The following action was taken by the Southold Town Board of Trustees at their Regular
Meeting held on Wednesday, September 13, 2023.
RESOLVED that the Southold Town Board of Trustees APPROVE the Administrative
Amendment to Wetland Permit#9465 for the as-built 92sq.ft. grade-level masonry patio
and 47sq.ft. grade-level concrete pad adjacent to previously approved gravel patio;
surrounded by approximately 371f of 3' high concrete retaining wall; and adjacent
stepping stones; and as depicted on the survey prepared by Kenneth M. Woychuk Land
Surveying, PLLC, last dated August 22, 2023, and stamped approved on September 13,
2023.
Any other activity within 100' of the wetland boundary requires a permit from this office.
This is not an approval from any other agency.

DECLARATION OF COVENANTS

WITNESSETH:
WHEREAS, DECLARANT is the owner of certain real property located at 1335 Fleetwood
Road, Cutchogue, Town of Southold, County of Suffolk, State of New York, described in the Suffolk
County Tax Map as District 1000, Section 137, Block 4,Lot 30,which is more particularly bounded and
described as set forth in Schedule "A" annexed hereto,hereinafter referred to as the Property; and
WHEREAS,the Property is situated on lands within the jurisdiction of the Board of Trustees of
the Town of Southold(hereinafter the"Trustees")pursuant to Chapter 275 of the Town Code of the Town
of Southold or its successor, and various activities conducted upon the property may thus be subject to the
regulation and approval of the Trustees prior to being conducted; and
WHEREAS,the DECLARANT therefore made application to the Trustees for a permit pursuant to
the Wetlands Law of the Town of Southold to undertake certain regulated activities;and
WHEREAS,on May 15,2019,the Trustees approved the application and issued a permit with terms
and conditions;and
WHEREAS,the issued permit,terms and conditions of the permit,as well as the site plan prepared
by Meryl Kramer Architect,dated March 27,2019,and stamped approved on May 15,2019,upon which the
permit is based,are filed in the office of the Town of Southold Board of Trustees as Permit No.9465,and
annexed hereto as Schedule`B;"and
WHEREAS, as a condition of the granting of a Wetlands Permit to undertake such regulated
activities,the Trustees required that a ten-foot wide"non-turf buffer"be established and maintained
adjacent to top of bluff, leaving a 4' wide pathway through buffer to access bluff stairway, as depicted on
the site plan prepared by Meryl Kramer Architect,dated March 27,2019,and stamped approved on May 15,
2019;and
WHEREAS,the DECLARANT has considered the foregoing and has determined that the same
will be for the best interests of the DECLARANT and subsequent owners of the Property.
NOW,THEREFORE,the DECLARANT does hereby covenant and agree as follows:
1) Upon the substantial completion of the aforementioned permitted activities there shall be
established and perpetually maintained adjacent to top of bluff,leaving a 4' wide pathway
through buffer to access bluff stairway, a ten-foot wide"non-turf buffer"as defined by
Chapter 275 of the Town Code, as depicted on the site plan prepared by Meryl Kramer
Architect,dated March 27,2019,and stamped approved on May 15,2019.
2) The DECLARANT shall at all times comply with the Terms and Conditions of the permit,
a copy of which is attached hereto in Schedule`B"annexed hereto.
3) These covenants shall run with the land and shall be binding on the DECLARANT,his
heirs, assigns,purchasers,or successors in interest and may be modified only upon resolution
of the Board of Trustees.

' TERMS AND CONDITIONS

The Permittee Andrew Fohrkolb residing at 1335 Fleetwood Road, Cutchogue, New York as part
of the consideration for the issuance of the Permit does understand and prescribe to the following:
t l. That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages,of suits arising directly or indirectly as a result of any
i operation performed pursuant to this permit, and the said Permittee will,at his or her own
expense,defend any and all such suits initiated by third parties, and the said Permittee
fassumes full liability with respect thereto,to the complete exclusion of the Board of Trustees
of the Town of Southold.

2. That this Permit is valid for a period of 24 months,which is considered to be the estimated
I time required to complete the work involved, but should circumstances warrant,request for
an extension may be made to the Board at a later date.
! 3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved,to provide evidence to anyone concerned that
authorization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work herein
authorized.

6. That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.

7. That if future operations of the Town of Southold require the removal and/or alterations in the
location of the work herein authorized,or if,in the opinion of the Board of Trustees,the work
I shall cause unreasonable obstruction to free navigation,the said Permittee will be required,
upon due notice,to remove or alter this work project herein stated without expenses to the
Town of Southold.
8. The Permittee is required to provide evidence that a copy of this Trustee permit has been

TERMS AND CONDITIG-135
The Permittee Andrew Fohrkolb residing at 1335 Fleetwood Road, Cutchogue, New York as part
of the consideration for the issuance of the Permit does understand and prescribe to the following:
1. That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees
of the Town of Southold.
2. That this Permit is valid for a period of 24 months,which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved,to provide evidence to anyone concerned that
authorization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work herein
authorized.
6. That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
7. That if future operations of the Town of Southold require the removal and/or alterations in the
location of the work herein authorized, or if, in the opinion of the Board of Trustees,the work
shall cause unreasonable obstruction to free navigation,the said Permittee will be required,
upon due notice,to remove or alter this work project herein stated without expenses to the
Town of Southold.
8. The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to

The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, May 15, 2019 regarding the above matter:
WHEREAS, En-Consultants on behalf of ANDREW FOHRKOLB applied to the Southold Town
Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the
Wetland Ordinance of the Town of Southold, application dated March 29, 2019, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
and to the Local Waterfront Revitalization Program Coordinator for their findings and
recommendations, and,
WHEREAS, the,LWRP Coordinator issued a recommendation that the application be found
Consistent with the Local Waterfront Revitalization Program policy standards, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
May 15, 2019 at which time all interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold
Town Code,

WHEREAS, the Board has determined that the project as proposed will not affect the health,
safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees have found the application to be Consistent with the
Local Waterfront Revitalization Program, and,
RESOLVED, that the Board of Trustees APPROVE the application of ANDREW FOHRKOLB to
demolish and remove existing one-story building and outdoor shower; construct approximately
1,788sq.ft. 1 & 2 story, single-family dwelling with 39sq.ft. and 65sq.ft. roofed over patios,

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, the proposed action is
recommended as CONSISTENT with the LWRP provided the following is required to further Policy
6.
1. Require that the non-turf buffer be vegetated.
2. Retain the existing trees seaward of the proposed residential structure.
3. Consider requiring the installation of a I/A OWTS to preserve groundwater and
surface water quality.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this
application and determines that this review falls under-the Type II category of the State's List of Actions,without
further steps under SEQRA.
SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk
County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its
reply dated December 17,2018 stating that this application is considered a matter for local determination as there
appears to be no significant county-wide or inter-community impact.
- - LWRP-- DETERMINATION: - This- application_ was referred for_review under Chapter_268,_ Waterfront
Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program
(LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated April 9, 2019. Based upon
the information provided on the LWRP Consistency Assessment Form submitted, as well as the records
available, it is recommended that the proposed action is EXEMPT from Coastal Consistency Review.
PROPERTY FACTS/DESCRIPTION: The subject property is an irregularly shaped 21, 225 sq. ft. parcel that
abuts East Creek. The property has a 31.00 feet frontage on Fleetwood road,then runs 268.03 feet towards East
Creek, the East Creek frontage is 125.71 feet, which returns 329.65 feet back towards Fleetwood Road. The
property is improved with two structures, one is an existing 8 ft. by 12 ft. shed, and an existing one-story garage
as shown on a survey prepared by Kenneth M. Woychuck, L.S. dated April 26, 2018. Both structures are slated
for removal as part of the project. The building envelope sits behind a bluff that goes down towards East Creek
with an existing'set of wood stairs, shed, catwalk, and floating dock at water level.
BASIS OF APPLICATION: Request for Variances under Article XXIE, Section 280-124; and the Building
Inspector's August 30, 2018, Amended September 18, 2018 Notice of Disapproval based on an application for a
permit to construct a new single family dwelling and an accessory garage, at; 1) less than the code required
minimum side yard setback of 15 feet,2) less than the code required minimum total side yard setback of 35 feet;
at: 1335 Fleetwood Road, Cutchogue,NY. SCTM#1000-137-4-30.

RELIEF REQUESTED: The applicant requests variances to construct a new single-family dwelling with a
single side yard setback of 11 feet where 15 feet is required, and a variance for a 21feet combined side yard
setback where a 35 feet combined side yard setback is required.
ADDITIONAL INFORMATION: Testimony was given by the applicant's attorney and architect as to the
proposed removal of existing structures on the subject property and the siting of a proposed new dwelling and
accessory garage he They also reviewed the history of the property, explaining that there was once a single-
family residence and accessory garage on the subject parcel. The dwelling was destroyed in a fire in 1984,
leaving just the accessory garage that is still in use. In the same year, a permit was issued to demolish the fire
damaged dwelling. Questions were asked about the proposed septic system, and the need for a new IA advanced
septic system. Aerial photographs were presented showing the neighboring properties and both written and oral
testimony was given by the surrounding neighbors of the property in support of the project.
AMENDED RELIEF: _The Notice of Disapproval, dated September 18, 2018, indicated the proposed
construction to be setback 11 feet from the single side yard, with a 22 feet combined side yard setback. During
the public hearing, the Board discussed with the applicant's attorney that the survey shows the closest setback
from the single side yard to be 10 feet not 11 feet and the applicant's representative confirmed that the relief
being sought is for a 10 feet single side yard and 21 feet combined side yard.
FINDINGS OF FACT/REASONS FOR BOARD ACTION:
The Zoning Board of Appeals held a public hearing on this application on April 11, 2019 at which time written
and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property
and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and
relevant and makes the following findings:
1. Town Law $267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character
of the neighborhood or a detriment to nearby properties. The Fleets Neck neighborhood is characterized by
similar size dwellings with similar shaped narrow lots. Aerial photographs presented to the Board confirm that
the neighboring dwellings are constructed on narrow lots with minimal side yard setbacks. This proposed
residence will be in keeping with the existing character of the neighborhood.
2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method,
feasible for the applicant to pursue, other than an area variance. The proposed location of the house is respecting
the front and rear (waterfront) setbacks, but side yard relief would be needed for almost any proposed structure
on the site, given how narrow the width is. It is of note that only a small part of the house, and a portion of the
garage require setback relief due to the triangular shape of the property.
3. Town Law §267-b(3)(b)(3). The variances granted herein are mathematically substantial, representing a
33% relief for the single side yard setback, and a 40% relief for the combined side yard setbacks. However, only
71.9 sq. ft. of the proposed residence lies within the non-conforming side yard setback, and the remaining relief
applies to a covered walkway and a portion of the garage for a total of 400 square feet needing relief.
4. Town Law $267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential
community will have an adverse impact on the physical or environmental conditions in the neighborhood. The
proposed residence is in a conforming location as per the bluff setback. The applicant must comply with Chapter
236 of the Town's Storm Water Management Code and the conditions set forth by this board.

the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the
limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. Due to
the irregular shape of the parcel, it would be very difficult to fit a house that is in character with the surrounding
neighborhood on the property without variance relief.
6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the
applicant to enjoy the benefit of a single-family residence while preserving and protecting the character of the
neighborhood and the health, safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under
New York Town Law 267-B, motion was offered by Member Lehnert, seconded by Member Planamento, and
duly carried,to
GRANT the variances as AMENDED FOR A SINGLE SIDE YARD SETBACK OF 10 FEET AND A
COMBINED SIDE YARD SETBACK OF 21 FEET as shown on architectural plans (Pages A-001, A-101,
A102,A-200 and A-201)prepared by Meryl Kramer,R.A., dated August 22, 2019.
SUBJECT TO THE FOLLOWING CONDITIONS:
1. The second-floor roof deck on the main house shall remain open to the sky in perpetuity.
2. The covered deck shall remain unenclosed and shall never be turned into habitable space.
3. The roof over the covered deck shall never be used as a second-floor walkway.
That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued.
Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays
and/or a possible denial by the Building Department of a building permit and may require a new application and
public hearing before the Zoning Board of Appeals.
Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or
survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application
when involving nonconformities under the zoning code. This action does not authorize or condone any current
or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such
uses, setbacks and other features as are expressly addressed in this action.
The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does
not increase the degree of nonconformity.
Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by
the Board of Appeals shall become null and void where a Certificate of Occupancy has not been
procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within
three (3)years from the date such variance was granted. The Board of Appeals may, upon

Wetlands Statement of Effect
The subject property is unimproved except for an existing accessory building with
outdoor shower, a bluff stairway, and a dock. The proposed development of the property
consists of the construction of a new one and two-story dwelling located a minimum of
44 to 50 feet from the top of bluff and more than 90 feet from tidal wetlands associated
with East Creek. Due to the limited buildable land area landward of the top of bluff
(14,570 sf) and the significant narrowing of the landward half of the lot, it is not possible
to locate the dwelling 100 feet from the top of bluff. However, the property is highly
elevated and well protected from flooding; and the bluff facing East Creek is stable and
heavily vegetated with trees and other significant vegetation. Moreover, the dwelling has
been designed to achieve the maximum, reasonably practicable bluff setbacks; and
instead of decks, on-grade masonry and pervious gravel patio areas are proposed on the
east side of the house to minimize structural areas and potential runoff on the waterside
of the dwelling. The project proposes to further minimize potential impacts associated
with the development of the property by protecting water quality and protecting and
restoring the quality and function of the adjacent bluff and tidal wetland ecosystem
through additional mitigation measures, including 1) removal of the existing accessory
building and outdoor shower located 10 feet from the top of bluff; 2) establishment of a
10' wide non-turf buffer in place of existing lawn adjacent to the top of bluff, 3)
installation of a proposed drainage system of leaders, gutters, and drywells to collect and
recharge roof runoff, 4) use of a project limiting fence to control site disturbance and
runoff during construction; and 5)removal and replacement of an existing sanitary
system located approximately 52 feet from the top of bluff and less than 100 feet from
tidal wetlands with a new sanitary system located outside Chapter 275 jurisdiction, more
than 100 feet from the top of bluff and more than 160 feet from tidal wetlands.
Therefore, the project will not have any significant adverse impacts on the adjacent tidal
wetlands or surface waters of the Town.

Due to the limited buildable land area(14,570 sf)landward of the top of bluff and the significant narrowing of the landward half of the
lot,it is not possible for the proposed dwelling to meet a 100'setback from the top of bluff. However,the property is highly elevated
and well protected from flooding;and the bluff facing East Creek is stable and heavily vegetated with trees and other vegetation.
Moreover,the dwelling has been designed to achieve the maximum reasonably practicable bluff setbacks;and on-grade masonry and

The subject property is unimproved except for an existing accessory building with
outdoor shower, a bluff stairway, and a dock. The proposed development of the property
consists of the construction of a new one and two-story dwelling located a minimum of
44 to 50 feet from the top of bluff and more than 90 feet from tidal wetlands associated
with East Creek. Due to the limited buildable land area landward of the top of bluff
(14,570 sf) and the significant narrowing of the landward half of the lot, it is not possible
to locate the dwelling 100 feet from the top of bluff. However, the property is highly
elevated and well protected from flooding; and the bluff facing East Creek is stable and
heavily vegetated with trees and other significant vegetation. Moreover, the dwelling has
been designed to achieve the maximum, reasonably practicable bluff setbacks; and
instead of decks, on-grade masonry and pervious gravel patio areas are proposed on the
east side of the house to minimize structural areas and potential runoff on the waterside
of the dwelling. The project proposes to further minimize potential impacts associated
with the development of the property by protecting water quality and protecting and
restoring the quality and function of the adjacent bluff and tidal wetland ecosystem
through additional mitigation measures, including 1)removal of the existing accessory
building and outdoor shower located 10 feet from the top of bluff; 2) establishment of a
10' wide non-turf buffer in place of existing lawn adjacent to the top of bluff; 3)
installation of a proposed drainage system of leaders, gutters, and drywells to collect and
recharge roof runoff; 4) use of a project limiting fence to control site disturbance and
runoff during construction; and 5)removal and replacement of an existing sanitary
system located approximately 52 feet from the top of bluff and less than 100 feet from
tidal wetlands with a new sanitary system located outside Chapter 275 jurisdiction,more
than 100 feet from the top of bluff and more than 160 feet from tidal wetlands.
Therefore, the project will be consistent with Policies 5 and 6 of the LWRP.
