SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated February 4, 2019 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is a 10, 861 sq. ft. corner parcel, located in an HB Zoning District. The parcel has a road frontage of 76. 26 feet along Main Street, then another road frontage of 151.2 feet along First Street, then runs north 50.7 ft,then east for 25.75 feet before returning 125.57 feet east to Main Street. There is an existing 2,081 sq. ft. one story dwelling on the property with a rear deck as shown on the survey prepared by John T. Metzger, LS, undated and stamped received on January 16, 2019. BASIS OF APPLICATION: Request for a Use Variance under Article III, Section 280-13C; Article X, Section 280-45C and the Building Inspector's December 4, 2018 Notice of Disapproval based on an application for a permit to relocate an existing single family dwelling and convert a portion of the dwelling into an accessory building (art studio); 1) proposed art studio in the accessory building is not a permitted accessory use; at: 17250 Main Street,New Suffolk,NY. SCTM#1000-117-9-30. RELIEF REQUESTED: The applicant requests a use variance to create an "artist studio", by converting a portion of a single-family dwelling into a detached accessory structure, which is not a permitted use in an HB zoning district. ADDITIONAL INFORMATION: As per testimony given by the applicant's agent, the building currently sits at six (6) feet above sea level and FEMA requires the building to be raised to meet their minimum elevation flood zone (AE EL 6) requirements. The proposal also includes a new sanitary system to address the water level of the site in order to bring it into compliance with the latest Suffolk County Department of Health Page 2, June 20,2019 #7280, Victoria SCTM No. 1000-117-9-30 Services sanitary standards. As per testimony by the agent and owner, the original building was used as a restaurant with a one family dwelling attached to it, as per Certificate of Occupancy#Z269, dated April 16, 1959. In December of 2001, a certificate of occupancy was granted, Z-28109, for an addition, alteration, and deck addition to an existing single-family dwelling. In September of 2003, another certificate of occupancy, Z- 29704, was issued for new windows and the installation of a new gas boiler in the existing dwelling. One of the neighbors spoke at the hearing about concerns with the drainage at the current site, but asserted that he liked the proposed project, since it addresses the drainage issues. Associated with this application is another pending application, ZBA#7278 for area variance relief for an accessory structure in a non-conforming front yard where code requires a rear yard location FINDINGS OF FACT/REASONS FOR BOARD ACTION: USE VARIANCE The Zoning Board of Appeals held a public hearing on this application on June 5, 2019, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: Based upon the following use variance standards,the Board finds that the applicant and his agent failed to sufficiently make the case to the Board's satisfaction for the granting of a use variance, both through written submissions and oral argument at the hearing, 1. Town Law§267-b(2)(b)(1). The applicant cannot realize a reasonable return for each and every permitted use under the zoning regulations for the particular district where the property is located, as demonstrated by the submittal of competent evidence 2. Town Law 12267-b(2)(b)(2).The hardship is unique to the subject property 3. Town Law X267-b(2)(b)(3). The requested use variance, if granted, will not alter the essential character of the neighborhood 4. Town Law§267-b(2)(b)(4). The alleged hardship has not been self-created 5. Town Law X267-b. Grant of a use variance is the minimum action necessary and adequate to address the unnecessary hardship and at the same time preserve and protect the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Lehnert, seconded by Member Planamento, and duly carried, to DENY the use variance as applied for and shown on the survey prepared by Peconic Surveyors PC, last updated dated October 3, 2018. Vote of the Board: Ayes: Members Weisman (Chairperson), Dantes,Planamento,Acampora and Lehnert. (5-0) Page 3,June 20,2019 #7280, Victoria SCTM No. 1000-117-9-30 FINDINGS OF FACT/REASONS FOR BOARD ACTION: OVERTURN THE NOTICE OF DISAPROVAL The Zoning Board of Appeals held a public hearing on this application on June 5, 2019, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. The owner testified and submitted brochures and a professional resume that he is an art educator at the university level and an artist craftsman who is currently using the west wing of his dwelling, (which was formerly a restaurant on the subject property), as a woodworking and mixed media workshop in which he fabricates commissioned art work and other pieces for exhibitions in an offsite artist's gallery where his work is represented and sold. Personal inspections of the premises by the Members of the Board of Appeals confirmed that the workshop contains numerous wood working tools. 2. There are currently no exhibitions or retail sales open to the public on the subject premises and no future plans for such uses. 3. Pursuant to Section 280-45, A 12 and 15, Artist's and Craftsmen's workshops and Custom workshops are permitted uses in an HB zone district. 4. The east section of the subject structure is used as a dwelling and is currently attached to the west wing by a deck and trellis. The existing artist's workshop portion of the subject structure will remain in place and will become an accessory to the existing dwelling portion of the subject structure, which is to be relocated on the subject lot in order to be elevated to FEMA compliant flood zone standards 5. The proposed detached accessory workshop will not become an accessory garage, as noted on the Notice of Disapproval issued by the Building Department. 6. The survey submitted to the Building Department and this Board mislabeled the proposed accessory structure as a one-story framed studio. 7. Both portions of the structure will remain largely the same and the proposed relocated dwelling portion will only be enlarged by 236 sq. ft. for utilities per FEMA requirements. Moreover, in an HB zone district, the proposed detached accessory workshop is an ordinary and customary accessory use to a single-family dwelling. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Lehnert, seconded by Member Planamento, and duly carried, to OVERTURN THE NOTICE OF DISSAPROVAL dated December 4, 2018 which wrongly states that the accessory use is an"Art Studio" in an accessory garage, where the Board finds that the proposed alterations will result in an accessory "Custom Workshop/Artist's and Craftsmen's workshop" which is a permitted use in the HB zone district. Vote of the Board: Ayes: Members Weisman (Chairperson), Dantes, Planamento, Acampora and Lehnert. (5-0) Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code.
