by appropriation for (a) the amortization and redemption of
the bonds and any notes issued in anticipation thereof to mature in such year and (b) the payment
of interest to be due and payable in such year.

Section 5. Subject to the provisions of this resolution and of the Law and
pursuant to the provisions of Section 21.00 of the Law relative to the authorization of the
issuance of bonds with substantially level or declining annual debt service, Section 30.00 relative
to the authorization of the issuance of bond anticipation notes and Section 50.00 and Sections
56.00 to 60.00 and 168.00 of the Law, the powers and duties of the Town Board relative to
authorizing bond anticipation notes and prescribing the terms, form and contents and as to the
sale and issuance of the bonds herein authorized, and the renewals of said bond anticipation
notes, and relative to executing contracts for credit enhancements and providing for substantially
level or declining annual debt service, are hereby delegated to the Supervisor, the chief fiscal
officer of the Town.
Section 6. The validity of the bonds authorized by this resolution, and of any
notes issued in anticipation of said bonds, may be contested only if:
(a) such obligations are authorized for an object or purpose for which the
Town is not authorized to expend money, or
(b) the provisions of law which should be complied with at the date of the
publication of such resolution, or a summary thereof, are not substantially
complied with, and
an action, suit or proceeding contesting such validity is commenced within twenty days after the
date of such publication, or
(c) such obligations are authorized in violation of the provisions of the
constitution.
Section 7. This resolution shall take effect immediately and the Town Clerk is
hereby authorized and directed to publish the foregoing bond resolution, in summary, in “The
Suffolk Times,” a newspaper having a general circulation in said Town, which newspaper is
hereby designated as the official newspaper of the Town for such publication, together with the
Town Clerk’s statutory notice in the form prescribed by Section 81.00 of the Local Finance Law
of the State of New York.

The resolution, a summary of which is published herewith, has been adopted on July 2, 2019,
and the validity of the obligations authorized by such resolution may be hereafter contested only

the County of Suffolk, New York is not authorized to expend money or if the provisions of law
which should have been complied with as of the date of publication of this notice were not
substantially complied with, and an action, suit or proceeding contesting such validity is
