Proposed drainage plans can be submitted along with the building permit application when and if the ZBA approves the garage addition. The as-built improvements should also be required to comply with Chapter 236. A shallow drainage field should be designed to accommodate the runoff from the arbor and this new drainage design should be proposed in a manner that will take any and all backwash from the swimming pool. The proposed addition on this conforming 212,810 square foot lot(105,926 square foot upland) in the Agricultural-Conservation District, is not permitted pursuant to Article III, Section 280-15, which states; "in the Agricultural-Conservation District and Low-Density Residential R-80, R-120, R-200 and R-400 Districts, accessory building and structure or other accessory uses shall be located in the required rear yard." The proposed accessory garage addition is located in the side yard. The "as-built" deck addition with "as-built" arbor has a front yard setback of 14.9 feet, which requires a minimum front yard setback of 60 feet, as shown on the updated survey by Nathan Taft Corwin III, L.S. dated July 13, 2016 and the Site Plan and Garage addition drawn by Thomas C. Samuels, Architect. The garage will expand from 2 bays to 3 bays (13 by 22 feet) with a loft for storage and conform to the design of the residence as shown on the Site Plan drawings by Thomas C. Samuels, Architect. ; ADDITIONAL INFORMATION: Board members inquired about two outdoor showers that were identified during a recent site visit, and asked the applicant's representative if the showers will remain. The applicant promptly responded via email correspondence on June 7,2018 indicating that the shower attached to the arbor will remain,while the shower attached,to the garage will not remain. The Board members and applicant also discussed the existing poor condition of the accessory garage, the prospect of an unintended demolition, and the applicant's responsibility to reapply to this Boaid, if demolition is warranted. Also noted during the hearing, ',no drainage is in place, therefore the applicant will be required, per Town Engineer's comments,to submit dt rainage plans. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on June 7,2018 at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings:; I� 1. Town Law§267-bQ(bl(1). (Grant of the variances or will not,produce an undesirable change in the character of the,neighborhood or a detriment to nearby properties. The parcel is adjacent to Hall's Creek and flagged wetlands. It is secluded and no neighbors will be affected by the proposed expansion of the as built accessory garage or the as built deck and arbor, both of which have been in existence for years without any negative impact to the community. Because of the angle of the existing house, the garage is considered as "partially located in the house's side yard". The addition to the garage improves a structure currently in disrepair with the proposed increase adding 286 sq. ft. to the structure resulting in approximately 33%increase in size. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. Because of the irregular shape of the parcel, and the angle at which the house is located on the property, the accessory garage, which is proposed to be renovated and expanded, is partially in the non-conforming-side yard and will therefore require variance relief. The as built deck and arbor cannot meet the code required front yard setback of 60 feet because of the proximity to tidal wetlands and Great Peconic Bay and will therefore require variance relief. 3. Town Law 5267-b(3)(b)(3). The variances granted herein are mathematically substantial, representing 100% relief from the code for the addition to the accessory garage and 75% relief from the code for both the as built wood deck and wood arbor.. However, none of the as built accessory structures can be seen from other properties and the setbacks are to a 20 foot R.O.W.which is only used as a foot path for a few other neighbors to access Great Peconic Bay. The addition to the existing garage having an increased height (22 feet maximum) allows for a dry storage area and retains the existing setbacks from the wetlands. The"as-built deck and arbor" provide shade and space for family gatherings and they are located at a substantial distance from the Bay and wetlands. 4. Town Law 5267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The proposed additions are landward of protected areas, and the as built structures are located near a dead end portion of a right of way and the improvements are isolated from neighbors.
