LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. TOWN OF SOUTHOLD OFFICE OF ENGINEER: This application was referred for an evaluation and recommendation to the Office of the Engineer. In their letter dated January 31, 2019, the Engineer considered the as built deck to be de minimus in nature and determined that no further action be required for compliance with Chapter 236 of the Town Code. PROPERTY FACTS/DESCRIPTION: The property is a non-conforming 1.424-acre parcel located in an R-80 Zoning District. The parcel measures 115.82 feet along the northerly property line fronting Main Bayview Road, and measures 490.00 feet on the easterly property line bordering a 30 ft. private right of way. The parcel then turns to a half circle running 130.00 feet on the southerly property line and measures 321.22 feet on the westerly property line before turning north for 13.28 feet and again running an additional 150.06 feet on the easterly property line. A small portion of the West side of the property borders Koke Drive. The parcel is improved with a two-story frame residence, a frame garage, and an in-ground pool with an attached deck at grade. All is shown on a survey prepared by Angelo Joseph Cecere dated October 16, 2018. BASIS OF APPLICATION: Request for a Variance under Article III, Section 280-15 and the Building Inspector's November 30, 2018 Notice of Disapproval based on an application for a permit to legalize an "as-built" accessory deck surrounding an existing accessory in-ground swimming pool; 1) located in other than the code required rear yard; at: 7630 Main Bayview Road, Southold,NY. SCTM#1000-87-5-16. Page 2,June 20,2019 #7281,Garofalo SCTM No. 1000-87-5-16 RELIEF REQUESTED: The applicant requests a variance to legalize an as-built deck in a non-conforming side yard location where code requires accessory structures be in a code conforming rear yard location. ADDITIONAL INFORMATION: The existing swimming pool has the benefit of ZBA variance #4610, dated October 15, 1998,to locate the accessory swimming pool in a non-conforming front yard area. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on June 6, 2019 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 067-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood consists of single-family homes on large building lots. The subject at grade deck is built around the existing in ground pool which has the benefit of an area variance, and is well screened for privacy from the street 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant could have been achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant could have built a code conforming on grade patio. 3. Town Law &267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 100% relief from the code. However, the property has two front yards and the as-built deck was built in the architectural rear yard where the pool is legally located. 4. Town Law 4267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law &267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an at grade deck around the swimming pool while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Dantes seconded by Member Weisman (Chairperson), and duly carried, to GRANT the variance as applied for, and shown on the survey prepared by Angelo Joseph Cecere, LLS, dated October 16, 2018; and architectural plans prepared by Nigel Robert Williamson Architect, dated November 16, 2018. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. In the event that an approval is granted subject to conditions, the approval shall not be deemed effective until the required conditions have been met; and failure to comply therewith will render this approval null and void. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. The property Site Plan has been prepared by the office of AJC Land Surveying PLLC last dated 10/16/18. This project involves an "as-built" deck that has been constructed at grade around an approved swimming pool. The original ZBA determination#4610 back in 1998 approved the location of the Pool. This determination also went further to require that any decking constructed around the pool must remain open to the sky. It appears that the existing pool deck surround never properly acquired a building permit back when the pool was constructed. At this time the Engineering Department would consider this Deck Surround to be de minimus and no further action would be required for compliance with Chapter 236. ZBA File# RECEIVED AREA VARIANCE REASONS FOR David& Claudia Garo alo: JAN 2 3 2019 (1) An undesirable change will not be produced in the CHARACTER of the neighbofbf fl8ra�jAPtYk%eptpEALS to nearby properties if granted,because: The lot is unique in that the house is located on a corner lot with two front yards and an adjacent parcel (1000-78-7-49) which has merged and the front yard of Main Bayview Road. The combined parcel has three front yards. The house is in the center of the parcel with conforming setbacks but the only rear yard area is not large enough to place the accessory swimming pool and surrounding deck in the rear yard. The subject deck surrounding the pool is at grade. In 1998 the pool received a variance. The Zoning Board concluded that the pool would not produce an undesirable change to the character of the neighborhood or detriment to nearby properties. The Board found that "the pool and deck are screened from Koke Drive, is not close to any neighbor, and is as a practical matter the rear yard".The deck which now surrounds the pool is screened from Koke Drive,is not close to neighbors,and as a practical matter is in the rear yard. (2) The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue,other than an area variance,because: The deck was constructed by the owners when the pool was built and replaced in the last two years. The owner built the original deck,when it was replaced the contractor used trex boards(a more expensive material)and compliant with the building code. The owners were not aware that a stone patio does not require a building permit and therefore no variance. However, the deck is new,is preferred by the owners,and the owner would incur a financial hardship to remove it and replace it with a patio. The deck cost$12,000 and made of durable trex boards for longevity,removal of the deck would cost in labor and material and a new patio at grade in the identical location would not be desired by the owners. Had the owners been clearer to the Zoning Board in 1998 a deck would have been granted. (3) The amount of relief requested is not substantial because: As with the Board's findings in 1998,"in reality as the front yard,and a variance permitting construction of a pool in what is technically another front yard is not substantial". A deck would have been approved had the owner known to request it. In reading the transcript of the hearing in 1998 the Board tried to assist the owners,who were representing themselves,to address the issue of a deck or patio around the pool. It was clear from the minutes that the Board anticipated that the pool would have a surrounding structure such as a deck,however,the owners did not comprehend the issue and that they had to make clear to the Zoning Board what type of surface would be used to surround the pool and a simple diagram of the design of the deck. To the owner,deck and patio at grade were reasonable alternatives,and a decision as to which structure they would construct could be left to a later date. The Board did not realize that to the owner a variance for a deck should have been addressed at the same time as the pool application. In Southold Town the building department distinguishes between a deck on grade and the identically placed patio on grade. The "on grade" deck requires a variance but an "on grade" patio does not require a building permit or a variance. This is unique to Southold Town. Most homeowners are not aware of this distinction. (4) The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because:The deck is at grade and located well away from the property line. The deck will not result in storm water running beyond the property line. The deck around the pool is needed to keep the pool clean and provide a walkable surface. The size of the deck is reasonable. Less than 4feet on two sides for walking access around the pool and 8 feet and 9'81/2 feet on the east and south side as sitting areas.
