That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation, the said Permittee will be required, upon due notice, to remove or alter this work project herein stated without expenses to the Town of Southold. 8. That the said Board will be notified by the Permittee of the completion of the work authorized. 9. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit, which may be subject to revoke upon failure to obtain same. 10. No right to trespass or interfere with riparian rights. Herrmann En-Consultants 1319 North Sea Road Southampton, NY 11968 RE: RICHARD SACHS 2435 LAUREL WAY (aka 2435 LAUREL LAKE DRIVE), MATTITUCK SCTM# 1000-121-4-17.1 Dear Mr. Herrmann: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, May 15, 2019 regarding the above matter: WHEREAS, En-Consultants on behalf of RICHARD SACHS applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated March 5, 2019, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator recommended that the proposed application be found Inconsistent with the LWRP, and, WHEREAS, the Board of Trustees has furthered Policy 9.4 of the Local Waterfront Revitalization Program to the greatest extent possible through the imposition of the following Best Management Practice requirements: submission of revised plans and the use of thru-flow decking; and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on May 15, 2019 at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, 2 WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that for the mitigating factors and based upon the Best Management Practice requirement imposed above, the Board of Trustees deems the action to be Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code, and, RESOLVED, that the Board of Trustees approve the application of RICHARD SACHS to remove existing dock, consisting of a 1.5' x 14' ramp, 4.7' x 73' catwalk, and 7.3' x 11.9' terminal platform; and construct in its place a new dock (elevated 12 inches higher; beginning 8 feet farther landward; and extending 20 fewer feet into the lake), consisting of a 4' x 74' catwalk and 8' x 15' terminal platform (constructed entirely of untreated materials, including open-grate decking), all as depicted on the site plan prepared by Jeffrey T. Butler Engineering, P.E., P.C., last dated March 10, 2019; and stamped approved on May 15, 2019. Permit to construct and complete project will expire two years from the date the permit is signed. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with LWRP Policy 9.4, and therefore, INCONSISTENT with the LWRP. 9.4. Assure public access to public trust lands and navigable waters. E. Provide access to, and reasonable recreational use of, navigable waters and public trust lands under water. 9. Provide for free and unobstructed public use of all navigable waters below the line of mean high water for navigation, recreation, and other public trust purposes, including the incidental rights of public anchoring. The dock extends into Laurel Lake much further than adjacent docks in the waterbody. The length interrupts public recreational access along the nearshore (kayaking and canoeing). Water depth at the terminus of the dock is 5.75 feet and therefore there is opportunity to shorten the dock even further and still accommodate allowable vessels. Private dock structures extending into public trust waters obstruct public use of waters where the dock is located and does not meet this policy. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
