After discussing this issue with Mr. Verity, it was determined that the code was in effect at the time that our application for a Notice Disapproval was submitted on February 22, 2017. The Town Board had voted on February 14, 2017 to change the definition. The new'Definition states the following: DEMOLITION--Any removal of a structure or portion thereof where the totbtbdst,of the reconstruction of the structure or portion thereof exceeds 50% of the market value of the existing structure before the start of removal. Mr. Verity stated that the issuing of a Building Permit in the future would require an appraisal to determine the Market Value of the existing structure, and that construction costs of the renovations and additions would not exceed 50% of the-appraisal. If this is not achievable; an additional Notice of Disapproval would be written and the Building Permit denied. Please get back to me if I can answer any additional questions.
