SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated February 4, 2019 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is a 10,861 sq. ft. corner lot, located in a Hamlet Business (HB) Zoning District. The property has a road frontage of 76.26 ft. along Main Street, then another road frontage of 151.2 ft. along First Street, it then runs north 50.7 ft., then east for 25.75 ft. before returning 125.57 ft. east to Main Street. There is an existing 2,081 sq. ft. one story dwelling on the property with a rear deck. BASIS OF APPLICATION: Request for a Variance under Article III, Section 280-15 and the Building Inspector's December 4, 2018 Notice of Disapproval based on an application for a permit to relocate an existing single family dwelling and convert a portion of the dwelling into an accessory building (art studio), at; 1) accessory building located in other than the code required rear yard; at: 17250 Main Sheet, New Suffolk,NY. SCTM# 1000-117-9-30. RELIEF REQUESTED: The applicant proposes to relocate an existing single-family dwelling and requests a variance to convert a portion of said dwelling into an accessory building to be located in the front yard on the subject lot which has two front yards. Page 2, June 20,2019 #7278,Victoria SCTM No. 1000-117-9-30 ADDITIONAL INFORMATION: As per testimony given by the applicant's agent, the building currently sits at 6 feet above sea level. FEMA requires that the building be raised to meet their flood code requirements. The proposal also includes a new sanitary system to address the low water level of the site in order to bring it into compliance with the latest Suffolk County Department of Health Services sanitary standards. As per testimony by the agent and owner, the original building was used as a restaurant with a one family dwelling attached to it, as per Certificate of Occupancy # Z269, dated April 16, 1959. In December of 2001, a certificate of occupancy was granted, Z-28109, for an addition, alteration, and deck addition to an existing single-family dwelling. In September of 2003, another certificate of occupancy, Z- 29704, was issued for new windows and the installation of a new gas boiler in the existing dwelling. The owner/applicant testified that he uses the space as an artist's workshop in which he produces art pieces that are both commissioned and that he sells to and exhibits in various offsite galleries, adding that the structure is not proposed to be a garage as was noted on the Notice of Disapproval issued by the Building Department. He further testified that there are no retail sales or exhibitions that are open to the public on the premises, and that there are no future plans for such uses. One of the neighbors'spoke at the hearing about concerns with the drainage at the current site, but asserted that he liked the proposed project, since it addresses the drainage issues. Associated with this application is another pending application, ZBA#7280 for a use variance for an artists' studio in an accessory garage which is not a permitted use. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on June 5,2019 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The subject property is a corner lot with two front yards. The area along and near First Street contains restaurants, a public beach, a post office and retails shops; while Main Street contains predominantly single-family dwellings. The area is prone to flooding. The subject structure has existed on the subject property in its current location since 1959 and the westerly wing was, at that time, used as a restaurant. The building in its current configuration contains an artist's workshop in the westerly portion, that is attached to an as built dwelling in the easterly portion, by a deck and trellis. Both portions of the structure will remain largely the same and the proposed relocated dwelling portion will only be enlarged by 236 sq. ft. for utilities per FEMA requirements. Moreover, in an HB zone, the proposed detached accessory workshop is an ordinary and customary accessory use to a single-family dwelling 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. Flooding on the subject property has increased over the years, making it necessary to protect the dwelling by re-locating it on the property on to a new FEMA compliant elevated foundation. In detaching the workshop portion of the structure and leaving it in place, the workshop will become an accessory building in the non-conforming front yard location. Given the burden of two front yards, and the shape of the lot itself, there is no way to relocate the dwelling portion of the structure on the property that does not leave the now detached accessory workshop in a non-conforming front yard. Page 3,June 20,2019 #7278, Victoria SCTM No. 1000-117-9-30 3. Town Law §267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 100% relief from the code. However, although the Notice of Disapproval cites an accessory garage in a non-conforming front yard where the code requires a rear yard location, there is currently no attached or detached garage on the subject property, and none is proposed. In addition, personal inspections by Members of the Board and written and oral testimony by the owner and his agent confirms that the proposed accessory in the front yard is an artist's workshop; and pursuant to Section 280-45, A 12 and 15, Artist's and Craftsmen's workshops and Custom workshops are permitted uses in an HB zone district. Finally, although the proposed workshop has existed in its current location for many years, and is proposed to remain there, it is only because the property floods that the applicant is proposing to detach and make FEMA compliant the dwelling portion of the structure, which will then technically change the existing workshop into an accessory structure in a non-conforming front yard, even though no changes are proposed to the workshop itself. 4. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and the conditions of the Zoning Board of Appeals listed below. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the property as a restaurant and attached residence Although it is more costly to do so, the applicant could have chosen to leave the entire structure in place and elevate both attached wings on a FEMA compliant foundation 6. Town Law X267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an accessory artist's workshop in a front yard, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Lehnert, seconded by Member Acampora, and duly carried, to GRANT the relief as applied for and shown on the survey prepared by Peconic Surveyors PC, last updated dated October 3, 2018, and the architectural drawings by Joseph Fischetti, P.E. stamped and labeled as Sheet No: A-1 through A-7 and dated July 25, 2018. SUBJECT TO THE FOLLOWING CONDITIONS: 1. Prior to receiving a building permit,the owner(s) of the subject property cited herein must sign a statement acknowledging: a. That the applicant(s) have read this determination and understand the limits of the variance relief granted herein; b. That the applicant(s)will immediately contact the Building Department if a demolition,as defined by Section 280-4 of the Town Code,1 occurs during construction,or any construction 1 Section 280-4 of the Town Code defines "Demolition" as any removal of a structure or portion thereof, where the total cost of the reconstruction of the structure or portion thereof exceeds 50% of the market value of the existing structure before the start of removal. That the applicants are aware that the Zoning Board of Appeals retains jurisdiction until the issuance of the Certificate of Occupancy and has the right, after a public hearing,to modify, suspend or revoke such approvals or any term or condition thereof or to impose thereon one or more new conditions, pursuant to Article XXV, Section 280-141 of the Town Code. 2. The owner must receive approval from the Suffolk County Dept. of Health Services for an upgraded sanitary system shown on the survey by Peconic Surveyors PC, dated October 3, 2018. 3. Retail sales or exhibitions open to the public are not permitted in the subject craftsman's/artist's workshop 4. This approval shall not be deemed effective until the required conditions have been met; and failure to comply therewith will render this approval null and void That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk, within three (3) years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1)year terms. Using a light bulb,just as Ibn al-Haytham had used lamps,he projected light through a transparent object and onto a wall in a piece called bottle-pour(1971).This was better,but solved only half of the problem because it still required a darkened room.In order to resolve the second limitation,he reversed the process again and developed the technique he now employs with his wall-pieces,projecting the image of a small found or fabricated object onto a transparent screen using multiple light sources'and mirrors within one self-contained box(Cutter,2009). As in a nineteenth-century camera obscura,the result is an image that appears with the same level of clarity as the original object,and is reverted to right-side up using mirrors.For viewers accustomed to film or digital images,the projected objects appear strikingly hyper-real.This effect was augmented further in another series of work by Victoria's employment of brine shrimp in large-scale installations,which created the illusion of a storefront filled with humming,seemingly alien life forms(Honey,I'm Home,1996).All of Victoria's work requires the viewer to question their relationship to images:how we perceive altered scale,discern reproduction from reflection,and rely on our sense of vision to orient ourselves both physically and emotionally in an environment crowded with images and objects. I had the opportunity to discuss Ted's work with him in his SoHo apartment and studio.He splits his time between SoHo and the North Fork of Long Island where he grew up.The apartment area is utilitarian and spare.It's the space of an organized,focused individual. We began our conversation at the island in the galley kitchen,moved through a hallway featuring his latest wall pieces,and ended up in the workspace where a classical station played music throughout my visit.In person Ted is solicitous and thoughtful,and not prone to over- intellectualizing his work—a craft-driven artist,who understands the value and the limitations of speaking and writing about art.
